by law i think your company should pay for all G.C. related expenses..

I agree with the majority of the posts here that talk about bickering and infighting that we have as opposed to remaining focused on our common goal. Just because someone had a bright spark that people with Masters should get Green Cards, is the USCIS going to honor that and change the rules to benefit us? I think we need to remain patient and focused on the job at hand. i.e - supporting the IV front liners and having a single voice which boldly and clearly talks of expediting the green card process. If we are not going to to act in unison, we are the biggest losers!
FYI - I have been in the country long enough and have gone through the pain of bungling lawyers and unresponsive management..so its not that I choose to be +ve since I haven't had any bad experience with this process!!

I had sent an email to rags months before about this friend. He decided to become an expat and move to India while his GC still languishes in the labor stage. He is an engineering manager who works for one of the big oil service companies (Think of word association with the Vice President). He would have been invaluable to this country as the country tries to become more self-reliant in the energy sector. Instead, he now lives in India and services oil wells in Russia. How is that for loss of competitiveness (loss of his service as well as his tax money to other countries)!

Let us say I accumulate 40 points and return to India for good. Do I still get Social Security in India if -
1. I am a US Citizen living in India?
2. If I am a GC holder living in India?
3. I am neither a US citizen nor a GC holder living in India?

With citizens of India, it is full penson benefits, what ever it is (earned based on contributions). You don't get medicare type of thing.
For citizens of countries like Canada, it is limited by windfall limits. People who worked in both US and Canada become elligible for too much retirement benefits and it is curtailed by limits.
So in nutshell, any treaty may worsen benefits of 10 or 10+ Social Security Contributers.

I have not been laid off and I don't have problems finding jobs; in fact my company has asked me to search for one more person with a background similar to mine. However I have been limited by the requirements of AC21. I was toying with the idea of leaving the country; but cannot sell my primary residence and might have problems obtaining a visitor visa for re-entry (to close on the house). I was seriously considering investing in some more real estate; but am holding back due to the random AC21 denials. I want to start my own business since I finally got my EAD this year - but with all the uncertainity of AC21 case approvals, I am not willing to put personal resources into a business in this country. Currently I am working on starting a free workshop for investment in my community - which will stop if my I-485 is denied in case my former employer revokes my I-140 (and yes; I did send in the letters for AC21). I have registered my dog with therapy international and volunteer my time for various causes (cabin repair, trail maintenance, public education) and donate regularly to the fire and police - all of these will take a hit if I have to leave.
I wonder what the reporter will conclude if he/she talks to immigrants who have lost jobs and have trouble finding new projects........

It would be good if more of you PhDs visiting here would post and share your ideas about what we should be doing to further the PACE amendments agenda. Regular posting by you and others will bring up new ideas and more importantly, keep up everyone�s motivation to see this thing through. Once postings and interactions reach a critical mass, things will pick up momentum which will see through the completion of our agenda. It's because you, me, or any temporary legal immigrant will go back home if some law changes, and new batch of H1 B people will come in to fulfill industry requirement, but for illegal, route from South America is a one way street to USA and no going back. Plus, if temporary legal immigrants leave, US Govt. got to keep all our social security, retirement saving etc. if you think from their angle (US govt.), I guess for them, it makes more sense to legalize illegal (so at-least govt. can get some share of money from their taxes) because no matter what govt. do, illegal are never going to go back.
After one has been here for 10 yrs. , does US have any Internation tax treaty with INDIA to give back social secuirty benefits or return the taxes back, if one goes back.
I dont care about GC, Indian govt. must get our social security taxes back. This is a legitimate concern atleast. I guess Indian govt. can take this issue up for sure.

I have similar situation - I applied for 140 in July 2006. My daughter will turn 21 in July 2007. As I have applied for 140 before she turns 21, she is safe for GC, but will loose H4 status when she turns 21. As per my lawyer's advice I have applied for her F1 so that she can stay and continue her studies in US. When I become eligible to apply for 485, she can be included in the application - but, not as a dependent of H1B holder.

I was not bragging. I was just thinking out aloud, so to speak. Economic ups and downs like this this are a normal part of economic cycles in a capitalist economy. My observation is that IT industry is not as badly affected as other sectors. I have not seen people sitting without jobs for extended periods. I mean, some people do loose jobs but they get something else within a couple of weeks. That is pretty much normal functioning of markets.
This is not your normal recession... Whats happening right now is once in a lifetime event... This is the kind of stuff you will be telling your grandkids about! This is payback time of the excesses of the past 25 years of loose monetary and fiscal policy under Greenspan... Your observation about IT industry not being as badly affected is true only till the month of October... Till then things were in sort of slow motion esp in IT sector... Not anymore!

Americans to a large extent have not known what real poverty is... The social implications of this fall out are going to be awfull... Don't take things for granted... If you thought that cushy job of writing apps for Facebook is safe, boy you are wrong... The depressionary train has already left the station and all we can do now is sit tight and watch!

I think this rule would be pretty controversial with the diversity restrictions that US expects.
So, why there is country limit just on GC quota, if they want diversity it should be on H1/L1 visas as well...this is why we are seeing backlog of more then 5yrs in GC. It is not diversity they want it is called discrimination :eek:

Really great job on the singing Pankaj!!! It was really impressive!
Even though it was not really the anthem for anyone there, it was a nice gesture to sing the national anthem of the people we are asking to help us. Plus, it is the only anthem that we all have in common...
Also, you have chosen to move to this country, please have the courtesy to adapt to American values. Singing the national anthem is always right.
