I am also in similar situation although no RFE yet. I have submitted a non-availability of birth certificate letter and affadivit of parents. I have the following questions
(1) Do we get the letter from the muncipal office from the place of birth or we can get from the muncipal office that we are presently residing. (birth was in UP , residing in TN) I believe the non-availibility certificate has to be from the jurisdiction of the birth and not current residence
(2)What is the letter for , is it for birth certificate or for non availability of birth certificate. If you were born before a certain year (not sure about the exact year) there is a great chance that your birth was not registered. That is why you have to ask the local authority to search the records and give you a letter saying that such and such person's birth was not registered and no records exist

well..I have been waiting for my labor certifcation to get certfied for too long. just after Sep 11 I applied both for US GC and Canadian PR. My wife also applied for her GC. meanwhile her GC moved to regional when suddenly DOL thought it was time to regroup and there it went into BPC. In the meantime we got canadian PR some 2 years ago but we did not move thinking that we have jobs here.Then she got pregnant and lot of complications ( premature labor) and during those complications her company got acquired by another bigger firm who thought they don't need her..and result was job loss plus GC into the trash....meanwhile my labor certification even after 5 years was still sleeping in EB3 category(PD Oct, 2001) when i still have Masters( god knows why my lawyer put into that category)..Now my canadian PR was set to expire in march, 2007..so I thought i should decide fast..and i applied for jobs..and I got offer in vancouver with moving expenses paid from califronia..It has been the toughest decision because my employer is Indian here in california..and I have had good growth(10% average) but not the way I had wanted..I guess he also exploits..Indian exploiting another Indian..because they know I am not going anywhere..plus we work hard.. I asked him to match what was being offered in vancouver..and he started converting CAD into USD..well..it is not fair..So I have decided to heck with US and the Employer..and move on...at least I can come back..it is not an easy move because my son being premature child had lot of free facilities in california..hopefully he will get the same in Vancouver until he gets to 3 years ..and then it stops..
I have been in this country too long..and I guess one should settle down rather just wait for them to give GC...reading the other post about one lady whose EAD card got expired just tells me that how inconsistent this GC process can be and right until the end...

i have gotten everything from multiple !@#'s to great but that is not the point. Your profile is empty, there is very little information about you and the first thing you post is something about how H1's getting scammed. To me it would look like a post from an anti immigrant basher trying to muddy the waters. How does this post help any one?..you could have just added it in the news section. Was this article so important that you had to create a dummy profile and post something. You were in such a hurry that you could not be bothered with entering some information about you...isnt it strange...maybe you are normal guy who just read something during your lunch break and wanted to share it with everybody...who knows... A first post could be something like...'i just joined, i have a PD of xxx and i would like to help' would'nt you agree that this is much better than posting something that doesnt help the immigrant community.

I was trying to check what is the priority date attached to I485 application. Seems there is no such info. attached to pending I-485 application.
Also, just now I checked my 485 receipt. The PD column in my I-484 receipt is blank. Is this common for every one? Just curious?

well - for the antis - the ONLY post they liked seems to be "pack your bags and go home". Lets not try to force ourselves to satisfy them.
Now, when it comes to out of status issues - lot of people do genuinely fall out of status. There is nothing called exploiting the loophole unless someone breaks the laws.
It is obvious that one must not be on bench, or after layoff without a job. There is no room for loopholes.
We have always seen that USCIS does treat every petition for renewal on a case to case basis. Grace period (considerable) has been considered for genuine cases.
Infighting is common - it happens everywhere. People seldom change.
See - IV is not something like a freedom movement or asking for rights for poor or downtrodden - IV is basically a group of immigrants who are skilled and well educated who want to lobby for a change in system and sort issues. Everyone here has their own selfish motive and that's why this infighting among eb2 vs eb3 , MS vs BS, India vs ROW et al......
So lets not worry too much because antis paint all of us together because of actions of some people. If people realize and change - well it is good for all - otherwise - "we cannot make the horse drink water .." you know what I mean
I agree with you. Any advise given here is not legal and yet it will definitely attract the attention of the AI groups/individuals. However the fact is the custodians of the Law themselves do adjudicate approvals on a case by case basis and give due consideration to small lapses in status.
As a community we are here to support fellow would-be immigrants in whatever way possible within the 'legal' framework of the laws applicable. Sometimes a simple -'get your back wages done or go on unpaid vacation' is construed as a wrong advise. It is quite possible that many of people are genuinely mis-informed about their rights or do not recognize they might be out of status.
A lot of people do not make it a point to read the basics on their status and their rights either and apart from being a forum to rally support for the 'cause of legal immigration' this should be a community to educate people of their rights and provide the kind of support we currently do.

ask lawyer to file MTR and resend response to RFE along with it. You should get a quick response (within 4-6 weeks). If MTR is denied, ask to file appeal, but sometimes it's better to change employer and start from scratch. Appeal can be a long process.

IV has been doing a great job, we should all be proud of being a part of it.

I think we should keep fighting till our goal is met. Can IV core team shed some light whether recapturing the unused visa numbers is ever possible ? Even if there is slightest change, we should NOT GIVE UP and work towards it. I've read that USCIS have so far wasted upto 600,000 EB visa numbers.
Now we are seeing some light at the end of the tunnel for multi year EAD or EAD validity during the period of AOS(I-485). Should we roll up our sleeves and work for the recapture of unused visa numbers ? How to make this happen, Please share your thoughts and ideas.

I did spoke with Sheila Murthy Lawyers on chances of maintaining GC processing and Consular processing.
My firm is OK with my long Leave of Absence...Only thing that threw spanner in the wheel was comment from Sheila Murthy firm's advise.
Per them, to renew AP and EAD, I need to be phsically back in states and also stay in States for the duration of approval i.e. if it takes 3 months for renewal of AP and EAD, then I need to be in States for that duration.
I asked them what if I can apply 5months in advance, from Outside US and someone can fedex it to me. Max I can come back for few days.
.. Per them this will not work...
What do you guyz say ?

I don�t think you need to be here from the day you apply AP to the day it get approved. If what I think is correct then I have one idea for you.
1) Now you can go out of USA on first AP, which is already approved
2) Come back for few days to apply 2nd AP again (6 moths before Current AP will expire)
3) Once you apply 2nd AP, you can go France again with first AP and then come back to US before first AP will expire.
4) After few days again you can go France with 2nd AP.
Since your PD is old, most probably you will get GC approval before 1st AP will expire.
This is just an idea but not sure how feasible it is.

I'm only 15 and i run a web hosting company with 2 adults, its a very good business and i do the web design side.
TAX is the main thing is the thing to think about, i think its 16 when you start to get taxed, im not sure, might be 18 or 20. But once you go into there, you need to pay the tax man on all your profits :(
I do design mostly for $200, $150. And had a lot of clients in the past :)
Get into web design, its the best on the internet to do :)

My checks got encashed this friday. Applications were delivered to NSC on July 2nd, later forwarded to TSC. My I140 was approved in TSC.
Man that was good news!!! I am very frustrated for the last few days as no one got with Texas I140's who filed AOS with NSC haven't gotten a receipt. I now see that we will all get the receipts soon!!!!!!!!!!!!! GOOD LUCK TO EVERYONE WAITING!!!!!!!!!!!

I think over this issue several times (my kids are of this age).
A person (Indian) with green card marrying to an Indian Citizen (whether in Indian or on H1 Visa or on F1 Visa) offers no help but adds misiries to spouse and family.
Somtimes I think, it to be a pressure technique - hey now you have GC and you are unmarried - so marry American (or GC holder) and contribute to growth and well being of those who are already in US.
My 2 cents on this situation.
