NIW is tricky. As you have PhD, you can apply yourself (w/o sponser) in EB1 Researcher catagory, if you do that kind of job.
The only self-sponsoring category are: EB2-NIW and EB1-EA (Extra Ordinary). EB1-EA is harder but EB2-NIW is not easy either. NIW will have to argue why labor certification should be waived. Talk to a lawyer. You will have to show YOUR work not just the field you work in has merit and in national interest. And you bring unique abilities to the US. Your past achievements and not future potential counts more.

Changing company after getting Green Card
I would like to discuss this important topic about changing company after getting Green Card (GC).
I do understand this topic was discussed in the past and lot of our members may have enough information about the topic. The reason why we need this new thread is to consolidate various immigration lawyers’ opinion in this matter, so that our members could take informed decision.
Question is how long one should work for the same company, through which they are getting the Green Card?
My Opinion:
Do not change job at least for 1 year. The law does not specify the duration for which you should work for the company through which you got the GC.
The official rule is that you must not have any preconceived intention to leave the job when you get your Green Card.

Im july 5th filer .NSC_CSC_NSC.got my EAD on 20th december07.AP still pendind at CSC (RFE).opened SR for FP in october and got FP notice next day .Obvously SR had nothing to do .SR was replied after 45 days and says "status of I-485 USCIS is waitinf biometrics information to produce permanent residency card .I had filed 140 and 485 conc.and my PD is current .I had seen lot of NSC_CSC_NSC got their FP notices in mid november .

isn't ability to pay normally satisfied directly via paystubs and W2 when you have worked for the company. esp if company has already paid you for the period of say 1 yr then ability to pay is proven no?

I think its more than 3 since I got a notice about my 2003 state taxes in 2007 which they said they never received and I got stuck with a penalty ( although I was getting a refund ). I paid the penalty since it would have been too much of a hassle to go through 2003 records and then duelling it out with the IRS.

Murthy's lawyer suggested Consular processing as an option.
She explained that in Consular processing I still need continued Sponsorship from my firm, but it will revoke my 485 application. I will end up filling bunch of forms with USCI, including 824.
This was my PD will remain intact and when it becomes current, I will have to go to Indian Consulate and get Immigrant Visa from there.
IN this whole process My firm needs to continue sponsor my GC processing. Advantage is : I don't have to come and renew my EAD and AP every year.

So you mean I should not even think of invoking AC21 EVEN after 180 days ?
go ahead and invoke AC-21, you are not necessarily going to run into the problems that poster faced (in fact based on anecdotes on Forums the AC-21 related denials by USCIS have gone down a lot since 2005, probably because of the yates memo that came out then calrifying all this). Try to stay on H1 as long as possible though (you dont HAVE to use EAD to invoke AC-21 and change jobs).
At the end of the day a lot depends on your luck. Some people get unlucky and end up with all this nonsense, some people end up getting caught in namecheck... they are both thankfully a small percentage of the cases, so dont let your career choices be decided by what USCIS might do. Take precautions where possible (staying on H1 etc) but do what you think is right for your career and family. The whole point of this AC-21 clause was to provide flexibility to the employee, make use of it.

You will get a letter in mail and then you should get all the documents listed there.............Also some of the items listed will make no sense to you as yours in Employment based GC and the letter is a standard letter which USCIS uses for family based gc also.....
It will also have one point that bring documents if you were arrested,convicted etc........dont get scared if you never got in trouble....
Prepare for the interview....read your job description which was used for LC and you should know if word by word as that was 1 question officer had asked me and I could answer it very well but was surprised that I was asked a question related to what technology I work and what are my job duties......
Good Luck. Everything will be fine and it will take 30-40 min max. :)

Got the approval notice today :) "Welcome to the United States of America" - ironically i have been in this country for a decade now! finally the "welcome" :)
It has been a very long journey!!! and a very frustrating one for the last few years... but the feeling that I now get is really liberating... first thing I did was thanked God for ending the seemingly endless wait that me and my wife (she didn't care as much) were in.
I'm already thinking of the things I want to do after this new found liberation... it includes showing the middle finger to those who have taken undue advantage of my status :cool: :D and i'm not taking it anymore... I'll be a new person starting Monday!
Just so there is no confusion... my PD was Feb 2003 EB3 but my wife's PD was EB2 April 2004... we got our freedom through her application. If anyone needs more info on how/what/when - i can share that (it had its up's and downs - mainly downs, but all's well that ends well)!
Lastly as a token of my real support to the cause of IV I will be donating a small amount. I have donated in the past... I have participated in conversations in the past... I was not so active on other fronts but I truly believe in this organizations effort to help the community. And God willing each one of you will get this freedom soon! God Bless!

OK I double checked the new license. Even though the Expiry is 2014, it does have in red "Temporary Visitor Status Expires: 09/09"
