We need to underscore this point over and over again with a sense of urgency. Having to wait ~5-10 years for permanent residence **just because of country of birth**, a discrimination practiced only against Indians and Chinese (well, I know it's country quotas and each country has one, but it only impacts Indians and Chinese) is nothing but a grave human rights abuse.
As the President has said many times over, "the time is now". This needs to be fixed.

So far all the arguments and suggestions were really good. But Totoro seems to be looking for compelling stories. There are very depressing cases where people had to restart their GC process for no fault of their own. And some people have been here for more than 10 years still rotting in the queue hoping to get a GC and move on with their dreams to become a Citizen of this country.
However the collective compelling story is what Eternal Hope has expressed. This is exactly the situation for people from India/China.
Sure anchor babies is not a great argument for illegals cause it promotes illegal immigration. (In fact I heard in some countries Citizenship by birth only works if the parents are legals. But thats a different story.).
Let us say because of the reasons listed by Eternal Hope we are forced to go back to our home countries.
Firstly, How fair will that be for our children who are Legit Citizens of US.
These innocent kids know only US as their home. Just as much as any other US Citizen. Most of the kids can only speak english. They can barely understand their mother tongue. Point is they are just as American as any American kid.
If they are forced to go to a foreign country, far from their friends and familiar surroundings. Had the change been for the better, still they would feel they were wronged. My guess is they will hold a grudge against us, their parents, and their own country.
This to me is compelling reason, specially since I am a Democrat (sorry can't vote yet).
BTW, my moral support has always with Obama, and with Zoe Loefgren.

That was the defining moment for all people who have been subjected to injustice, been told that they were not good enough because of their race or country of origin. Think about it... Although I used my lawyer to file my I-485 ( My date was current in June and I submitted all my papers to my lawyer on May 20th and actually it was filed on 27th June), I also prepared I-485/ead application myself over the weekend and when I compare this application with lawyer's, mine was more accurate because lawyer mad small mistake in my address.
Anybody who follow this thread can prepare the application by him/herself.
Both points above are very very true. That is, lawyers will make more mistakes then you and the forms are very very easy to fill specially based on info available in threads. It should not take more then 2 hours to fill the forms.
Please fill the forms on your own and send them for Jul 2 delivery.

Contribute for what. I would , If I am told for what we are contributing. What are the real faces.
I am not one of those who can go advocate at places as I do not have luxury of it. I respect people who are going beyond their daily schedule and advocating, but what are the goals.
I however want to contribute not *donate* if I know what am I going after.
For any advise the standard answer we get is - Consult your immigration lawyer.
I dont want to dampen the interests of others who are ready to contribute. Tell me few reasons and I can contribute a decent amount.

For Indians we had vaccination in India at our childhood. Due to this some will get positive results in the skin test. Then doctor is going to recommends for chest x-ray. Some of the doctor's are going to overlook this. Because the medical report is a sealed cover we don�t know what number he written in the medical examination form. You can ask the doctor.
And one more thing is for skin test we have wait couple of days.

vparam, i've been following this issue a lot longer...you have to understand the blue slip is just procedural....the main substantive issue is what proposal can attract maximum republican support during conference. The Hastert doctrine (majority of majority rule) states he will not bring to the floor a proposal thet does not attract a majority of republican votes (116 votes). Pence is a star conservative (has a 100% rating from the American Conservative Union) and is a rising leader in the Republican Party. The Pence proposal is gaining strong visibility now and he is going to introduce his bill this week. Tancredo recognizes Pence's standing among repubs and that is why he's asking his minions to attack it.

My Attorney has sent in more than 2 inquiries with DOL and each time we get the same boilerplate reply saying you are in queue and we are processing it. This is an automated reply as few of my friends even got the same reply with no change except case number.
Also as for as i know there is no time limit as such as 4 months to wait before contacting DOL.

The biggest weakness of DOL/USCIS is going back to the older cases while newer cases are piling up. They do not have any service level agreements to adhere to. That is why many labors in the older process ended up in BECs.
Please raise this problem with your local senators and representatives and put pressure on DOL. The longer it takes at DOL, the longer it takes for your GC. Do not be under false hopes that your I-485 will be picked up based on the PD. For USCIS, RD is the convenience and they wil only go by that even if the law is written otherwise. So get your application out faster.

- It was a historic event, in a historic and scenic location with plenty of symbolism about what America represents - the Washington Monument to the Capitol, and the lobby day, reception (both of which I missed thanks to my flight delay) and press conferences at the Rayburn building.

