I was away this morning for a big community project that I am involved in. I wanted to round that off with a morning brunch with the Congressman I quoted, but couldn't pull it off. I had met Mr. Mark Udall a couple of times in Friendship and Business Chamber get together in Denver, CO. He is a fine gentleman.

I found the EAD v/s H1B article quite informative, articulate and really eye-opening. I dont see any issues with posting links to other immigration sites, PROVIDED those links are not simply marketing links and DO actually provide good immigration-related info. Some of the stuff he has written makes a lot of sense and Ron is not taking the same stance everyone else takes where they advise people to stay on H1B status to keep milking them for attorney fees.

From a Constitution standpoint, Obama believes the Congress should pass the law and his executive branch will implement it.
Unfortunately, thanks to the filibuster, the senate is broken and nothing important has gotten passed. The Health care bill was watered down to make it almost useless.
He seems to forget that he also has a role of a leader to move the country in the right direction even if it may be unpopular.
There are issues that have over 60% support (eg. Don't ask Don't tell, Legal immigration issues, Energy tax credit, etc.) that he can support via executive orders but refuses to do so from a standpoint of the Constitution.
So, we are at

My PD is Feb 2004, so I've been current for almost 2 months now. Though, my ND is 9/12/2007 and NSC is processing 7/14/2007, so that's not current yet...
Receipt date and not notice date is the factor.
Also, NSC has been processing even people with October notice dates and appoved people with current PDs.

It is 7 years for your 1040 forms when you file W2 returns, so I would guess you have to keep all related docs for 7 years, if for any reason it gets audited, then IRS could ask for more than 7 years records.

Dear Pappu and Core Members,
I appreciate all your efforts and have made my own contributions to support what IV does. Lately due to the political standstill in the House, we have not seen much movement on the immigration issue. At the same time it is important to have some actions illustrated in the open forum to attract the attention of new members and existing members who continue to visit this website. I am of the opinion that unless the 'interest level' of people is maintained in coming to this website, understanding the action items and following them, people will lose interest in visiting this website.

Your dependents are "in status" as their I485 pending. donot worry about it. You will receive your card within 3-4 days.
Currently they are of course in status. The problem here is with the RFE for which the poster does not have the required primary evidence. If the RFE is not answered (or even not answered to the satisfaction of the immigration officer), then the I-485's for the dependents would be denied, and then they would be out of status since the primary applicant is no longer in H1-B.

guys i think USCIS is not interested in giving EB 3 guys GC...
as mostly EB 3 guys r ppl with Bachelors (and less than 5 yrs exp) or who are stuck with EB3 due to there company (like me)...
EB 2 guys r mostly with ppl having masters degree from US...so i guess they will definetly get more preference than eb3...
I guess US wants to raise there economy by giving GCs...so that ppl more ppl will buy houses....
I hope something happens for EB3 also...but I guess in Oct bulletin PD for EB3 will b some month in 2001....
so gud luck to all of us

go ahead and invoke AC-21, you are not necessarily going to run into the problems that poster faced (in fact based on anecdotes on Forums the AC-21 related denials by USCIS have gone down a lot since 2005, probably because of the yates memo that came out then calrifying all this). Try to stay on H1 as long as possible though (you dont HAVE to use EAD to invoke AC-21 and change jobs).
At the end of the day a lot depends on your luck. Some people get unlucky and end up with all this nonsense, some people end up getting caught in namecheck... they are both thankfully a small percentage of the cases, so dont let your career choices be decided by what USCIS might do. Take precautions where possible (staying on H1 etc) but do what you think is right for your career and family. The whole point of this AC-21 clause was to provide flexibility to the employee, make use of it.

Its called a form-letter.
The staff writes those.
They use the same letter and change the name and address of the constituent and copy-paste the generic position on immigration.
That is the reason you are seeing a letter that casts a wide net on immigration issues, like border security, illegals, etc. etc. The staff would send out the same letter to all constituents who are writing for or against immigration or any issue related to immigration.

US State Department doesn't send emails via ".com" domain
If it doesn't have ".gov" at the end of the email address, don't even bother to read the contents.
