I, personally, do not know anyone who lives in Canada and is complaning about jobs. Every beginning is difficult but for us who come to Canada from the US, I do not think the beginning would be difficult at all. Even with their famous Canadian exp only requirements....
Also, when you guys weigh in job prospects in Canada in comparison to being on H1 in the US, do you consider that your spouses would have a fair chance to at least re-start their careers or start their new careers, or do you think / know that your spouses will actually continue to stay at home?
In that case there is no difference between staying here or going there, right?

I had a copy of approved I-140 (EB2) with PD Mar 06. I had to file for new labor in Apr 09, after i got my labor my lawyer filed for new I-140 with a copy of earlier approved I-140. I remember she was saying that they will also write a cover letter to recapture earlier priority date (I don't have a copy of that). So i believe porting can be done easily when filing new I-140 rather than after I-140 approval (i am not saying you cannot do after new I-140 approval but it takes extra effort, time and energy ).
In the interest of others in a similar situation can you post the exact process that you or your lawyer finally followed to get a successful porting of PD?

Completely agreee with hari_baby22. Couple of days back I posted that immigration voice could get a lot more donations if they publish there earnings/expenses report online and make everything transparent. Lot of people including myself, do not contribute because they dont know how funds are getting used. My post was deleted by administrator and I got following message -->
Here is the message that has just been posted:

We don't think you are for real. We believe you are an agent of a for profit immigration website.

Hi all,
Thanks for the responses and sorry for Confusions..
I am giving the scenario more clearly..
My name Before mariz is"Venkata Naga Sunita" surname: "Prachina" (changed identity).
After mariz surname changed to "Naveena".
When I applied for H4 alongwith my husband's H1B, I had my passport with old surname(Prachina). That passport got stamped for H4. Later I got another passport with surname changed(Naveena). At this point, I have one passport of old surname with H4 stamp and another passport with new surname.
While entering into US this January, on I-94, I wrote "Venkata Naga Sunita" Last name: "Naveena". In March, DMV ppl told me that the name in the I-94 should match with Visa". When, I applied for H1B in May with this new surname and attached this I-94 that has new surname "Naveena".
During H1B processing, I had to visit my home country on emergency purpose and got approval of H1B on Sept 7th, which is valid only from Oct 2nd. I re-entered to US on Sept10th and wrote my last name as "Prachina" on I-94(to match with current H4 Visa with which I am entering US). When I recived my papers this week, I was happy to see that my Change of Status is approved and surprised to see that my name on the I-797 and attached I-94 is printed as "Sunita V" Last Name:"Naveena".
Now, the I-94 number and name that are present on my I-797 are not matching that are attached to my passport. Is this OK or going to create any problems in future(SSN or stamping)..

It's very unfortunate! But I don't think other Indian IT companies (or Indian s/w industry in general) are in trouble! Which country does n't have its own share of such incidents?.....US also has seen it's own Enron & WorldComs!!

See, what I am getting at here is.......
MOST employers dont give a rats tail about how you talk so as long as you can dish out good design and do it FAST!
You most likely wont be speaking to clients, thats what Project managers and salesman are for.
how old do you have to be to work for someone? i mean like.. say ur 14.. and ur better than someone thats older than you and u do a really good job?
can u still go for a job and get paid?
- Matt :mu:
Did he ask about a specific job?
No. There you go assuming he meant in a web company. You also assume that MOST jobs have salesmen and project managers. Not facts. Actually errors.
Probably not a good idea to assume. Although you probably already knew that.

