    I'm ready to file AOS, while filling in the forms I realized that I have just one more page left in my passport which is valid for another 7 years.

    - If I get a "new booklet" from the Indian Consulate, does it come with the same or different passport number?

    - If it has a different passport number, does it affect the AOS application once the AOS has been filed with the previous passport details?

    It does come with a new passport number. Also if you have current valid visa in old passport, you always have to carry both passports together. Your new passport will even have a note saying that you traveled earlier on a previous passport. Also the number of your new passport will be noted on your old passport.

    I do not think you will have any problem due to applying for a new booklet. Passport is an active document and subject to ongoing changes.

    You might want to confirm that with your lawyer though.

    I just got sent a packet from NVC to ask to confirm my layers details and my current address. Im hoping the June VB will put me in the current section...?

    I see that most of you who are getting approved are 2007 filers. Any 2008 filers got approved?

    Also what is the number to call to Open a SR? Is it to soon to call since my PD is current only since yesterday. Folks who called to open a SR please let us know.

    Most of us are missing the point here. The bill is aimed at those immigrants who have obtained advanced degrees in the US. And believe me, there are lot of aspiring immigrants who have been waiting since 2002-2003 who also happen to have American degrees, most of them stuck with EB3. Priority Dates will still be in play. Most probably, there will be a new category. These additional visas will help clear up backlogs irrespective of your current visa category. If you have a US degree and your PD is current, you will be eligible. Not sure what the confusion is about :)

    Mine is similar to yours. Paper filed and receipt date 4/2/2010. LUDs on 4/8/2010 and 4/13/2010 (exactly 1month till today). Still waiting.

    E-filed EAD and AP Renewal on 2nd April.. Sent documents after a week.. Received couple of LUD's and the last one on EAD application is on 04/22/10 and the application is still in Initial review. In case of AP the LUD is 04/07/10.

    Not sure if someone else is in the same boat??? Should I try calling USCIS??

    Does CPO status on USCIS site mean 485 is approved? or is there some hidden processing going on, which can turn the tables??

    Just skeptical.


    btw, I forgot to mention. I thank the IV members for their invaluable guidance. Will continue being a regular member.

    CPO = Card production ordered.....my understanding is that the card will be produced after the application is approved. So CPO = you got yourself an approval.

    some assumptions and calculations with answer = 750k . You are right to get this 750K approved it will take 5 years.. ...one more thing to consider is country level limitations. and EB1/2/3 limitations...ROW and China may already be catching up (may not even need 5 years)...India will need 50 years not 5 years to catch up.

    My 2 cents..

    Every one is here is emotional, after seeing the beautiful collective work of USCIS/DOS/DOL/AILA ect.. Now AILA is jumping high between sky and earth and due to the mismanagement of system. Everyone knows both USCIS/DOS is mismanaging the process. However, What AILA was doing when DOS issued the visa bulletin 15 days back? Do you thing, AILA did not know the estimate of number of 485s going to be filed in the month of July? Why did not they call USCIS and DOS about the implication of making all categories current? Why did they not advised their client that there is a mistake in VB, it is not possible it will become current in just one month? All of sudden, why they are jumping and collects all the money from customers to file 485?

    Here is my estimate how many 485s is going to be filed in July.

    BEC has almost cleared all the backlogs. The rough estimate about 200,000 LC might have been certified by BEC. Let�s assume about 150K out of 200K candidates held back due to retrogression from 2004 to 2007. Let us assume 150 K PERM LC certified between March 2005 and June 2007 affected by retrogression. Therefore about 300K (primary) people will go for 485 in July. If we add dependents it will be another 450K. Therefore about 750K 485s+ 750K AP + 600K EAD applications will be filed in the month of july.

    If 750K 485s filled in one month, we need about 5 years sum of EB visa numbers. It needs 5 years to issue the visa. There should be 750,000 EB visas should be immediately available as on July, to make all EB categories current. There are only 40,000 visas available as of June. Does AILA do not aware of this simple estimation?

    There are 40,000 eligible/approvable 485 are currently pending with USCIS. The composition of PD and country of chargeability may vary between 2001 and 2007. In order to issue 40,000 remaining visas to already pending 485s they made all categories current, otherwise it will get wasted. In order to approve a 485 the PD should be current. That�s why they made it current. It is not for accepting 750,000 485s, when available number is just 40,000. AILA should have aware of it and advised the USCIS/DOS and customers properly

    Our attorney has set a Saturday deadline for the submission of all forms so that the filing can be done in Jul 1st week - They have reiterated several times that the visa numbers can be unavailable in the middle of July and this cannot be reversed even though USCIS cannot legally override the DOS bulletin.

    Yep. It would be good for EB3/2 - India-PD 2007 filer considering canadian immigration simultaneously...ofcourse do not rush now for filing Canadian PR - As Canada generally gives you PR witin 2 years and by that time 2007 filers may not have passed FBI check for their 485 here..If the way things are going I see at least 5 years wait for 2007 (India)filers.

    mdforgc and other PERM gurus,

    Please help.

    I am in the process of filing PERM. Ads have been placed etc and all the
    formalities completed. Now, we are at a stage where the forms have to be prepared, signed and submitted. However, i am very unhappy with my attorney. He is unethical and i am afraid he will screw me up. So here are the questions


    1) At this stage ( not yet filed PERM) but on the verge of filing, is it possible to change attorney or is the job order etc specific to the Attorney.


    2) In form ETA -9089, in the Alien Work Experince section, it says to give the name of the aliens supervisor and the employers phone number.

    MY attorney says this is not required. Any thought on this. Did your forms mention this ?


    3) I am afraid my Attorney will deliberately mess up the form. What should I watch out for in the form before signing on it ?

    4) IS there any redressal system at all in this country for Attorney Malpractice ? Anyone taken this route before ?


    Guys, please help me as I have to take a qucik decision.

    The first step you should get your employer to do is to file a job order in the state job bank or americas job bank. You have to keep this ad for 30 days and then wait another 30 days to file PERM. This is the longest time. All other forms of recruitment needs to wait only 30 days and you can file PERM on the 31st day. There is no mention of working days or weekends, it is 30 continuous days. As you know in addition to this job bank order, and two Sunday newspaper ads, there has to be three other forms of recruitment before you can file PERM. If your employer and lawyer are really proactive it will only take 60 days to file PERM from start to finish. You also have to get a prevailing wage determination and post it at your job site for 10 days not including holidays and weekends. Hope this helps.
