I was hoping that AILA would ask questions on capturing unused visa numbers and EB visa usage per year from USCIS!
I dont think USCIS can make a decision on capturing unused visa numbers. It is a directive that has to come down someone higher up, the president maybe. So AILA cannot ask them that question.
About annual wastage of visa numbers, since Ron Gotcher bought this news out, it must have already been discussed in an earlier [but recent] meeting or perhaps Ron has his own channel.

Doesn't your H1 renewal come with a valid I-94? Please check that. If not, Why don't you go to the local office in person, I am sure they will adjust it. Try going to the border it does not hurt, I thgink the rule is 30 days as mentioned in your other thread.

So what you are saying is that INS and IRS systems are connected?
I can back that one up. We received audit August 13 for 2005. Had to prove we are married & kids live with us. When called and spoke to officer she said it was an "INS flag"! Honest to God that is what she said. She then asked if we had applied in the last couple of months for 485's??? She knew all about the USCIS system and said one way of telling is if you file jointly at the same address each year then why would IRS be asking for proof of marriage and kids living there etc. She was great and confirmed they had received all paperwork. Had to resend due to liquid being spilled on copies.... Even H&R Block said it was INS based.
Then we get 4 out of 5 EAD's approved, but spouse gets RFE and it is proof of name change please resubmit marriage certificate!

The time and efforts put in by these core members is unknown to many of us; but as sensible and logical thinking persons can easily visualize that.

IV is in touch with USCIS, Admin officials as well and continuing our efforts with lawmakers. A year ago it was difficult to imagine. We have covered lot of ground in the past one year and this year due to the support of all our members we feel very motivated. Visa bulletins are very negative and let it be an inspiration for all of us to work harder to get rid of retrogression.

There is nothing funny about our state in US. Unless the humor is very dark the relevance will be lost. The idea can't bee to make another Monsoon Wedding.
There are many ways of telling a story. It can be either with humor or sentiment or any thing else. If we are presenting a story that was meant for telling problems (like h1b/GC process) presenting only problems will not achieve our goal in publicity. Show something that audience like (most of people like healthy humor I think) and include your concept/problem in that so that it will get in to people. Otherwise it will be so called award movie with lot of tears and sadness. Even that would work if it was presented with lots of creativity.
Any way problems are not only in US and they are there everywhere. I am also struggling with these Visa issues (GC waiting since 2002), but that doesn’t mean I haven’t had any humor in my life here in US. I didn’t understand your comment against movie like monsoon wedding. Please elaborate.

If your I-94 expires you will be out of status ... it would be best if you take your new passport and travel outside immediatly before its expiration so that you can get a new I-94. The earlier IO probably didn't give you an I-94 till 2010 because your passport was expiring within 6 months.
I think you need to act on it urgently.
I have the same issue. My wife I-94 was issued based on her passport expiry date and not on her I-797 expiry date. I called up my attorney and she told that the best way to deal with this issue is to travel out of the country. If anybody had renewed it without making a travel, please post here.

I had my FP taken at 9:30AM today. I just checked, and my I485 has a LUD today; immediately after FP were taken. So they did update my case almost immediately after taking FPs.

just wanted to share my Finger Printing Experience.
I am july 2nd filer, EB2.
NSC -CSC - NSC case.
Got my FP done today,
however I noticed that on my ASC notice, my SSN has been printed incorrectly.
I called USCIS and made the correction.
I was surprised & furious at the same time, by seeing this mistake from USCIS.
Their system is so bad, they are not even verifying the Name to the corresponding SSN. Had I missed to notice, I would have been stuck either at FBI name check or by a querry from USCIS later for a long long time.
Already the wait is long enough.
Anyways, dont relax just seeing your EADs and APs, watch every detail on whatever they send.

I also don't think this is true. After you get your 3-year H1B extension beyound the 6-year limit and say your 485 gets denied while you are in 7th year, you can still stay and work for the rest of the 2 years on your H1B and use those 2 years to file for new LC etc.

Sorry to hear that case is gone to wrong office. The (c)(9)() class of EAD filing instruction is that it must be sent where I485 is being processed.
During infopass visit, officer must have given some clue.
If I were you, I would be sending the supporting documents with a covering letter stating the blunder. This type of mistake should not be uncommon to USCIS offices and they should have procedures to fix it.

I found one of your earlier posts on this forum suggesting that 3 years back you were in the same situation as I am today - expired VISA and two extension approvals (797's). In my case, VISA expired in oct 09, current 797 expires 31 dec 09 and next (against I-140) starts jan 2010.
As your's was the only post i found on this topic, it will help me a great deal if you could let me know about your stamping experience. You mentioned that your stamp showed validity dates from both 797's, could you please share some more details on that? Did it have two start dates and end dates?
Besides, from another one of your posts, i gathered that it is best that i come back into the us only when my newer 797 is already active. i guess it wud reduce complications at POE. Would appreciate if you could give me some suggestions here too.

I totoally agree. We need to educate people who are not familiar with the legal immigration system.
For the organized efforts of IV Brand Ambassador--one of my American friend, who is a retiree suggested that I go to present at the retirement center. The retirement center he has in mind houses mostly well-off retired professionals and active AARP members. My friend said these people have strong influence because their established financial and social status--even political status.
Would IV be facilitating/ organizing on-going efforts across states to really deliver our message to American citizens?

One hour later I saw them marching with us holding flowers that some of our volunteers were distributing to passer bys. One gentleman was a school teacher.
Additionally, one of our best friends can be American citizen who understand the issue from economic, personal and other perspectives. If they become part of our voice we will become more effective.
Each one of us has to become "IV brand ambassador" and present our issue in right perspective to counter so much misinformation floated by some vested interests. Yes, you can do it. We can facilitate.
