Thanks wahwah. I am quite sure that this memo is good for us. But I am waiting for some laweyers e.g. Oh or Murthy to confirm that. I am keeping my fingers crossed. In the meantime if someone comes across an updated AFM then please let us know.

I am on a non immigrant visa and am fairly close to getting my green card through EB-1 under current system - so am basically screwed if the new law passes. I have sent my share of web faxes and have made my wife/ friends at work do the same. I view green card as a logistical convenience and not a do or die thing. If GC does not work out and my work visa upper limit expires - my company would move me elsewhere (or I can get another job somewhere else)....I dont consider myself beholden to any country except India (my country of birth) and would happily move around till I can afford to settle down comfortably in India
However, if I think rationally without being condescending, here is my take:
Legislators in a democratic country are answerable to the people who vote (that excludes all of us). If the Indian MPs start listening to the thousands of neighboring country (no offence intended - just illustration of a point) immigrants while making up their mind on any legislation - I would be damn pissed off - regardless of whether they pay taxes or not.
When we all came to US on work visas - US Govt did not make any promises about green card nor did they extend an express invitation to most of us (there may be some exceptional scientists/ educators etc here and I beg their apology)......the contract was between us and sponsoring employers..not with the US Govt...US Govt may choose to legislate the way they deem fit without asking us or listening to us- regardless of what 1 million folks have to say
The opposition to the new law from skilled, legal non-immigrants is not united....nor are the demands uniform....a divided front can never be a strong front.
No matter what IV or any other organization does (not to take anything away from the great work being done here)......the senators/ congressmen would listen only to those who have voting rights....I dont think anything is being done here to change public opinion of the common US citizen.....and I am not even sure how to do that....common US citizens think that Indians (and other work visa holders) are here to take away the nice white collar jobs which they took for granted.......
Senators/ congressment do not (and they should not in a real democracy) have any opinion - they are supposed to mirror the opinion of the voting majority...the reason they care about the illegal immigrants is because the ethnic segment from which an overwhelming number of illegals come from - their legal US citizen brethren have put their electoral weight behind this.....since many families are like 50% legal and 50% illegal......
with all due respect to you sir, Can you please explain us what to do? If someone want to pack bags and leave they can always do that and my humble advice to those people is dont waste your time on these forums.

1.I got my medicle done when the dates were current last time so the date on the medicle is old.now i have moved from canada to US.And i have to still fill the AR-11 form. in this case does the old medicle stands cancled or I can still go with that medicle and fill the AR- 11 now.
2.What is 9 digit A# in AR -11, my 1-94 has 11 didgit number and electronic format does not accept more than 10 digits.
3.The online AR-11 form also does not accept the canada address,

At the same time, the hearing revealed a continued resistance from the Hispanic supporting legislators who support the relief for the farm workers foreign workers and comprehensive immigration reform legislation, making the fate of these bills uncertain, according to the ComputerWorld report. There was also a resentment expressed by one of the legislators to the elitist mentality underlying these highly skilled foreign worker employment-based immigration bills. One wonders where these two conflicting communities can find a common ground where they can work out a compromise. Current does not mean beyond your PD. There is no mention of PD's being current anytime soon.
What I mean is the analysis is too optimistic for EB2 China/India, which is hard for me to believe.

when did this happen to you? Is it in the recent past or way back, looking at your post, it seems it was way back. Please confirm as lot of us think this is a recent development as we haven't heard anything about this until this thread.

Guys,
I know ROW country may not like this thread, but look at EB-3 India or China, put yourself in our shoes and than you may realize how unfair this country is. In this unprecedented financial turmoil, I feel there are very remote chances for CIR or any package which increase immigration etc would pass, I am taking this initiative to gather as many people I can and go to washington. Again this is not an IV effort. If you are with me , you can spare some time it could be few days in Washington!! please PM me.
Again we are not creating any organization or anything, we are not going against IV's agenda. This is also a part of IV's agenda, but for now our sole agenda will be to bring a 2 line bill to remove country quota or increase the country cap(whichever can fly).
PS : For EB-3 India, unless country cap is removed or increased, you can presume you GC application dead forever...For EB-2 India It'll be a long journey for people with PDs sooner than 2005...

Well I guess one way to make a point is by having a fax, letter and email campaign to let Businessweek know that they will be boycotted.
The other thing to do is get Businessweek declared into a racist publication and every blog entry should mention it so that any google search should bring mention the same.

Thanks Snathan for bringing up this issue.
I personally suffered due to this visa stamping. I was stuck in Delhi for four months due to administrative processing, almost lost my job, lost apartment, lost lot of money and now I am scared to go back for stamping again. My wife and I had to miss my father in law's funeral due to this fear.
I know few other folks who have been in similar situation and I can contact them to share stories.
I am willing to contribute both time and money for this initiative.

I believe if you get a receipt notice , that means your initial evidence is ok

Receipt Notice means they accepted the case for reveiwing. I guess these rejections came after they reveiwed the case.

I think most of EB3I and EB2I are missing one point.
EB3I didn't loose anything by the change in spillover policy few years back.
It is EB3-world who lost. Obviously EB2I and EB2C was on the gainers side.

CurrentSpillover EB1row->EB1I/C->EB2row->EB2I/C->EB3row->EB3I/C
(or to be more precise, it is currently EB1->EB2->EB3 since spill overs are not considering country based limitations)
Either way EB3I was last in the que. So nothing changed for EB3I or EB3C.

I dont believe Indian govt can help in this...Lets first gather people and we will let you know the next course of action. There are bunch of people in Face book who got struck up in visa delays. I am trying to reach out to them. Its big group...try to get them here. Please contact those people...