I would go with the prediction in the Jan 2010 Visa Bulletin:
WHAT ARE THE PROJECTIONS FOR CUT-OFF DATE MOVEMENT IN THE EMPLOYMENT PREFERENCES FOR THE REMAINDER OF FY-2010?
Based on current indications of demand, the best case scenarios for cut-off dates which will be reached by the end of FY-2010 are as follows:
Employment Second:
China: July through October 2005................CHINA IS ALREADY AT NOV 2005...SO THIS HAS HAPPENED
India: February through early March 2005.........ONE MONTH BEHIND HERE....NOT BAD WITH THE PREDICTION
If Section 202(a)(5)were to apply:
China and India: October through December 2005 ..................THIS IS THE SPILLOVER CHANCES FOR JULY-SEPT 2010....MOST LIKELY IT WILL CLOSE AT JAN 1, 2006
I tend to agree with you. Projections by DOS seems to be closer to reality.
I would stay conservative contrary to many other predictions.
1) China moving to Nov 2005 is a good thing for India. This means India will get all the remaining fall-down/fall-across numbers until priority date reaches Nov 2005. After that both India and China will share and move the dates by a month or so. This should get India to Dec 2005 to Jan 2006.
2) Many see the dates have not moved much for so many months. So they can be skeptical about the date movements in the last few months. The reason why i anticipate much larger movements in the final months is due to the fact that India gets about 3 times more visas through fall-across/fall-down than what is alloted for just India.
2009 info
Country cap for Eb-2 - aprox. 2800
2009 India for Eb-2 was 10,116.
fall-down/fall-across numbers 10,116 - 2800 = aprox. 7316
So we can see that visa movement for India (Eb-2) is greatly influenced by the number of fall-down/fall-across which seem to happen mostly in the last quarter.

Got the status update email from USCIS stating a card has been issued for my 485 application.
I am not married yet. What are the implications if I get married to a citizen of india residing in India.
Kindly refer me to appropriate material if you know of any.
Thanks,
Akshay
Then, your spouse should comes in family catagory. You should sponser I-130for a spose of LPR. But FB catagory backlogged very bad now the PD is 2003. It takes many years.
Other option is wait for 5 more years. You will become US citizen after 5 years. Then apply 130 for your spouse (spose of citizen). As there is no numatical limt, your spouse can come immediatly.
Other option is she/he can come in H1,L1 and any othe non-immigrant catagories. However, they wont give certain non-immigrant visa like student, for your spouse if they kow she/he is a spose of LPR. Consult a lawyer.
Other easy optin is marry a person in US.

Hello Friends:
Recently Vermont center processing time for H-1B extensions moved to Oct-1-2007. As per new USCIS reporting method of processing times, what this means is, they have COMPLETED processing applications received as of Oct-1-2007. This means, people who have applied for extension after Oct-1st should be getting their approvals these days.
I want to find out which dates currently they are at based on your feedback of your application date and whether you received approval or not as of today.
My case: Applied Oct-30-2007 Status: Pending
Thanks.

Is there a relation between immigration process (485) and IRS?
If a person owe money to IRS , does he/she have a problem with his/her immigration process? I'm not talking fraud ....! I'm talking owing taxes to IRS
The reason i'm asking is because some lawyer do ask for W2 forms, some do not. That means there is a relationship between immigration and IRS.I just have no idea how it works.
Thanks

Infighting is sad.
Just a food for thought - say items non related to immigration are removed by the admin from the IV website. The person who's thread is deleted, will get ticked off. What are the chances that they will act against IV? maybe this fear of losing some support is keeping the admin from removing all non-related posts? Or it could also be the amount of time and effort necessary to regularly 'clean up'.

How much does a typical lawyer charges for responding to the Employment verification RFE?
I got an RFE on my I-485 (NOID). Its because the employer who sponsored my GC revoked my I-140 after I joined another company. I approached a lawyer, they charged $1000 to reply the RFE. Thought its a bit expensive but I had no other go than to go with him because I had to get it done at ASAP.

I had my GC approved out of line last year in aug [was current (pd march 2006), but processing time wasn't current for texas at that time]. EADs for both me and my spouse had been approved like 1 week before this happened. Hers was for 2 yrs and mine for 1 yr. What happens to her application if I loose my job or leave my job ? I am the primary.

Hello Gurus,
My I-140 was recently approved. 140-485 filed concurently in July 2007. I have a new job offer and plan to use AC21. However I am worried because the wages at new job would be significantly higher than the old job. There are two reasons for the big difference
1-Desi employer v/s corporate employer
2-Dallas v/s New York
Any comments from people who have faced similar situation will be highly appreciated.
Thanks
usually wage difference is not something on which your GC can be denied, but very large descripancy can raise questions.
