I wonder how much power these committees have. It is clear from her letter that DOS/DHS chose not to respond to her or send her any info and defy her request to continue accepting AOS applications until she had a chance to review the matter closely. Committee has the subpoena power to force the document release and hold hearing but if DOS/DHS ignore her letter again, I wonder what would she do.
I guess the deadline is tomorrow so we'll see how this unfolds.

This bill might do something good for some EB3 folks who have advanced degree but then again instead of a EB2 and EB3 difference we will now have an EB3 MS and EB3 Non MS difference and as i see it there is not much difference between those two. Same wine new bottle.
what about highschool dropouts vs college dropouts? literates vs illiterates? same wine new bottle too? then why the distinction of EB1, EB2 or EB3 either? Just hand them visas as soon as they get down that plane :)

You are right that there is no hope for EB3 India. But only as long as you and others in EB3 do not meet their lawmakers. Take part actively in action items. We have details of every local town hall meeting in your area and you can go there. We can help you set up your meeting with your lawmaker in his office. We can help you meet in their DC office if you want to get really active. We have several more details and ideas and need people to work on them.
FYI we never use the terms like EB2 or EB3 in our meetings with lawmakers. There is no priority in our agenda based on category or nationality. Well Pappu, the fact of the matter is nothing has been done specifically to help EB3-I/C/ROW. IV may be EB agnostic but EB3-I seems to have been stuck forever to the point of despair.
I and other EB3s have donated to most of the IV causes and campaigns. We have written to our Senators, reps, sponsors and co-sponsors of bills but nothing has helped.
If IV renews its focus to help EB3-I/C/ROW then you can expect more contributiuons from EB3s.
I do not want a lesson on EB3/EB2/EB1...there is no end to opinions on this forum. What I and other EB3-I/C/ROW want are results. Contributions, meeting the lawmakers, writing to politicians etc will kick in fourth gear if there is a reasonable advancement of dates for EB3-I/C/ROW.
BTW, your and other IV leaders' efforts are very much appreciated. All that I am saying is that IV should be focused on EB3-I/C/ROW (through tagging recapture to a bill or something) now that EB2 is getting help from USCIS spillover.

Schiff has repeatedly stated that he does not believe in amnesty for undocumented aliens, but he does believe that those who have been living in this country -- working and paying taxes -- should be given an opportunity to embark on a lengthy and hard-earned path to citizenship. Yes, my lawyers have shortlisted cases by PD and EB2/3 categories....and suggested best effort to file before July 31st..(when new fees kick in - guess they want to save the EMployer some green)....

In California, a musician who claimed 100K income/year was asked to stand in front of his home with his musical instrument and photographed. That photograph went into Washington Mutual's file as income proof. If you think, the housing crisis is because of defaulters, you are partially wrong! Prices went very high and people couldnt buy and that is the reason home prices went down. Since it went down, loans backed up by those very assets lost value. And people defaulted because what they owe was higher than the value of home!
You are really delusional if you think non GC home-owners are to be blamed for this mess!
You really need a good tax refund from the government! File your taxes soon!

I think spillover method has not been changed since years. The only puzzle is that whether it is horizontal or vertical or combination of both that USCIS works with we exactly do not know.

I just called them now. I was lucky enough to talk to the operator. She said I should be getting it in a week. I guess they have a back log. She couldn't tell me anything else. BTW my application was received on Sep 11th. Money order was cashed on Sep 23rd. Still in process not shipped yet. I called 713-626-2148 and pressed 1 then 9 and when it asked for voice mail or operator I pressed 0 for operator. I kept pressing 0 until someone answered.

I am in a similar situation. After failing to get a definite answer on the exact time taken by the process of changing status to H4 while in the US, I have decided to take a trip to India to get this stamped instead. I was told that change of status to H4 needs to be approved before starting school, simply showing proof of having applied for COS is insufficient. But if you apply for change of status to F1,then approval is not required before starting school. However I would suggest you confirm this from your lawyer/school.
