God bless everyone still in this situation. My son turns 21 in October and we too were faced with this threat. Thankfully we got our I-485 submitted in June and he even received a letter from USCIS directly to him confirming he is now locked in under CSPA protections (which we already knew, but was very nice anyway).
Our attorney had pointed to the potential in the DREAM Act proposals that keep resurfacing . Although primarily drafted to assist illegal children brough here by their parents, the provisions would also apply to children brought here in H4 who aged out. All the other conditions would have to apply, but we had intended to convert our son this fall to F1 and then hope that Dream Act would pass sometime in the next 2 years to save him before he turned 25.
Another angle for those of you trying to seek protection to explore with legislators as there is very broad support for DREAM but it keeps getting caught up in comprehensive reform agenda.
Good luck to all of you still trapped in this dilema, I share your pain and sympathize with the stress this places on you and more improtantly on your kids.

I am ROW-3, Applied for I-485 and EAD cards for my self and my family members. RD 06/19/07, ND 07/19/07. Received EAD cards, finished finger prints and waiting for name check.
I have another family petition (theu my Dad) and my periorty date became current this month. I do not know what to do. To go ahead and apply for GC using may father's petition or to waite untile I hear from INS regarding the work petition.
The cost will be about 4,000 $ and I am afraid that I will be stuck in the name check againe. I was told that I can only have one pending GC petition at all times. The advantage of the family based petition is to be able to work for any employer, no restrictions at all.
Any ideas, please advise.

i assume this is for everyone, including citizens. you may want to make the legal part bold in the phrase "legal immigration". immigration automatically raises everyone's eyebrow but you need to emphasize that the fight here is for "legal" immigration. that is a key differentiator especially when nobody knows what the heck EB, priority date etc is.

Unless crises strikes people and they are shatters they do not care.
Just see the old threads of EAD delays. All these people with EADs were sobbing on those threads pleading to IV to help them. Most did not have a donor status or had contributed a dime. They were on the verge of losing their jobs when IV helped them get their EADs on time. Now where are all those hundreds of people. Are they contributing a dime for the lobby day? I bet after 2 years, they will come again to IV and sob about EADs delays and ask IV to help them.
This is the part I am not agreeing with IV and don�t like very much. Why would IV ever need to help people who never bothered to contribute time or money?
If they can get it for free why would anyone wants to contribute ?

Well I really think this is reasonable suggestion to factor Priority Date to determine eligibility for citizenship. It could be 5 or 10 years past your priority and only after approval of green card. Currently many people wait for 8 to 10 years for green card and another 5 years to be eligible for citizenship and some lucky ones get green card in 2 to 3 years and citizenship in another 5 years. System should somehow be balanced to have close to uniform wait times towards citizenship for all.
sorry to sound like a beaten record - but it seems that everyone here pretty much sees citizenship as fait accompli!
how has our respective motherlands harmed us that despite being pushed around by US for years on end -we are desperately seeking US citizenship?? after all - in many cases - its the basic and advanced education received at our respective countries that has made us qualify as "highly skilled" immigrants here.....

Further, in my country, there are still reservation policies in everything, which may prevent the kids in going in for the education line they like. I donot want to explain this more as I may be degrading my own mother country. In a nutshell, everyone who wish to be a citizen of this country will have lot of valid reasons for getting a citizenship in this country.

I havent received any emails from IV. I have a valid email account and verified twice. I haven't received a single email or newsletter.
Now its not a big deal as I have been following up all the events through website and also contributed..
But wanted to get it to the admin's attention so that they can check if there is some software glitch. There might be people like me who havent been receiving emails and are not visiting the website on a daily basis..

It depends on the service you choose, I think they have an option for expedited service and you can get the document within couple of days. They also provide you the pdf format of the document, you can print that document and submit immediately instead of waiting for the postal document.

my notice date is sep 26, 07. It's a mixed feeling...the wait has killed the enthu, but at the same time, I feel good that no more visa, AP, EAD extensions, and feel that I have wings of freedom to pick up a job i like, place i like, not bound by CIS rules regarding employment, etc...

Yeah some forget to be civil...but i believe that these few don't represent all of of IV.
And we are all subject to emotions and can make these mistakes as well where we forget to be civil.
I agree there needs to be more clarification on IV's goals and current pursuits....coming soon....a better FAQ page ;)

Every time some one gets a response from ordinary members such as myself, these members asking so called "legitimate" questions, these members such as bitzbytz, rajuseattle et al, these guys will immediately cry foul, uncivil, being manhandled, abused and battered. If you want to have a debate, be prepared to handle the debate and don't pretend that you are melting when someone tells you that your idea is foolish. Either you want a debate or you don't. And if you want to have a debate then why not come up with a response in support of your arguments instead of engaging in name calling like "uncivil" etc.
I know when someone is asking a genuine question. Its no rocket science and I can tell when someone is genuinely asking a legitimate question and when someone is trying to throw mud on work done by others. It enrages me to see these people not doing anything but at the same time, damaging work done by others.

I had mailed my passport extension documents on 09/15/2008.
I have already booked my Tickets to India on Oct 28.
I have not heard from the Houston office yet on my passport renewal status.

I am jumping ahead of the situation here, but I just wanted to see what other members think/know. Assuming that the 90K visa recapture happens, It doesnt take too long for them to be used up in the current situation where there are a lot of people with labors and approved 140's (w/PERM). Not every one will have an oppurtunity to file for a new labor and file for 485. If DOS makes the PD's current / post Mar 2005, wouldn't it be unfair to people who labors are pending for 3 yrs. How does this work out in the previous recapture? HLG doesnt say about numbers being forwarded to the next year though.
To be fair, maybe we should ask the lawmakers not to allow the recapture of the 90k visas to make sure that people with later PD will get GC later. Besides, we should ask DOL to retrogress again, maybe to sometime in 2000, to guarantee that everyone before that time gets his/her GC. We should also ask USCIS to stop processing 485s and resume until BEC finishs all the LCs.
Recapture 90k visas will never worsen, if not improve, your situation!

Looks like NSC is also approving I-485's. Not sure how long this trend is going to continue, guess all depends on how much visa numbers gets trickled down from other categories to EB2 India / China. Hope and wish they are many.. which would helps many people waiting in line and PD not getting pushed back for FY '10. I feel bad for EB3 folks though, seems like nothing going to change for them at least in near future, untill there is some congressional action. Looks like NSC is also approving I-485's. Not sure how long this trend is going to continue, guess all depends on how much visa numbers gets trickled down from other categories to EB2 India / China. Hope and wish they are many.. which would helps many people waiting in line and PD not getting pushed back for FY '10. I feel bad for EB3 folks though, seems like nothing going to change for them at least in near future, untill there is some congressional action. BTW, today I treid calling USCIS. First the 1st level representative spoke and she straightway created a SR for me and my daughter. Once she finished that part Politely I asked her to transfer to an IO. Luckily without any wait call got connected to an IO. Had very brief conversation with him. He was fixated on my EAD being valid till August 2010, so according to him I don't have to worry about. But I persisted with my line of questions like current status, whether it is pre-adjudicated?, whether all clearances are done etc. Only thing he replied was "Your Case is in REVIEW". I asked him what does review means. His answer was review means review. Our conversation stopped there.
What do you guys think on "Your case is under review"?
