DOS has publicly admitted that they made a mistake in the past interpretation and allowed visas to flow to EB3-ROW and EB3.
Do yo uguys seriously expect DOS to start making the same mistake they publicy apologized for a few months back?
We all talk about staying united.. but if EB3 folks are going to get together and start asking DOS to unfairly divert visa numbers away from EB3 (mostly to EB3-ROW... numbers will run out before EB3-Isees it), how are EB2 folks expected to just sit and watch?
How can we stay united then?
What would you do if your blood brother was in EB2 while you are in EB3? Would you do the same?

That's not correct. FBI cannot deny somebody a visa JUST BECAUSE they cannot do their job in a TIMELY FASHION. Law states that "YOU ARE GUILTY ONLY WHEN ITS PROVEN"
Also, Please keep in mind there are over 12 MILLION ILLEGALS WITH NO RECORD!

My priority Date is EB2 May 2006. I will be current if the dates got moved.
I will be out of the country for the entire month of May.
Please let me know if it is acceptable to be out of the country during 485 approval.
Also please let me know what I need to do at the port of entry.
May not be acceptable. As soon as your dates become current, I guess you will be eligible to file for 485 on May 1st. and you must.
Come June 1st and if they retrogress, for some reason, you will miss it.

A number shd be printed on your approved I-140 approval notice. Always save this number. Its just as imp. as your D/L card. :P (till you get your GC stamped)

First of all thanks a lot for your reply and i further have some question if you could please help me understand that. the situations is that I have given my New I140 (EB2) to my lawyer and all he did was took a copy of my I485 receipt notice and said he will send that to USCIS. My PD on EB3 is Feb. 2003, how would I come to know if my EB3 PD was ported to EB2 by that I mean to how I would come to know if my I485 was ported to EB2 and still have PD of Feb 2003...

I am a silent visitor of this website.
Just my 2 cents... Don't think USA is like India where you can do something forcefully. Why don't you guys understand the real problem of USCIS.
Do you think that by sending flower to USCIS will force them to make EB2/EB3 current for 2005/2006/2007 guys??
Please try to understand their problem.
Also India is the great. Why don't you guys just think that India is your home country where you are born and brought up. Why you people can't just wait and watch?? If nothing happens to the so called GC, then why don't you think to pack up and go back to India???????
My sincere request, please don't do rally, you might be arrested......you never know what they can do..... Don't you think that, it is better to go back to India rather than being embarrassed here in US???

Would you not retaliate if a wrong was done to you or your family. The days of British Raj are gone, dear. Grow up and stand for your right, and don't be ashamed.
Second, all the efforts from this community are making much much noice- as in getting media attention. Even if we don't see immediate benefits, others would. So, think for others and long term
Third, don't be a pessimist. you don't get arrested for peaceful rallies. There is still law and order in US. And, please do not discourge us.
Last, please join the folks in rallies and other efforts.

This needs to be advertised on the forums here or on the home page. Most people don't know what IV's expenses are.
A generic breakdown of costs, without going into specifics, would help members understand the expenses and provide some transparency.

Many of us could be over-qualified for our current EB3 position (after so many years of wait) and is accepting the current position only to strictly adhere to "same/similar" job classification. In that case employer can file a GC for our real qualification i.e. Eb2.
Yes agree. The point is that for an example in September 2008 if you used AC21 then on that date you and your employer claimed that your skills are matching for "particular EB3 job classification" . Now if you go interfiling to USCIS in March 2009 then USCIS doubt as logically employer ca not establish the "natural skill progression" within 6 months.
One more thing - RFEs. Although people used AC21 in 2007 or start of 2008, just recently USCIS sent RFEs to many. All of them have just finished replying those RFEs in which hthey claimed that they are still working on a "same job" matching EB3 skill. My employer sent that RFE response in May 2009. So my clock starts again from May 2009. In December 2009 it is almost impossible for my employer to show that " I am fit for advanced skills". So this is the glitch that lot many lawyers are strongly hesitant to proceed on interfiling.

When I call through vonage phone, the wireless internet connection to other computers is getting lost. Is this the problem others have too?

I know most of the ppl file EAD and AP along with I-485, but is it possible to file EAD and AP at a later time and not with I-485.
I know it's a stupid idea but just curious whether we can do that or not?
Also is the filing of EAD and AP also ties with your PD being current ?

47K + 5500*2.1 ~ 58000 visas...for EB2 I to make it current. coldcloud-> you cut short the waiting time by half ( from 10 years to 5 years? :))
I believe you dont need to multiply all of the 485 by 2.1 as already applied I485 will include the family?
