    Hi,

Does anybody know of and have used any good lawyer for AC21 related matters from bay area in CA?

I reside in bay area and would like to consult a local lawyer regarding the "same or similar" nature of the new job that I wish to take using AC21.

The reason for requiring him to be local is to use his services, again if needed, during adjudication.

I appreciate any help in this matter.

I was also planning to phone consult Murthy.com lawyers and would like to know of any experiences.

    Thanks

You yourself willingly knowingly signed G28 form and gave all the power to your attorney. USCIS is not suppose to be sending you anything. And IV has nothing to do with it.

You have to realize, that your attorney/employer have to be willing to support your GC honestly, since you might need them in case of RFEs, etc. If they are playing games, then invoke AC21 and leave them.

You can sign G28 with another attorney, and your new attorney will request your case from your previous attorney. Your previous attorney will have to be REQUIRED to send ALL your papers (including that RN).

You can apply for EAD with just having receipt number, you can find out it by just calling USCIS. So I don't see any reason to freak out.

    I still want to!

you might also need a copy of your approved Labour application.
I am not sure if you can get the documents directly from the UCIS becuase the documents belong to your employer and not you.
you can try through Freedom of Information Act(foia.com). but it might take a while to get the documents.

All that is required is only I-140 Approval Notice. Labor Cert is not required.

    troll Alert.

posting controversial or provocative messages in a deliberate attempt to provoke flames.

Is it too much to ask Google to put a Diwali logo like it does for Hanukkah or Christmas .. at least if not in google.com but in google.co.in?

Also is it too much to expect American mainstream media to totally NOT ignore Diwali which has significance for the second largest population in the world and instead publish significantly less significant story of the balloon boy?

Is it too much to ask for to include Diwali in the spell check for this editor? (Not wailing or Gwalior ...)

It is this mentality of deliberately ignoring the feeling of majority of the world population that is getting the western civilization more and more isolated and retracted.

Well it doesn't really matter. And I am visiting India now and I can see that this country and China will definitely kick ass of Western civilization .. as it is already doing. The people here are hungry for more and in spite of seemingly unsurmountable problems it will succeed and once again India will be the "Sone Ke Chiriya".

With this thoughts and wishing peace .. happy and prosperous diwali to everyone.

May Lord Rama bless the world.

I think that instead of exhausting our energy on this issue, we better think how to make progress in our fight against injustice. And to all those who are using an abusing language .... please show your guts when you go for your next visa stamping or when entering the United States on a port of entry and try to use the similar language.... you surely will get an answer/lesson you will remember for rest of your life.

    Yes Agreed.

that is a good guess - I hope it is correct.

However, whether the fees are being used for overtime or for more people working on a case, that means USCIS is understaffed and needs to hire more people. In that case, isn't it logical that they would increase fees across the board for all applications, not just PP? i.e. fee hikes would be for new applications to pay for the extra resources, and existing applications should be processed under a flat fee for all cases.
If they are claiming that those who pay extra fees are entitled to faster processing, ahead of the line, then that, my friend, is a bribe, whatever official term is used. Because otherwise if they were understaffed, which it appears they are, they would simply raise fees for all applications.

I can understand a corporation doing this, like getting your tax refunds processed faster through a company if you pay more, but imagine if IRS suggested they would process faster for an extra fee.

They cannot raise fees without providing extra service. USCIS does raise fees once in while though. But the PP fees bring in a very large amount of revenue in comparison to small increases in regular fees.

Also, for better service, people often pay more. I invariably pay more in an airplane to be in the first class. Not sure why USCIS cannot use that logic to make some more money. I don't think it is comparable to a bribe. But, I guess we will agree to disagree here.

    Dear <newschannel /congress/senator/legislator name here>,

While the coverage that we "potential" legal immigrants received during the CIR debate was abysmal because we were not considered "human interest" pieces by journalists and editors. We have been subjected to another slap in the face by a broken immigration system.

    Please see:

    http://www.aila.org/content/default.aspx?docid=22804

"Administration Slams Door on Thousands of Legal Immigrants: AILA Condemns Agencies' Bait and Switch
Cite as "AILA InfoNet Doc. No. 07070264""

This news has so far only got brief coverage in a few websites. Among them include:-
    http://news.yahoo.com/s/ap/20070703/ap_on_go_ca_st_pe/immigration_green_cards
    http://seattlepi.nwsource.com/national/1152AP_Immigration_Green_Cards.html
    http://news.google.com/news?hl=en&ned=us&ie=UTF-8&ncl=1117797588

We hope that this press release is sufficient to now categorize us as a human interest piece. It is ironic that those crossing the borders illegally get front page coverage, while the tens of thousands of us going through the legal channels get ignored. Many of us have spent hundreds of dollars and wasted time, effort and money, only to be rudely slapped in the face by this visa bulletin revision. Any coverage will be appreciated.

    Thanks,
    <your name here>

    =====

Please send this to any newschannel, legislator, or congressman in your area. The more people know about this, the better. (Also, ensure that the yahoo and nwsource press website links are complete as IV cuts the full path from my post.)

I suggest you to think of investment options like stocks( only suggestion not an advice) I agree with other members as I presonally think paying the house loan is not a good option as we have to pay more tax to uncle sam. Enjoy the cash benefit that you get for your TAx and keep some money in Bonds and stocks and a little liquid cash( 10K to 20K).

Yes, even though July VB brought good things and everybody is busy in getting documents together, we should also take some time and look in to this.

The July VB has distracted us. Should re-mobilize quickly. Shouldn't rest till favourable amendments are in.........

