I hope USCIS explains to us on how their work distribution process works.
Forget about that even if they publish every quarter, how many I-485 from each country of chargeability and employment categories are pending any processing, it will help analyse when one can expect their approval.
At this moment TSC is following some Pilot plus program to adjudicate the I-140 and I-485 filed concurrent, that scrwes up many standalone I-140 for whom the PD is not current. According to USCIS policy your I-140 adjudication is independent of the country of chargeability and PD. Now how in the world we explain their Pilot plus program which ignores the I-140s from the retrogressed countries is only USCIS leadership knows.
NSC at least not going into this Pilot plus program and consistent in their approval patterns for both I-140 and I-485.
USCIS is under pressure for both Naturalization cases and the VISA number utilization prior to end of FY2008, which is Sept 30th 2008. We will see some kind of RFEs for July-Aug 2007 I-485 filers during Oct-Dec 2008 timeframe when USCIS has ample time in processing the I-485 petitions.
I dont see any RFE or any other progress on our I-485s until that time...and obviously the approvals will come later when the PDs for india EB-3 and EB-2 start moving further.

Bigboy please gets your facts corrected: and read the definition of GC through Job posted at USCIS website below:
"If you want to apply for a green card (permanent residence) based on the fact that you have a permanent employment opportunity in the United States, or if you are an employer that wants to sponsor someone for a green card based on permanent employment in the United States, you must go through the following processes"
We all know how permanent jobs are here :) It's just the way the immigration law has interpreted it.
His point was more in support to legal-Skilled immigrants that create value for US of A ;)

In Minnesota, the driver license is usually valid for 4 years. But for non-citizens (and GC holders) they print a red colored status check date. And the validity of the license is then until the validity of the visa. In most cases for those under retrogression it would be anual renewals of the driver permit and the validity date coinciding with the EAD validity.

05/26/2006: Critical Role of House-Senate Conference Committee and Importance of Selection of the Conferees
More than ever, in the Comprehensive Immigration Reform legislation, the role of the upcoming House-Senate Conference Committee will be critically important. Traditionally, once conference committee reaches an agreement, the floors of both Houses usually accepted the compromise report of the conference committee. It is thus critically important to learn who will be selected to the conference committee by each House. The key players in the selection are the Speaker of the House, the President of the Senate, Majority and Minority leaders in both Houses.
In the Senate, the floor has already decided how the conferees from the Senate will be selected. It proposes to send conferees at the ratio of 14 from the House and 12 from the Senate. On the Senate side, all the conferees will be selected from the Judiciary Committee at the ratio of 7 from the Republicans and 5 from the Democrats. On the Republican side, the Majority leader will select the seven Republican conferees and the Minority leader will select the five Democrat conferees. Without doubt, the Democrats will select the hardcore supporters of the CIR, but it is unclear who the Majority leader Bill Frist will pick on the Republican side. He may attempt to balance between the hardcore supporters and the hardcore opponents within the party. We just wish that the hardcore Republican opponents who posed a roadblock to the today's passage of the bill in the Senate as revealed in the amendment and final roll calls do not take a dominant power on the Republican side of the Senate delegaton. Readers may want to know who these opponents are by checking the voting records of S. 2611.

I got an update via CRIS
UPDATE: On August 5, 2008, we transferred this case to our NORFOLK, VA location for additional processing.
My current status: My case was filed as EB2 and the PD is Mar2006, so I am current for another 6 days (Oct 2006 is retrogressing to 2003).
I have talked to several of my friends and they said this update means an interview is in the works.
Do you guys agree?
If so, I had questions based on that. Me and my wife were planning to travel to India this December.
1) Will I still be getting an interview since my case is not going to be current starting OCT 2008?
2) In case we should expect an interview, should we wait till we finish the interview?
Any input would be appreciated.
-Raj

I agree with above posts.
I am EB2 with PD Nov 07, so I have a lot of wait to do. But I feel bad when I see people trying to stop EB3 to EB2 porting.
Where is the compassion? I believe we should concentrate fighting with outside forces rather within the group.

Please avoid all this sensationalism in your thread headers! You don't seem to know squat and are claiming something without any reference...the red dot/square seems appropriate...why I am replying to this!?
i'm just putting my opinion in my way. that's what this forum is for. atleast not talking BS, just staying on the main topic.
btw u answered for ur urself, i'll just repeat with a change "why are you replying to this!" go see a doctor, is my advise.

