BREAKING NEWS: LOFGREN GIVES USCIS THREE DAYS TO ANSWER QUESTIONS

Congresswoman Zoe Lofgren (D-CA), chair of the House Immigration Subcommittee, sent Secretary Chertoff a list of questions and a request for documents from USCIS to get to the bottom of the whole Visa Bulletin fiasco. The letter is very interesting not just because it puts a heck of a lot of pressure on DHS right now, but also because Lofgren's folks imply from the questions that USCIS was short circuiting established security clearance procedures to "pre-request" visa numbers from DOS. If it turns out full security clearances were not carried out, USCIS will either need to say that they had the legal justification (which would be a public relations disaster for the agency) or that they intended to complete the checks after the fact (which would be a direct violation of their own regulations). The only way to avoid answering the questions and to make this go away would be to eat crow and start working the case July cases.

I guess DOS/DHS won't provide all documentation, just like recent firing of US attorney.
I wonder how much power these committees have. It is clear from her letter that DOS/DHS chose not to respond to her or send her any info and defy her request to continue accepting AOS applications until she had a chance to review the matter closely. Committee has the subpoena power to force the document release and hold hearing but if DOS/DHS ignore her letter again, I wonder what would she do.
I guess the deadline is tomorrow so we'll see how this unfolds.

Can you please let us know the procedure? I'm very much interested in filing a formal complaint with the CIS and Ombudsman. I'm not against genuine candidates getting their GC through MNC executive category, but would like to stop this malpractice.

EB3 ROW is at Jun 2004. But as per latest USCIS inventory, EB3 ROW pending 485's are around 48,000. Visa numbers available every year for EB3 is approximately 42k. If you deduct the backlogged EB3 countries (4x3000) visa numbers, the total comes down to 30k for EB3 ROW. So EB3 ROW should become current or atleast Jul 07 in another 1.5 years. If this is not going to happen, it means they are diverting the EB3 numbers to some other categories.

I thought visa numbers are available equally per quarter and DOS is prevented from releasing numbers early. How can they say that all the visa numbers have been used (or will be used by April end)?

Q2: Jan-Mar
Q3: Apr-Jun
Q4: Jul-Sep
I think July visa bulletin would bring some good news when numbers for the last quarter along with the spill-over (if any), are released. If USICS is not as efficient we may even see some good advancement. Don't loose hope guys!!

A new theory has it that DOL deferred audit processing to H-2 temp labor. Now that they are wrapping up that work they are starting to move the audit cases. According to a post on forum, last week an immigration attorney received notifications on three audit cases. Unfortunately all three (from the same company) were rejected due to some kind of incompliance with the required advertisement format.

USCIS has to accept applications for first few days. Then they have to go through all the application to determine the number based on the country. Then they will send the number to DOS who will decide the dates of next bulletien.
It's not like USCIS will say "Oh I got 300,000 applications today, let's close the door..." It does not work that way.
I understand that you are only trying to say what your lawyer told you. But, don't try to make it sensational topic by saying "Horrible news" and all. We are anyways stressed out from the process and on top of it this rumor comes up in every other thread. :(

could it be true that only 23% of the folks who became current in May have got the approvals ? It almost the end of the month, I know that it need come in May but still...

people this is such less amount, ready to pay so much money for renewing visas etc, but you can't sign up for 20 or 50 every month. This is really becoming like begging..I do understand everyone has family commitment and other financial need but $20/month is not too much !!

So far, there is no provision of 485 filing without priority date becoming current. Has this failed too? Just two weeks before Feb. 15th. I guess the fate of this provision is determined now.
It seems that nothing can happen before Feb. 15th. Even the H1 increase has not happened yet. Democrats do not seem to be immigration-friendly as many expected before. No hope for CIR this year. No hope for SKIL this year. What a miserable situation!

add to that aman's lost bags and cell phone and constant attempts to call akhil to retrieve his wallet...poor akhil arrived back huffing and puffing and in mortal panic...later we discovered we had his home phone number and had been leaving messages on it for 2 days...and wondering why in the world he would not pick his phone up!
It was a unique situation.........
me and my wife were coming back from a lawmakers meeting and found that Aman was waiting for his wallet as the luggage was in my car...........
while walking fast she scratched her ankle badly and was not able to walk properly............ so i made her sit at an intersection and ran towards the hotel............ then had to rush back to get her, as i had asked to her wait at an intersection....
was fun and by the time i reached back i was like all huffed/puffed up and she was laughing at me...........

On June 14th the Visa Bulletin was published for the month of July, and all EB1, EB2 and EB3 green card cases are current starting July 1st, except "other workers". We have learned that this was done to ensure that no employment based green card numbers will be unused for the 2007 fiscal year, which ends on September 30, 2007. As we reported in a prior Immigration Update, an employment based green card cannot be approved without a current priority date. Additionally, the third and final stage of the green card process, Adjustment of Status or Consular Processing, cannot be filed, unless the priority date is current. US Citizenship and Immigration Services will be flooded with I-485 Adjustment of Status applications on July 2nd, the soonest the cases can be filed. Processing times for the Adjustment's interim work and travel authorization are expected to increase beyond their current 90 day times. USCIS has confirmed that Adjustment filings must have all of the requirements (medical clearances, birth certificates, etc.), or the application will be rejected. The priority dates could retrogress to their current levels, or further back, as soon as August 1st, but definitely by October 1st, once enough green cards have been issued for the 2007 fiscal year. Unfortunately, with the end of the comprehensive immigration reform bill, mentioned above, we are not likely to see an increase in the number of employment based green cards anytime soon. Once an Adjustment of Status is filed, an applicant can continue to secure work and travel authorization extensions, until the Adjustment can be decided.
