I have paid SSN for many years now even I have received a letter about 3 months back stating I am eligible for cetain Social Security benefits .. and how many points I have accumulated so far.
Every month I pay this amount towards SSN. After paying SSN for many years, I still stand no privillege of early Green card, I am still stuck in Green card process.
I am sure there will be many people like me.
I also hate loosing SS Taxes. I mean we dont have any security in this country. We get 60 days to pack up if we loose our jobs and then they collect SS taxes from us. This is insane and a gross abuse of people on H1B. I think we are equally to blame to continue taking the abuse as the abusers. I fully support the clause that Green Card/Naturalization is a priveldge and not a right, but robbing me out of my money is not. I do support filing a lawsuit against this fully. I am sure if we pull one years worth of our SS taxes, then we can pay for this suit. We might win or loose but least we will have peace of mind that we faught for the right cause.

(1) they believe EB2/3 mid-month retrogression is unlikely in July based on coversations with relevant folks in govt.
(2) USCIS is unlikely to want a spirited fight from AILA by retrogressing mid month, especially given the fight that's already on about June EB-3 unskilled
(3) The June EB-3 unskilled mid-month should be viewed in the context of the just 5000 visas that were left.
I am not going to qualify the attorney by firm name or with adjective phrases such as "very high profile." Nor am I going to quote the attorney in multiple colors. Posting it here for what it's worth (even though I realize this would sound totally bogus if I were to start this post with "a bird told me that...") None of the above is secret knowledge; apparently other AILA attorneys are also up to speed on these points.
In any case, however relaxed attorneys might be, we should probably work on trying to hit that ever-moving target of "as soon as possible," if we want to see the smile that an EAD card will bring to dear spouse's eyes.

That photograph went into Washington Mutual's file as income proof. If you think, the housing crisis is because of defaulters, you are partially wrong! Prices went very high and people couldnt buy and that is the reason home prices went down. Since it went down, loans backed up by those very assets lost value. And people defaulted because what they owe was higher than the value of home!

The first point is illegals have to be paid at american laborer wages. They are currently dragging down labor wages. if the wage is monitored like H1b and set by the govt, enough american citizens of the 15 million unemployed, will take these jobs and illegals will have to leave.
Most people may not know, there are millions of American farmers, roofers, etc, who can't find a job because of illegals. We compete with americans at the same salary and with the disadvantage of visa overhead.

The situation is the same. In my case and of course in most of others too, what he/she said is correct. Waiting for Eb3 to cross 2001 has become a difficult thing. If I started an EB2 app rather than hoping positively, I would have finished my wait for GC.
Ever since retrogression started the dates have not crossed 2001. 245i or not, the backlog is a fact. Sad part, when there is action items from IV, trying to talk to my state members, I have realized and been told that IV does not cater to EB3 anymore. It is disheartening how much ever I try to explain, occasional members look at IV threads like EB2-EB3 predictions and say there is no hope for EB3 and also IV has no answer to it.
I tried my part...too bad I was not able to participate in the IV advocacy day due to family emergency. anyway, let us hope IV's persistence yields us the results. My heart goes for a lot of EB3s who may automatically qualify for EB2 just due to their experience.

Such armchair strategy folks are the reason we are all suffering in EB3 I. If these folks joined this effort and worked hard to fix it, we would have made lot more progress. Despite being highly educated, some people fall prey to divisive posts and opinions on the forums without checking the facts.
People who had come to the DC advocacy day this month know what we do and that our focus is solving EB retrogression completely. We do not talk about EB2 , EB3 categories. We talk about the overall retrogression in EB visas.
The biggest damage and threat to this effort is not from anti-immigrants or other interest groups but from people of our own community who spread lies, pursue personal agenda and grudges, talk against this effort and cause damage to this community effort. They forget that this damages their own cause. Have you seen divisive posts, or anti-organization posts on the forums of anti-immigrants? Just think about it.
After leading this effort for more than 4 years I have come to a realization that we as a community are the reason of our own failure and the reason for our own successes. There is nobody else to be blamed. If we have to blame someone for this broken system, it is ourselves for not being able to get together and fix it.

