Well, you have not pissed me at all. I did what IV had asked in one month back. I had sent my 2 letters (me and my wife) 17 days back and collected another 12 letters from friends and send them too. I had contributed what ever IV had asked until now, what ever it may be.
I am sorry, but just a note can baffle you guys and you put all the -ve comments to the post, then sorry to say you guys cannot take any constructive opinion from others. And I think I did no wrong in asking Chanduv to stop posting innumerable threads just for one cause.

Thank you Tom and Zcool.
I did try asking my manager and the vendor if they could mention that the project could go on for another 3 years but was not successful.
The letter that I got from my manager did mention that I have been working for them (client) since jun, 2005 under a contract extendable in 6 month increments and they see a need for me for the forseeable future.
I believe my company has some direct clients... I will ask my employer to attach those contracts as well.

FYI: I got my I-140 approved on 07/06/2007 after 7 months of wait. This just makes me think that while approving I-140 they didnt even looked at my H1B. The processing of these applications are completely separate. Since my I-140 got approved recently, my employer might not have lot of issues with IRS or INS. ??????????? what do you guys think.

Thanks for all the replies that you guys have been posting to this thread. On one hand I am happy that I am not alone facing this issue at the same time I am sad that we all are having to deal with this issue.
Anyways, what I have learned so far based on my research is that the reason USCIS was rejecting my application was because they wanted to figure out if I qualify for the fee waiver based on the July 30, 2007 rule. The I-485 receipt notice apparently depicts the fee paid to USCIS and hence is an easy way for someone to tell if they qualify for that.
Apparently, the personnel screening the applications at the USCIS Phoenix Lock Box have been told to use the I-485 receipt notice to figure out if the correct fee has been provided with the application. So if the I-485 receipt notice is missing (as it is for some of us), they don't know how to determine if the correct fee has been provided or not. Apparently, they can't go into the system and pull our I-485 records to check (or perhaps they don't want to). That's the reason they reject the application with those two seemingly unrelated reasons.
I have eFiled this time and hence I have bypassed that screening in some ways. My application should not be rejected due to this anymore (theoritically). I called USCIS up again later to request a duplicate I-485 receipt notice and they told me that I should not be needing it anymore as my I-765 (eFiled) has been accepted. So we'll wait and see.
I am now planning to request expedited processing of my application. For an expedited processing to be approved, it needs to satisfy atleast one of the following criteria according to USCIS...
1) Severe financial loss to company or individual
2) Extreme emergent situation
3) Humanitarian situation
4) Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States
5) Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)
6) USCIS error
7) Compelling interest of USCIS
I feel I am fall under the point 1) and point 6). The IO that I talked to over the phone told me to write to USCIS with appropriate documentation.
At this time, I would like to learn from you guys if anyone of you have applied for expedited processing, what criteria did you apply under and what was your experience with it.
Further, I would appreciate if you guys comment on the reason that I plan to apply under...Do guys think it will work?

Hi,
Sorry about your employment situation.
If you think it is serious enough, I strongly recommend getting an Attorney's advice on how to transfer your H1B smoothly and also to clairfy any questions that you might have.
Paying few hundred dollars for attorney's consultation is worth the peace of mind that you get, once your questions are answered.
Murthy.com, shusterman.com etc are some of the good ones that I know of.
Good luck and donot worry too much (as these kind of things never stops occuring in life).

Glad to see there is some hope in future for EB3 I.
But we shouldn't rest on these hopes. If we can get at-least couple of items on IV agenda (recapture , STEM) passed we should all be greened for sure.

Guys,
The reality is that we are just being played upon by the companies and the US govt regarding green cards. Employers know that we are not going to budge from our jobs to maintain the coveted priority date and the government is in no big hurry to reform the system as they can collect taxes from us without being accountable to us.
I think Democrats are also going to drag the immigration issue as seen by the article below :

I do not mean to doubt IV, but the writing is on the wall that our lobbying efforts are not going to go too far.
For all of you single people out there, the only fastest option is to marry a US girl/guy. For all those who are married, the choices are simple, forget the American dream and adopt a Canadian or Australian dream or endure the uncertainty of a green card application.
I have reached the conclusion that I cannot bear this uncertainty any more and therefore, I am pursuing other options. Ciao...Good luck to all those waiting for a GC!

Hello guys,
My frustration is increasing and patience going down. I am strongly considering moving back to India. When planning the move, a few questions popped in my head the answer to which I am not able to find (yet); hence putting it out here.
1. How can I inform SSN department or credit bureau that I am not longer in USA..hence no one can use my SSN even if it gets stolen? Is there a way to "lock" things down?
2. What happens to 401K? Is there a IRS tax law that says because this guy was on H1-B and leaving..don't charge him the 40% penalty?
2.1 After 40% in penalty and 30% in taxes...with the market beaten down...not much remains...wonder if it's even worth touching it. So if I decide to leave the money here in my 401K account, what happens when I want to withdraw it? Rather what is the best way to withdraw it?
3. Any estimates on how much it costs to ship things back to India? I live in 2 bedroom apt..so have the usual stuff.....couch, bed, tv, clothes of many sizes, lots of kitchen utensils. Just an average...I understand things can vary a lot.
4. PIO card has the passport number of my son on it...the passport will expire when he is five year old. So do I get a new passport number? If so what happens to the PIO card? Do I need to get a new one?

One of friends got advice from a tax consultant about the 401K withdrawal question you have. The best approach in this case would be to phase out the withdrawal amounts over a period of successive years. When you are in India, you are not earning US income. So say if you take 10K the first year, it will be considered income earned in US for which you have to pay tax. Since 10K is below the standard deduction amt, you will not have to pay any tax. The penalty will still apply as you are breaking the 401K.

Based on Assement in this article, it almost seems that the chances of STRIVE are dead even before it goes to House Immigration Commettee. I am not trying to be negative or something but the article has such a tone. I can understand that Pelosi did not schedule any timing but what concerns me most is the fact that
"California Democrat Zoe Lofgren, who chairs the Judiciary Subcommittee on Immigration, Citizenship, Refugees, Border Security and International Law, will hold hearings before marking up any bill"
Now we all know how one sided these hearings are and how long they take. In nutshell these hearings give chance to any tom, dick and harry to express his opinion and create melodrama. We already worry about melodrama of people such as Sen Sessions in the Senate. Add this drama, and it can easily eat the short window we have to get the relief. I really hope I am wrong here but I have a bad feeling about this :(:mad:

I don't know if I didn't understand this right but one of my friends came to U.S like 5 yrs back in 2002.
Never left the country fo far.
She came on H4 and at that time her I-94 was till Apr/2005.
She got H1 in 2004 with new I-94 till May/2007.
Got her H1 extension( with new I-94 dates.)
The I-94 she got at the port of entry expired but her employer told her it is not a problem as her H1 has a I-94 with new dates.
I know in your cases(s) you have passport expiry thing. But I guess it's still the same right. I gues your H1 will have new I-94 in it .So what is the descrepency?
