I don't know if I didn't understand this right but one of my friends came to U.S like 5 yrs back in 2002.
Never left the country fo far.
She came on H4 and at that time her I-94 was till Apr/2005.
She got H1 in 2004 with new I-94 till May/2007.
Got her H1 extension( with new I-94 dates.)
The I-94 she got at the port of entry expired but her employer told her it is not a problem as her H1 has a I-94 with new dates.
I know in your cases(s) you have passport expiry thing. But I guess it's still the same right. I gues your H1 will have new I-94 in it .So what is the descrepency?

You need to follow instructions. It makes no difference in processing time if your I-485 application is pending in NSC and based on instruction you need to apply in TSC and Vice Versa.
In fact I think, load sharing is going on. I applied I-765 at NSC but case is handled by MSC. Don't be surprized, that you apply at TSC and case being handled by other office.

On papaer it sounds like a very good idea. I have canadian PR and I was also very tempted when I read this. But here are some disadvantages:
1. Windsor is a small place so hard for wife to find a job there.
2. Schools may not be the same quality as Toronto.
3. You might be putting your career in holding mode for another 1-2 years whereas you could do a much better job in Toronto.
Basically, my point is in order to try to wait for GC for another 1-2 years, you might have to compromise with your job/wife's job/kids education. I am at a point where I don't want to compromise with any of these if I move to canada. I want to make full use of the freedom of having a PR (take up whatever job/start a business/have wife take up whatever job/good school for kids etc)
I really depends on your situation, by what date do u need to move to canada to retain the PR and what stage of GC process are you in?
I was thinking this is a good way for short term period until we know for sure what is going to happen to us as far as GC situation is concerned. It may not make the most sense in the long term but is a good way of hedging your bets until you know for sure which way immigration issues are headed.
This may be a good soln for people who do not want to loose their Canadian PR or those who dont want to move back to India for their own reasons (ppl like me who have been in this country for 10 plus yrs on F1 and H1 cobined but with no GC in sight).

To get a 3 year extension:
* I-140 needs to be approved, AND
* your PD in the current months VB needs to be retrogressed.
If I-140 is still pending, either it needs to be pending >365 days, or your LC itself should have been filed >365 days ago.

my application reached NSC at 7:55am on July 2nd and I got my physical receipt notice today, mine was signed for by R Williams. checks didnt get cashed yet.

I started the US immigration in 2006, PD-September 2006, by CP, EB3ROW. DS230 renewed 3 times since then... a couple of months ago I applied to Canadian PR, now I am waiting for my interview date. So I have two processes parallel - US GC & Canadian PR. My question is : How these two immigrations can jeopardise each other? :confused:
Logicaly I will attend the Canadian interview first, will they ask me about US immigration? should I tell the truth? Will they deny the PR because of the GC process?
Presume that I have successfuly done with canadians and have landed in Canada with my PR in 8-10 months from now, and suddenly, I,ve got an invitation to the GC interview... :eek: Does the fact that I have a Can. PR will kill my future GC and at the interview the will deny and cancell my case? :confused: Or The interview will be successful and I will have my GC, but somewere in the future there is a point where I should refuse one - GC or PR? :confused:
I should mention that the GC is the choise No1 , and PR is a plan "B"...
I believe that my situation is not unique, but now I am out side the US and in my country it is difficult to find a competent lawer. So I hope that somebody from this forum could answer my questions.

I am planning to leave my current employer and move to a different one. I have got my I-140 approved under EB3 category from the current employer. While moving to the new employer, I want to retain my priority dates. I would like to know what kind of documents are needed in order to do the same. I am presuming that a copy of I-140 approval notice would be needed from current employer that I am sure that my current employer would not give me. So what is my chance in this case? is there any way, I can get it from USCIS? Has anybody got it successfully from other than the employer? Are there any other documents , I need from my current employer. Please suggest.

Just to add -
If customer is from India/China/Mexico then they will receive the product in 10 years. Rest all can get it in 3/4 years.
If customer uses Master Card (EB-1) then they get it in 6 months, Discover (EB-2) in 1 year. Rest all will wait for a long time.
Their order goes in pending queue, if they do not receive the product within 1 year then they have to renew the order and customer will pay for this renewal.
9 YEARS AND COUNTING.........................
Discover (EB-2) in 1 year - I hope this period is not for India.
I am EB2 waiting for last 7 years. And had no idea when this wait period will end.

You will get your card between 5 to 10 days from the date you have recieved card production email, so you will have time to go India and get the marriage certificate.

A recruiter would fall into a diferent job code basket. If the job offer is written to match responsibilities of your current job, you may be OK. This is really a question for lawyers and I suspect not all lawyers may concur in this case.
There is another option where you can get a new labor + new I140 for the new job and replace the 140 of your 485 applications. I would suggest you get the opinion of a second lawyer, just to be on the safer side.

I have recently moved out of state and started on a different job. I updated my address with USCIS online last week. I just got a email from CRIS for RFE. I have I-140 has been approved since 2004 and applied for I-485 in July 07. My lawyer is from Frogman firm. This was the firm used by my GC sponsor employer. My new position is slight different from Software Developer to Lead System Analyst. I think this should be covered with same or similar clause.
If you have prior experience please let me what to expect and do any preparation now itself.

Hello guys,
My frustration is increasing and patience going down. I am strongly considering moving back to India. When planning the move, a few questions popped in my head the answer to which I am not able to find (yet); hence putting it out here.
1. How can I inform SSN department or credit bureau that I am not longer in USA..hence no one can use my SSN even if it gets stolen? Is there a way to "lock" things down?
2. What happens to 401K? Is there a IRS tax law that says because this guy was on H1-B and leaving..don't charge him the 40% penalty?
2.1 After 40% in penalty and 30% in taxes...with the market beaten down...not much remains...wonder if it's even worth touching it. So if I decide to leave the money here in my 401K account, what happens when I want to withdraw it? Rather what is the best way to withdraw it?
3. Any estimates on how much it costs to ship things back to India? I live in 2 bedroom apt..so have the usual stuff.....couch, bed, tv, clothes of many sizes, lots of kitchen utensils. Just an average...I understand things can vary a lot.

The best approach in this case would be to phase out the withdrawal amounts over a period of successive years. When you are in India, you are not earning US income. So say if you take 10K the first year, it will be considered income earned in US for which you have to pay tax. Since 10K is below the standard deduction amt, you will not have to pay any tax. The penalty will still apply as you are breaking the 401K.

Sorry to hear that case is gone to wrong office. The (c)(9)() class of EAD filing instruction is that it must be sent where I485 is being processed.
During infopass visit, officer must have given some clue.
If I were you, I would be sending the supporting documents with a covering letter stating the blunder. This type of mistake should not be uncommon to USCIS offices and they should have procedures to fix it.
