Good to see the count already three (here) in just 30 min of posting this idea (IV's one of the peaceful ways). So I am sure there will be huge response. Please spread this message as much as you can, and see if we can gather a good #.
ALSO we will have to wait for IV Admin to approve this, as I am just a junior member and dont have that capacity. WE MUSt start one more campaign.

My wife and daughter planning to go to India next month. They do not have H4 stamping but H4 validity is there up to next year. Plan is to come back after receiving AP. I am thinking that once their AP is approved I will send their AP to India, and they will come back using that AP. Experts, do you see any problem in this. Please share your thoughts.

How many copies of RFE do they send? i mean do they only send one RFE notice to Attorney or do they send one RFE notice to Attorney and a copy to employer?? Can somebody tell me..
Only one copy is sent to the attorney.....If you applied under premium processing, USCIS faxes a copy to the attorney before mailing the RFE hardcopy....

I am not sure about AP weather it gets canceled or what but I think you did a wise thing cos even if your 485 gets rejected you loose ur EAD and AP but based on your approved I-140 you can keep on getting H1 extension for 3 years. So H1 is much safer than EAD.

I do not think one would not go to India just because he/she is scared to get a stamp in India. The loss of someone dear to you can overcome any such fears one might have (for me atleast thats applicable).
In any case, I did not know (neither did my collegaue) of the emergency quota. Thanks for sharing that with us and thanks to forums like these, every day is a learning experience.
Ragz4u, Well, I should not have typed the last sentence in my previous post, I take it back.. I agree with you the loss of someone dear to you can overcome any such fears one might have... But I do know my colleague did get his appointment through emergency quota and got his stamping and returned back, after attending his father-in-law's death/ funeral. He was not able to schedule the appointment through the online system, but he had to call the consulate directly to get his appointment. He got his appointment in the same week he had called them.

Why don't we just voluntarily mention the amount that we contributed in our signatures ? Since contributions are voluntary, so should be the option of disclosing information on it. When many contributing members start furnishing their contribtion information voluntarily, it becomes the "fashion" and others will follow suit, as no one wants to look like a free-rider.
As for the veracity of the information, we got to trust each other on that and follow an audit policy- I assume the core members/ administrators have the ability to cross-check the contribution information if someone looks suspicious. Anyone caught furnishing false information can be blacklisted. Such a policy minimises the work of the core team, without being overly intrusive.

My wife worked as a consultant for first half of 2008 with a desi employer as an employee (on W-2). After many calls and emails we received W-2 Thursday that has income and taxes of only first two months. Now he says that he showed remaining 4 months as his profit so he can only send 1099. Please advise if I can take any legal action against this employer.

I didn't send a certified mail but I have a reply to my email saying that they didn't received the statements from the Insurance Company and we can still report those missing wages without a W2 from the company.
Can we use this as a proof of contacting employer requesting for a corrected W2?

Yes, make sure you give your employer the benefit of doubt by sending the documents via certified mail and acknowledgment received/delivery confirmation.Make sure you mention that you need it amended to file for taxes and will be forced to report otherwise. Follow that up with an email via delivery confirmation option to make sure its been received. If nothing happens from your employer in consultation with your tax consultant file a complaint.

I have been there. done that. As soon as ported labor applicant using AC21 moves on & finally gets his GC, his labor cannot be ported anymore; even though you filed to use his labor before he obtained his/her GC.
Mind you, I used labor substitute not from a shady consulting company but from a reputed nasdaq listed company & had top lawyers appealing and proving my case. No use.
I think AC21 & labor substitution fundamentally had these issues where they could not co-exist. Since labor substitution was prone to abuse anyway. It was done away with. Good riddance to bad rubbish I say. Just I had to spend 3 years in limbo. What can I say - only solace is that there are others who are worse of than me.
Move on. Theres no point appealing this denial of I140.