Let me preface this by stating that I have not yet shot with a D70, however I have heard very good things about it...particularly for it's price. IMHO, the best test of a camera is done in the field. By in "in the field", I mean does it allow you to do what you want it to do. A DSLR has a learning curve if you're coming from a P&S. Once you begin to master a DSLR, theimage quality bill be much better, and you also have much greater ability for creativity. If you want a D70, I'd take the info you've read regarding various issues with a grain of salt. Buy one from a reputable dealer that allows returns if it does'nt meet your expectations.
After deciding to buy the Nikon D70 I began to read a number of posts to the pReview forum that had D70 owners citing backfocusing problems with their new D70s. All resorted to sending their cameras to the Nikon Service Center for repair. All reported at least some measure of correction but some indicated they could not achieve precise focus within the DOF for each of the Nikon compatible lenses they owned and are useable with the D70.
I own two Sonys (the F707 and the V1). Both, in my view achieve remarkable clarity, color and brightness right out of the box. AF on both is, again in my view, is extraordinary. So, I would be very disappointed if I were to spend 1500 or more bucks (with some accessories) to arrive at inferior imagery.
It is possible what I am reading is the view of purists who are able to "see" focus flaws that the more casual, but still demanding, amateur photogs would dismiss?
Has anyone out there had experience with the backfocusing problem to which I refer?

Not sure if anyone experienced this, but on 2 computers this site, antivirus software detected a virus & my work PC (protected with McAfee) is not booting up, IT said my hard drive has been corrupted. My laptop survived with a freeware anti virus. Please don't give me any reds, this is what happened to me, I just wanted to warn any unprotected members of IV.

Does it make a difference ?
- If you go to Canada are you really going to be working ? You are going to go to Law School and get your degree in Law and becoming a Lawyer. So you go to Canada and study and 3+ years later become a Canadian citizen come right back in US on TN visa. Unless you don't want to abandon your Chinese citizenship.
- The July 2007 - 140 are showing signs of approval. So you get the 140 approval and then use AC21 to hang around the US and complete your Law degree in Boston. A few years later you get 485 approved and you are set in US. The complication comes is that you have a GC filed as EE and 485 might become questionable or maybe not (if you become a smart lawyer :) to defend your own)
So from the options that you stand today, if in next couple of months 140 is approved, ask your lawyer can you use AC21 and go to Law school or will there be complications. If not, stick around here.

You are a citizen of one of the countries listed below, and the worker on whose record your benefits are based lived in the U.S. for at least 10 years or earned at least 40 credits under the U.S. Social Security system.
Thats the confusing part
This seems to indicate someone else will get benefit payments but not the worker himself / herself.
This part refers to family benefits, i.e. payments to spouse based on your SS contributions.
Question: Why Canada is not in the list of countries?

Can we do something about this.
Maybe we can go to a federal court saying it is discriminatory and get a ruling to that effect. This would stop "any" state from coming up with such legislation.
Many states have such rules. We need to deal with at a national/federal level.
We have too many items to worry about. DL should not be one of those.
In this country one cannot work without a driver's license. It is a matter of human rights. When USCIS gives us work authorization that has only 4 months remaining on it, a state ( Texas ) cannot say that I am not eligible to drive in this 4 months.
There is some disconnect here.
Isn't it something similar that happened when Gandhiji was thrown out of a train is South Africa. Gandhi was discriminated based on his color. We are being discriminated on immigration status for our right to work.

Exempt from the H-1B cap; not the EB cap. See line 14 on page 2 of H.R. 5630 (http://frwebgate.access.gpo.gov/cgi-bin/getdoc.cgi?dbname=110_cong_bills&docid=f:h5630ih.txt.pdf).
Bummer!

Did I mention EB cap in my earlier post? I mentioned CAP which does not conclude that it is EB cap. I went through the bill too.
No offence to anyone. Of all the drama that was going on from Jan 2006 until now, I feel (+ve) that our issues(EB relief) will be taken into consideration only when they come to the topic of making the illegals into legal residents of this country. Any immigration debate in Congress cannot be taken up without considering the Illegal Issue.
We will see and will be surprised to see that an illegal will be granted a status independent of an employer and will also have the travel permit and he/she can live here forever renewing his status.

Thanks for contacting IV with your SOS.
An IV core member is going to be helping you to fix this with USCIS. Let us know if you need help. He already tried contacting you yesterday.
As IV grows maybe this is a help IV can extend to all its donor members and help them if they get in such extreme distress situations. This is one of the ideas we are thinking for our members in the donor group.
I appreciate your response even if the guy is not a donor. Great job.

I am in the same boat. I have asked my paralegal about it a few times and he seems reluctant. He said they don't normally do it. By law, are they not required to let us have the receipt? Like you, I do have the receipt numbers, but not the physical copy of the receipt. Like you, I currently have no intentions of quitting, but I would like to have a copy... just in case.
Well..I am sure there might be lot of people like us..is there anything we can do to control these pigs..??
I am sure there may be many people who now say,
who asked you to come to this country
who asked you join them..blah blah...
just because we get hired doesnt mean we allow them to abuse us
I think we should take some initiative to control them or alteast save people like us
