this is the email came from my lawyer today..for the inquiry they did with the consulate regarding my visa.

The stated reason for the review falls within the law under Section 221(g) of the Immigration and Nationality Act. Under these circumstances, we typically see that the government issues a notice to the applicant wherein additional information is often requested. Kindly advise if you have received any notification from the consulate on this issue.

I am sorry and can understand how frustrating this would be for you. But you keep your spirits high. Can you ask your lawyer to contact DOS himself and inquire about your case? Once he has some information, he can communicate with the consulate here in India directly. I am not sure if you can do much here. I am wondering if there is anyway for you to contact VO instead of VFS ppl.
But importantly dont get discouraged, you will sail through.

In War on the Middle Class (http://www.amazon.com/War-Middle-Class-Government-Business/dp/0670037923) Lou Dobbs says H1B workers don't pay taxes.
However, H-1B workers are legally required to pay the same taxes as any other US resident, including Social Security and Medicare9 (Publication 519 (2006) (http://www.irs.gov/publications/p519/index.html), U.S. Tax Guide for Aliens). Some H-1B workers are not eligible to receive any Social Security or Medicare benefits unless they are able to adjust status to that of permanent resident. However, if their country of citizenship has a tax agreement with the United States, they are able to collect the Social Security they've earned even if they don't gain permanent residency.
In some cases, H-1B workers pay higher taxes than a US citizen because they are not entitled to certain deductions (eg. head of household deduction amongst many others).

Please don't give much credence to 'conspiracy theory' posts by paranoid folks like H1bmajdoor who live in fear of their own shadows. Neither do they understand the difference between a law AC21 and regulations ( USCIS frames these) nor do they care to learn. Their ignorance causes them fear, and fear causes them to act irrationally.
It's best to ignore such losers who beam negative-energy. Their penchant for inaction is a self-fulfilling prophecy that dooms their life. Nothing will happen to them in life, as they don't do anything to make things happen! . Don't join their league.

My Priority date is Jan 2006, EB2-India category having approved I-140. My husband is in EB3-India having pd Jan'2004, already applied I-485 (140 is approved) and got his EAD and AP. He is already using his EAD. I am a dependent in his I-485 but did not use my EAD and still continuing on H1-B.
Since my case is EB2-India which is going to be current in August'2008. Am I eligible to apply for I-485 me being the primary and my husband being my dependent? If so would there be any problem when USCIS adjudicates my case?

My MTR is still pending with USCIS since 6 weeks. I sent form 7001 to Ombudsman office and got a one line reply that 'your case problem request is currently being processed'
Sent letters and supporting documents to 2 US senators, but i got standard reply from them saying they need 30days to find the status. Office of one senator (NJ) was very helpful but not sure how this helps in resolving my case..

The pain of waiting for 9-yrs is nothing compared to the wait now (after dates got current)...Refreshing my yahoo mail on iPhone atleast twice per hour, Clicking on Safari where the last visited page is that of case status online (Click the status btn frequently) --- Life is difficult :(

I see soft LUD on my 485 today, but the status has not changed. I had an interview in Jan 2009 and at the end of interview the IO told me that he could not approve my case as it was not current. So I believe my case is pre-adjudicated?
Someone in the same boat? Hopefully the approval e-mail comes in the next few hours or next week. <<fingers crossed>>

After seeing the USCIS news, they want press and other media not to know more about why this flower campaign? I think we have lost and Emilio Gonzalez have acted very smart.

Hundreds of legal, highly-skilled workers in the United States sent hundreds of flowers to the Director of the United States Citizenship and Immigration Services (USCIS), Emilio Gonzalez as part of a symbolic and peaceful protest over what they said was a "flip-flop" by the State Department and the USCIS on eliminating Green card processing delays.
Dr. Gonzalez announced on the USCIS website late last night that the flowers will be forwarded to the injured service members recuperating at Walter Reed Army Medical Center and at Bethesda Naval Hospital.
In response, Immigration Voice, a non-profit organization representing skilled, legal immigrants, said that they welcome the fact that Dr. Gonzalez acknowledged the symbolic gesture of our protest and are overjoyed that these flowers will brighten the day of the injured service brethren.
Immigration Voice also said that it is their sacrifice for American freedom that has made this country great and such a desirable destination for multitude of people from around the world and that they wanted to say "Thank you and god bless you" to the servicemen.
