I guess when it comes to GC processing, NOTHING is really "wrong" is it? If you get a chance to work around and beat the long lines, I guess "It's all good". Some people are lucky that they get a chance to get Labor Sub, some ppl marry the GC and some ppl like the rest of us wait in line like "honest citizens".
The REAL question is, just how many of us would have refused a good labour sub, given the present conditions, solely on the basis that "it is unfair to others"? I know i would have taken it. Reason? It's LEGAL (or used to be). Our "misfortune" (if i can use that word), is that we did not get a similar chance.
For those wondering, what I am babbling about: "Let's not look down on this guy who got his GC approved by Labour Sub, or even continuously point out that he did."

The pdf file in your post indicates that you would qualify for in-state tuition if you have filed for GC. How does the university determine that you have filed for GC? After you have filed for labor or filed for 140 or only after filing of 485? Those 3 dates could be years apart and depending on how the university defines that you have filed for GC could determine the residency status. If you have any further information, please share.
They only accept filing of I-485. I submitted an appeal after I file I-485 before my son's status fo in-state tuition was approved.

I have a very good friend who is French. He live is Paris. He tells me his view is different than yours.
Beppenyc, could it be because France did not control the number of immigrants and ended up bringing more pople than what they should and made assimilation harder there ? Some believe that the US is heading to a path similar than the France one. Just look at the US. This is a country known for its immigration tradition. Look at what is happening now. Americans - unfortunately - are starting to become bitter towards immigration. Why ? It is because as everything in life, you need to have a balance. If you start letting too many people in, people may feel immigration becomes an invasion. Like France, this is a democracy. When you have the majority of your citizens pissed off at illegal immigration or even rate of legal immigration, honestly I would listen to the people otherwise the relationship between newcomers and citizens may look a rough road ahead.
Just to give you an idea, today I have a lunch with folks from my church - some are here illegally - and they acknowledged that there are too many Latinos in Orlando and therefore they do not want to live there anymore. Just to give you an idea how serious the situation is. Even the illegal folks themselves admit that an unbalanced number of immigrants may not be advantageous.
The problem in French is different. They bring the immigrants from Africa and North Africa to work to build the subway, La Defense (ask yourfriends),Eurostar ect ect. French has a controll of the number of immigrants, is not so difficult. The problem is that they put the immigrants living in the ghetto (Banlieu) and to not give any hope of future. When all the big project were done, they forced to sent the immigrants home, but without success. If you are really interest to see what is the reality in France, get this movie made in 1997, LA HAINE.

The US economy have an enormous advantage with the Illegal immigration, in particulary in Agricolture, they were more competitive in the international market. If you have 12 million of illegals, means that you have at least 6 million of American Citizen who give job to this people, making a HUGE PROFIT. Let`s analyze the restaurant business, how is possible that is cheaper to eat in USA than europe? The reason because here they can use a lot of illegal in the kitchen or as waitress. What about the house building? What about it? About the legal, the difference is that of course we are playing with the rules, but the reality is that we are in the same condition: we are slave, we can not look for another job because of the sponsorship and 4 have this green card we will wait for ever.That`s give an enormous advantage to the company, butis not fair, because the company is really exploit us. Guys,
Finally my problem and my questions are solved.
I drove up to the Canadian Border near Niagara Falls (Buffalo), they Canaidan Border Officials took my I-94. I took a drive in canada for 10 minutes. I even stopped at spot to view the Niagara Falls from Canadian side and drove back into US. I was issued a new I-94 with out any additional interogation.
What surprised me was my Canadian Visa expired on 09/01/2007 and i was still allowed to enter into Canada.
Anyways Thank you guys for all your responses.

Kindly send letters (preferably signed letters instead of emails) requesting them to kindly also include the EB category immigrants waiting in the line for a very long time. Kindly note that we as a community should help ourselves. Every attempt is worth the effort. If we do not write they will not even think of us. If 10,000 letters reach them, atleast they will discuss our case. Hope all our friends will cooperate and send simple one page letters to all members without any delay. THis is a GOLDEN OPPORTUNITY and all the members in the committee are Republicans.
In my experience, it is best to meet with these offices personally first and then start the letter campaign (if IV approves it). Merely sending the letters does not provide the chance to know if the letters were read, or if the office understands the problem we are talking about or if they have any questions........
Please meeting with these lawmaker offices a priority....

I had the exact same RFE. I'm on H1 since 1998, and you can imagine how many times I have left and entered USA. I have about 8 H1B extensions. Here's what I sent...
1). Cover Letter stating list of document to show evidence of law ful status in US.
2). I-94 card issued by CBP at the last port of entry.
3). ALL the H1B extension notices issued by USCIS. Its important that there are no gaps in dates on the extension/change of status notices.
4). passport copy containing all US visas and entry and exit stamps.
5). A document explaining the entry and exit dates matching the stamps in the passport.
6). Few pay stubs from the current H1B/green card employer that you are currently working.
7). Few W-2s for last few years.
Usually the I-94 that is on the extension of stay issued by USCIS is the same number thats issued by CBP at the Port of Entry. So, USCIS should be able to match the entry and exit information and extension of stay notices
I'm sure they know that one surrenders the white I-94 card when they leave US.

I had been in and out of US many times and there's lot if I-94's involved and I don't anything with me except the latest. What options do I have?... Also couple of times during my earlier trip (initial visits in US), the AIR Line didn't even take the I-94 from my Passport which ultimately I lost.
My Passport has all the entries indicating my Date in and Date out...
Gurus - What do you advise on my case...
Anybody's input are highly appreciated and I know we could somehow get the I-94 copies by requesting USCIS. (That is time consuming)... I have to respond in next five to ten days...
