As per Macaca's logic, pre Oct 2005 PDs will take up all the numbers available for EB2 Indai for 2007, in June and July.
If that is the case why was the Bulletin for july not set to Oct or Nov 2005 and instead made current. Surely USCIS does not want to deal with all the extra workload if it does not have to.
DOS/USCIS know the truth, but going by the Ombudsman's report, they want to use up visa numbers as fast as they can. So if they have 30K applications sitting, just waiting for visa numbers, now with everything set to C, they can blindly start approving without even seeing what the date on those apps is.
Also, with EB3-ROW being 'C' they dont even need to worry about per-country limits. Just pick up the next almost-approved file, assign visa number, mail out. repeat.

Too many guesses!!! I am a silent watcher here for last 1 or 2 yrs and all your calculations & guesses were proved wrong in the past. Some guys are too positive that they always guess & give some calcuations which seems like you are going to get your GC in 6 months..some are very negative that they always keep crying and always guess & give some calculation which seems like you will only get your GC in 2025. lol to be frank its really funny to see your guesses & calculations. BTW this is not to offend anyone her. Take it easy guys.:D

Dear Sir / Madam,
I am currently on OPT which is valid till July 2009. Also, my H1-B is approved through a company X starting oct 2008. Currently I got a job with company Y on my OPT. Can I continue to work on my OPT with company Y till July 2009? OR Do I need to transfer my H1B to company Y to be able to continue to work after Oct 2008?

There is difference between a common man and a celebrity. We did make noise about Abdul Kalam and Fernandez when the news came out. I think SRK was right to make an issue out of it.
I have been through secondary once and frisked about 4-5 times as a "singled out" case. Man I hated it, whole flight was watching what was going on. What if I make an issue? It will be dismissed as everyone goes through it.
When I went for secondary exam , I was released with 5 mins of questioning but was made to wait 30 mins. The secondary officer was nice, but the primary inspection officer was really mean. She picked on me coz I was smiling in the queue and talking to other people. and I laughed at the jokes cracked by other immigration officers.
3 out of 4 frisking incidents were insensitive and derogatory.
But voice of celebrity has more credence to it.

Spillover would be by PD so China will not get same number of EB2 numbers as India. India has many more old applications then China.
I assume they move both the countries PD to the same year/month if the spill over happens. Atleast in the past, it would be interesting to see how they move now.
Even in all the scenarios it is less likely to go in to 2007, if not beyond June 2006.

So regardless of what August bulletin says, USCIS can just, on a whim stop accepting 485 petitions in Mid July just because they have received "Too many" and the mail room clerk is tired ? I dont know but it really does not sound like something USCIS can do on a whim without publishing a change in the rule first.

Sorry for the clich� "United we stand divided we fall". Let us be careful and have meaningful dialogue especially when we take up contentious issues that might pit one member against another. IV stands for improving EB based immigration for all irrespective of the country of birth. Please note that there are several outside folks vying to split the group and we do not need to do it internally. I feel that this discussion has come up at misopportune time. Just recall the same kind of discussion that came from folks that had missed the July fiasco last year.
Let us not forget our "primary" goals and harp on minor irritants.

This rumour was in many minds up untill now. Now that we are discussing it openly, we are atleast clear in our minds about this issue.
We atleast are discussing what USCIS could or coundn't do.
Even my attorney has said that they cannot guarantee exact filing date per each case, even though mine was the very first application that went to my attorney's office with all documents ready including medical reports, birth certifictes. Such is the work load in my attorney's office.

It is not good to put fake identity in any forums. The guy (MARPHAD) pointed out have a good civic sense. Here admins are not paid. They have jobs, and not always watching people. This site is for every one. So the members have an obligation to find out the fake, anti immigrants. He may not be anti immigrant, but he have fake identity. They need to pump up more numbers otherwise getting rid of quotas doesn't help much.
