Yeah some forget to be civil...but i believe that these few don't represent all of of IV.
And we are all subject to emotions and can make these mistakes as well where we forget to be civil.

My son aged out by 31 days (DOB: 03/30/1986) after applying CSPA benefit (I-140 processing period) of one month and hence could not file 485 application (in this July) and hence we are going through lot of hardships in different ways ( showing $27k balance for F1 , maintaining F1 status at very high tuition fees, showing high bank balance for OPT etc...).
My son is herein USA for the last 8 years from his 13th year studying from his 9th grade to his undergraduate final year. My I-140 was applied/approved in his 19th year - however, due to retrogression, I-485 could not be applied and hence this issue.
I sincerely feel that - the objective of CSPA was to extend protection to this kind of situations - but could not fulfil the same because of later unexpected retrogression which was not there in employment based categories in 2002 and hence is a kind of technical anomaly. I also feel that if core group puts its heart in to this issue - it could convince the law makers easily since it is more of a humanterian issue and the problem is due to unintended technical anomaly and with practically Nil negative effects even from anti-immigrant view point.
As a group, age-out cases may not be many - but the suffering by these few is huge - after being in USA for 9 years, these children have to be separated from their families, has to repeat the cycle - continue study at vey high tuition fees, go through OPT / H1B (if in IT and wins H1b Lottery) / labor / I-140 / I-485/EAD/GC).
I request core group to study the issue in depth - then I am sure they can convince the law makers easily since it is rectification of technical anomaly.

I look at this bill in a different perspective:
1. This will give the Indian IT companies an opportunity to move up the value chain. Rather than body shop its employees to clients...they can have all the IT work done at its development locations. Also they can fill americans for half of its US workforce.
2. It will put an end to 100% H1b bodyshoppers who just make money without having any office and putting their employees onto client locations. These scrupulous bodyshops even dont pay on bench.

Teddy, IV team totally understand the need for predictions, it is a time consuming effort that some of you put in the thread to answer the needs of many IV members. Absolutely true and we appreciate your commitment and dedication. That being said, prediction alone is not the answer. Prediction along with advocacy gets the work done.
Predict all year round, and help the people needing the information to plan their life around, but when there is an opportunity to add to the efforts of prediction.....such as Advocacy, please make the best of it. It is frustrating to see that many members are simply satisfied at predicting, and are broadly indifferent to advocacy. As pappu mentioned earlier, it was advocacy that was instrumental in getting the data for all the calculations.........

We started the recurring contributions system Monday night and we sent out emails to 8400 individuals in addition to posting on this site.
Out of 8400, we have nearly a whopping 35 people signed up for recurring contributions. This is below the lowest of low expectations.
There is such a thing as Timing.
We all know that contributions reach peak time when Immigration debate is on CSPAN.
But what most people must realize is that when the bills are debated on the committees and floors, its too difficult at that later stage to make difference.
At that stage first of all you need a sponsor for your amendment, then you need the majority/minority leader to allow floor time for debate on that amendment and then you need votes to get the amendment passed.
Getting things done before committee level, in the original text requires action now, NOW IS THE TIME, when you dont hear about immigration in the news, but behind the scenes, things are happening.
So if you are holding on to your contributions until you start seeing debate and action on the hill, chances are that it will be late at the time and then those funds cannot be translated into usable resources.
Things take time and planning ahead of time and working ahead of time is something that highly skilled professionals must value.
If we start hearing rumours of layoff, we start looking for jobs...right? Or do we wait until we are actually laid off and on the streets? Why cant we be working ahead of time when it comes to this organization's efforts??????

Its the call of overall 8400 membership. Perhaps the membership, with its slow response, is sending a message that core group is wasting its time doing all this and we should shut down and go on with our lives. If that is the case, then that is fine too. All these efforts of maintaing the website, travelling to DC, maintaining the relationship with our lobbyist and a half a dozen allies....all this takes time and energy. If we dont have support then I guess the core group is the most idiot group of half a million highly skilled immigrants wasting its time.
One way or the other...I guess we will know in the next month or so.

Not if you loose your job and forced to go back to India because you have reached your limit on H-1B (6 yrs). For Soc-security Benefit you have to be a citizen or a permanent resident..

What we could successfully conveyed particularly to law makers etc...

On my wife's labor certificate, it is said her position requires a minimum of master degree. But the alternate is bachelor degree plus 2 years' experience. The lawyer has filed I-140 under EB2.
We are worried that this position does not qualify EB2 because we read on the internet that EB2 requires master degree or bachelor plus at least 5 years' progressive experience. We called the lawyer and said we heard from a friend such a case had been denied. She was very busy and just said there was no problem to apply for Eb2, and if we doubt it, we can hire our friend as a lawyer. We are so pissed off.
Can someone help me clarify if this position is qualified for EB2? do we need to change it to Eb3?

I just called all the offices mentioned.
Almost all of them seemed to know what I'm talking about and I left voice msgs for couple of the offices and some of them took the msg and mentioned will pass them on...

What's up with this site. I thought they updated the server yesterday and we shouldn't see the kind of downtime as we have been seeing in the past but I still don't see any difference. Did the server upgrade not make any difference. May be we should do a fund raising for server upgrade only. This is so frustrating that whenever there is some exciting news, you can't rely on IV webpage because it goes down. If core team needs money for server upgrade, I am all for it but someone please fix this mess.

USCIS has to issue EAD within 90 days (and you are within the period) or else it has to issue an interim EAD, especially so that the applicant's job is not jeopardized.