    Team,

I am in eb3 with priority date jan/2007 and working with EAD and 485 pending.

my sponsered employer willing to promote me with my position and i was having thought of filing a new case in eb2 and port my eb3 priority date. my company has different sister company working in different areas, can I file my eb2 application from other sister company not from the company where my eb3 is filed?

Also I have 3 years degree and 1 year pgdca plus 10 plus years of experience. I wanted to know if you know anybody who filed eb2 with 3 years degree and 1 year pgdca? according to my research i may have trouble at 140 stage?

if my eb2 gets denied, what happens to my eb3 case?

    Please advice.

    Thanks,
    Matt.

It is good idea. I discussed this my lawyer and according to him, nowadays USCIS is very strict about it and trying to match the requirements of EB2 against the candidate's credentials. If it perfectly matches only they will approve. It will be an option for those guys with EB3 with PD past 2005 and with enough EB2 credentials, primarily a masters degree and if it from US, then great.

Please do not go into this option just by stating that I have 100 years experience with such and such company. I will say, if your are a masters degree holder (from US the best) and is employed with a major employer for more than 3-5 years, then only attempt this. Do not try it if you are employed with some Desi company. This is harm both the candidate and the employer.

    My two cents worth!!!

there remains a sliver of hope- its called the lame duck session when a lot of such measures are passed. post election, everyone feels "safer".
a marked up bill, ready for the house, could sneak through in the post election season. we have to keep trying!

    Thanks Paskal!

This is exactly the kind of communication we need from the core.

I got RFE through attorney. It is asking following details

    1. Emloyment verification letter with present and intended permanent employer

    2. Last two months pay slips

    3. "Although your I 140 petitioner indicated in your initial I485 filing that you were employed by company A at that time, your Form G325 indicated that you were employed by company B and you were authorized by B at that time, please explain discrepancy"

I am bit worried about question 3. I worked for company A and labor, I140 applied when I was with A.

But during I485 filing I was with company B and in G325 I mentioned that.

It looks like company A by mistake mentioned that I was still with them.

I called my attorney he said its upto me decide which company I should work for.

But I am not sure company A provides an employment letter for me because I am working for comapny B now.

If B provides employment letter since it is >180 days since I 485 applied, will there be any issues?

    Please give your opinions...

Good points: Here is what I think:

    - future VBs
    - visa availability in the coming months
FOR THIS I HAVE DISCUSSED DETAILED PREDICTION IN FOLLOWING THREAD:

    http://immigrationvoice.org/forum/showthread.php?t=20863

    - awareness about visa wastage
DEFINITELY A MAJOR ACHIEVEMENT. ALL THE HAPPENINGS OF THIS YEAR (USCIS AND DOL DEPOSITIONS FOR IMMIGRATION BILLS ETC..) THERE IS CLEARLY MUCH MORE AWARENESS ABOUT VISA WASTAGE AND IT APPEARS THAT THEY ARE TRYING REAL HARD TO AVOID IT...:)

    - dates becoming current for most EB categories
    - light at the end of tunnel for most of us
I GUESS BOTH THESE THINGS ARE THE SAME. I THINK EB2 AND EB3 ROW WILL BE CURRENT BY THE END OF THE FISCAL YEAR AND EB3 INDIA AND CHINA WILL MOVE FORWARD SIGNIFICANTLY TO USE UP THE OVERFLOW (AS THERE ARE NO 485S FILED AFTER JULY 2007). HOPEFULLY MOST EB2 WILL GET THEIR GCS IN NEXT TWO YEARS. ADDITIONAL ONE YEAR FOR EB3 INDIA AND CHINA (ONLY A GUESS)

    - USCIS efficiencies
NO COMMENT ON THIS: THEY PROVED IT AGAIN....THEY CAN NEVER BE EFFICIENT...EITHER THEY DONT HAVE RESOURCES OR THEY DONT HAVE MECHANISM TO USE THEM (LIKELY LATER SCENARIO)..AND NOTHING WILL HAPPEN WITHOUT MAJOR RESTRUCTURING OF THE SYSTEM. EVEN AFTER EVERYTHING BECOMES CURRENT, THERE WILL BE PEOPLE WITH PD IN 2001 AND 2002 STILL WAITING.

Thank you gemini123 for the quick reply. I'm in Texas and have to get it renewed in Houston. I was talking to a broker who would get it done in about 10 days as I'm planning to travel to India next month.
He asked me to send the original pasport along with the I-94. That didn't seem right to me.
Should we also send a I-485 receipt copy?
Also, I have a expired visa in my passport but my H-1B is valid till May 2008. I'm planning to travel to India through Amsterdam and use my approved AP for reentering US. Would I need a tranist visa if I'm just chaging planes at the airport? Thanks!

Let bygones be bygones. No point in beating the dead horse. Nothing will be achieved by opening old wounds.

Let us be united from now on for all our sakes ( both Eb2 and Eb3)

Ok, let us be united. Let us work on getting USCIS to follow the letter of the law. What is it you ask? It is that the Visas be spilled over as required by the law. It is nothing to do against EB3 or EB2. The visa spillover suggests that the overflowing visas be issued to the most critically retrogressed queue (upon satisfaction of per country limits). Does it help Eb3 or EB2? Both, whenever there is a longer queue, that line is able to move forward.

Right now it is EB3 which is reeling under the incorrect implementation, and EB3s want to see it rectified, while the EB2ers demand Unity (knowing well that they stand to lose -- what was never theirs), I would not be surprised that EB2 raise the loudest voice of action (and no talks about unity) had the tables been turned.

So you see why I think the message of unity sounds so hollow.