1) I have read some of your earlier posts on this thread and what you have primarily done is merely re-iterated what the issue is. Without any contribution or suggestion as to how to actually resolve it. And since the situation has continued to stay the same for several years due to Congressional indifference, you seem to have decided to pick on IV for all the faults with EB3 backlogs and the lack of effort therein to resolve the same. For a minute, please understand that we all know the facts and realize what plagues EB3 backlogs.
2)Yes I have been on every EB3 prediction thread and know the numbers are too bad to be resolved by anything other than CIR (dead) or standalone bills. I do not know why you are stuck on insisting that we all think EB2 becoming current is the only solace for EB3 (associated spillovers etc etc.). IF Eb2 I gets current - well and good - Eb3 will still need some legislative relief (here I go again with EB2 vs EB3 - something I hate to do). But then one of your original gripes seemed to be blaming IV for not considering EB3 provisions in this Diversity Visa Bill which, at this early stage, is completely befuddling!
3) Your entire approach of going after EB2 applicants and blaming them for your dreamt up failure of IV is insane. Diluting the discussion with vitriol and then blaming everyone around you for not participating makes you a bigger "bigot" (sorry - just paraphrasing one of your used words) than what you blame others to be.
4) You do not represent my opinions. So please stop advocating yourself as an EB3 representative (which you are doing whether you believe it or not). With the points you have raised and the negative vibes you have created between EB2 vs EB3, you have shown that you are concerned and frustrated only about your own personal GC situation and are trying to use the EB3 tag to shove it down my throat. Which I completely detest.

The idea is that EB2 had benefited to a certain amount because of the change in spill over rule which is good for them i am all gung ho for them. Now since EB2 is in a postion where it will move ahead (fast or slow but it will move) IV focus will have to move towards the other category they claim to represent.

No i do not want to represent you (An EB3). I see that you are just before me. I followed threads for number predictions but it seems there aren't many people doing predictions for Eb3.
I have read here or somewhere that there are only 150 to 300 GCs per month for Eb3 india If it is true then it will take more than a couple of years to get to you as there are 8000+ candidates before you.
Have you seen any calculation for Eb3 any where?

There is no proof that the new bill will reduce costs at all! It will take many years to realize it anyway. Reform was needed but not at this moment when there were bigger issues that needed fixing in 6-12 months.

The point that I am making is that the anti-immigration lobby sees all immigrants in a single light. If we try to divide ourselves away from the low-skilled we are not going to get anywhere. Immigration in general touches a number issues - civil and human rights, economics, etc.. By trying to distance ourselves from any of these issues, we are in fact make it more difficult for ourselves. For the record, I do want a green card, I want a fair system. I am aware of that well publicized stunt. Do you know we have only 800K farm workers and 1.5 million farm workers were granted amnesty in 1986?
The only way to get cheap labor is with short term foreign contract labor, amnesty will never work, they have to return anyway.
The farmer will stop working in the farm, the day he gets his GC. Lets not compare an educated american. A citizen with no schooling would take the job at the right wage.
Nor really true. I have disagree with you here. Labor for agri jobs was documented (and quoted) even by Bush when he was pushing for Comprehensive Immigration reform in 2007. The number 1.5 million that you quote includes families and children of those granted amnesty. Its part of keeping the family unit together.
There is no proof that the new bill will reduce costs at all! It will take many years to realize it anyway. Reform was needed but not at this moment when there were bigger issues that needed fixing in 6-12 months.
In the long run it will. The issue was that people could not afford to pay their healthcare insurance premiums. Sorry to do this to you but, to be "politically correct", the Reps in the House are addressed as Congressmen/congresswomen. Only Robert Menendez in that list is addressed as a Senator since he serves in the Senate.

Tons of thanks for your time and this letter. Though most of the case are pending with Atlanta, there are few people struck with chicago as well. But the number is very small compared to atlanta. This template sounds very good to me, I will post the same at IV and let you know the feed back. Also I will direct the folks struck in chicago to you, they can hire you if they want you to represent them or I will ask them how do they want to proceed.
If we give the case number and employer name, would there be any impact/side effect ?

All of the Chicago cases have been transferred to Atlanta. If the Chicago guys want to talk to me, I�m happy to do so. They don�t have to hire me if all they want is information. As for putting names and case numbers, without that information, they won�t take the letter seriously. Also, I think that this will get the DOL to move on those cases. Almost every time I have made a specific complaint, they have responded by resolving the case right away in order to make the whole thing go away. It wouldn�t surprise me to see the same thing here.
