I did not like the idea of getting a red dot inspite of contributing $500 to IV. This is not a good idea of IV to flag members. I will take this up with my state chapter.

We went home after my wife started working using the EAD. After we came back we applied for your H1 and H4 extension and one we got that now we are in H status instead of EAD status. It is a little tricky. When we came back we entered as parolee but once we applied and extended our H1\H4 status we ar eback to H1\H4 status. Your lawyer would be able to explain it better.
My lawyer suggetsed that it is better to be in H status as it gives some manuvering time and opportunity in case the 485 is denied.

I want to thank this european who got his greencard 2 weeks back but still attended the rally. There may be more heroes like this. I was in a group of people when we spoke to him, didnt catch his name as i was encouraging bypassers to honk their cars to support our cause.

I am not sure the supplimental bill helps much to provide relief. it would basically create bunch of more backlogs at CIS and would even make 6 months to 1 year for EAD appoval , causing more backlog.

I filed mine on May 12 and sent to Phoenix Lock box and had the same issue. My checks are not cashed and am going through the same pain as you do. My lawyer suggested its not unusual to have these delays and it could take upto 4 weeks for the receipt notice to come. I am still tensed as the checks are not cashed and there is no receipt for the renewal. Please let me know how you are proceeding or find any new info

I know that if you don't have H1 stamping you need AP to reenter. But if you have AP why do you need H1 stamping if you are working for the same H1 employer after reentery? Is H1 stamping a backup to AP?
Some people want to maintain H1B even after AP is approved, just so that they can bring their dependents. But its also nice to have AP in case your H1B visa is rejected.

There is good chance that we might loose visas this year too....with USCIS allocating resoucers to citizenship apps given the elections in november.
We need to prevent that....that ought to be priority # 1....recapture can happen in parallel .
Last year there were not unused visas.

Not sure if anyone experienced this, but on 2 computers this site, antivirus software detected a virus & my work PC (protected with McAfee) is not booting up, IT said my hard drive has been corrupted. My laptop survived with a freeware anti virus. Please don't give me any reds, this is what happened to me, I just wanted to warn any unprotected members of IV.

I am seeing layoffs are on rise in IT sector these days in California. I am in a good business district area in southern California and most of the companies have frozen new hirings and lots of others are laying off.
Job sites are showing many openings but even if you apply the percentage of calls you get have reduced drastically. Hanging on to wht you got if you can seems to be the only option these days..

I say try to get as many shots as possible at your PCP. For TB and HIV tell him that you have been to India lately and want to make sure everything is okay. For other shots tell him that you are considering to apply for a medical/dental school and need to get vaccination records, which you don't have because everything was done in India. Take all those proof to immegration doctor, he will accept those records.
My wife in fact joined dental school last year. She needed only HIV.
You can ask PCP to give all the shots as part of yearly physical or mention that your immunizations are not current and you need those shots to be current.

By now, we all know of at least one person who lost his/her job recently. Unfortunately, this is a very tough time for all the people around the world, not just here in the US. But, we have to worry about our status here in the US.
This is the one community which helps people like us, who are still waiting to go GREEN!!!. No body is going to help you or me get a job when we lose one. We have to help ourselves. We have to help each other.
So, Friends, apart from sharing the bad news of layoffs with the community, please also share any job openings here. Let us try to help the ones here, without a job, to get one. I know it is not a job portal, but this is the one place, where we all immigrants come together. This is the time to help each other. So, Admins, can we create a separate thread to post known job openings that can help our friends here at IV.

I think the process is designed for 'non-backlogged' processing which normally does not extend beyond a few months...you are right, maybe, we should have a different validity in the current situation with long backlogs.

Hi,
My attorney received an EVL RFE for my I-485 case. My PD is 2007 EB3 so I don't have any hope of getting GC but I guess they are just pre-adjucating my case.
Here is my situation - I filed my !-485 in Aug 2007 and changed job (without filing any AC-21 paperwork with USCIS) in April 2008. My attorney had looked at new job description and given green signal for change. My entire immigration history of 10 years in US is totally clean with no gaps and with all work autorizations.
Now, my concern is that the letter that my attorney has prepared for my current employer to sign has lot of legal lingo (AC-21 language, lot of CFRs, info related to my LCA and I-140) and has some language to the effect of supporting my LCA and I-140 till my GC is approved. It also states that my current employer was able to afford to pay my salary since the LCA date. My employer is fortune 5 company so money wise there is no problem but my concern is that they may not want to sign such a lengthy (wordy) legal doc without consulting their Immi attorney. I don't have much time to respond (only 8 more days). So if my employer takes long time or tells me that they can not sign it, I want to be ready with Plan B. Can someone suggest what should I do?
1 - should I prepare a simple document with job duties, responsibilities, start date, salary etc that my employer will be willing to sign. So at last moment I can atleast get that signed. Something will be better than nothing.
2 - Should I / (bigger question is can I) ask USCIS to give me more time to respond to RFE?
3. Provide simple letter from employer with an affedavit or something stating that the new job is same / similar as the old job.

I am sure we'll all hear from IV core team when it's time to start our phone and fax campaign in support of this or any other beneficial EB provisions to be included in the supplemental bill, if it ever happens of course.

While I was looking for residency, one senior doctor told me that I should wait and get H1. At that time, I was so interested in getting residency at the earliest that I did not take his advice and instead got J1. It was only towards the end of my training that I realized that to get a waiver is so difficult, in my speciality branch. i had to get O1 visa first to buy time to look for J1, which I finally did in a remote western town.
Now it may be easier, since many VA hospitals are hiring for J1 conversion, which was not so at my time.
Again, if possible, try for H1.

Major flaw in your analogy is you failed to imply that only USCIS can produce TVs worldwide and it can produce only 140k of them for worldwide customers. Also they can only produce 7% of 140k for each country to fit each country's specifications. They sure will have customers, doesn't matter if their customer service sucks. Simple supply and demand theory.