I recently got my passport renewed for expiring 10 yr old passport. It took 2-3 weeks in SFO consulate. I have had to deal with this consulate 2 times, one for making my old passport ECNR and once for renewing passport. I found them courteous and very prompt. When I went the first time, the lady asked me if I had any emergency and if she could help me with something as I had gone to the consulate in the afternoon when they are closed for business, which is nice of them.
Two questions, last year when I entered US the officer at POE gave me I-94 which was equal to my passport end date. Subsequently I got my passport renewed and my company also filed an amendment to my H1. Now on new H1 my I94 is valid until 11/2009. My question is, based on my old H1, do I need to go out of the country?
Second question is, In my old passport there are 2 valid US visas, 10 Yr B1 and 3 yr H1. How do I get them on to new passport?

Susie, I can say quite strongly that IV's agenda is quite officially
"H1B quota is not an issue that we wish to take any sides on".
We are trying to reduce the backlogs as a primary goal.
The main aim is to reduce the backlogs which will also reduce the age out problem, but not fix for those already aged out. Believe me, even if this was the only issue on the agenda, it is hard enough to get this done.
If we don't fix the backlogs then age out will be irrelevant. Let's imagine that H1B quota is increased, and EB3 ROW never becomes current because of more H1B ROW newbies. Then EB3 India will never get any spill over. In this case new India EB3 applications could easily have a 25 year wait, by which time the primary petitioner will have retired invalidating the whole application. Thus you can see that increasing H1B quota works against us (although the official position is no position).
I am considering computer modeling this, because I think that the a 25 year wait is very possible with the current scheme (making age out easier to push maybe).
If there is an opportunity to provide ago out protection without risking the main aim then I think that it will be taken. First we need a seat at the negotiating table.
Until we get a seat at the table we have the trade off between raising age out complicates things, and raising age out keeps it personal. There has been some debate over the, I think that the professionals recommend "keep it simple".
My position on this is to raise the age out and other family issues like US citizen children being forced to leave because their parents are. But only raise it with those law makers it will clearly be received well with, and not be a distraction.
There are other issues worthy of targeting, but they too complicate things, and risk us not getting a seat at the table. For example banning consulting. This could force many to leave, including their children, through not fault of their own. I think that consulting should at very least be grandfathered, and have some other exceptions. But again pushing that would be a distraction.
As I said, if we get a seat at the table, this issue has a chance.

It was great meeting and working with everyone especiallyJay,Aman,Himanshu,Vandana,Prateek,Nilli, Vandana,Mark,Tamsen,Puneet (yes- I am being nice to you inspite of the lawyer jokes u crack at my expense!!!),Anil,Sanjeev,Rajesh, Macaca (yes I was a bit too hard on you :) but it was all in good spirit) and of course my friend Meenal. I just want to thank a few volunteers who worked on lobby day meetings with me but could not attend the lobby day or the rally day-Fora,Vasu and Payal. We are all so glad the lobby day meetings and the Rally went well. It really shows what we can do when we all get together. Kudos to IV and its members!

We EB3 folks are not requesting for EB2 visas. We all will be happy to get 50% EB1 spill over visas. The other 50% can go to Eb2s.
right now 100% of EB1 spill over is going to EB2.
Allocation of immigrant visas is not a policy matter. It is based on law. Any change should come thro law change. Congress (&president) has to amend the law (INA) how to modify the allocation. It is not a simple matter. Both DOS and USCIS knows it unfair to keep EB3-IN in 2001; but they can't do any thing. Thats whu EB3-IN folks should try hard to make the congress to change the law. Contacting DOS or USCIS not going to help, as they have no authoity in changing the allocation methods (they only execute the methods).

Yeah, but the 5th item being demanded is the same as a free trip to the moon with out any flight training. Another thing, I want to thank all the volunteer(s) who were asked to stay back to take care of the origin point and couldn't march in the rally.

Unfortunately your friend is correct - the alternate I can think is withdraw your present application and file I-140 and I-485 simultaneously now - other please tell whether this will be a good approach for their benefit. Can EB3 file concurrently I 140 and I 485.
But how to revoke an already submitted I-140 Eb-2?
By the way, many a time such a case would be issued an RFE and then you could change (not aware of the exact terminology for this) it to Eb-3.

Yes, approved LC expires after 6 months. This rule has already been implemented by DOL along with labor substitution elimination.
