I am very much surprise that media also overlooked the injustice to the Employment Based Immigration.
I just don't understand one basic question.
Congress is trying to pardon 12 million illegals as a one time measure and give them Green Cards. (OK - Very good)
On the other hand we are about half a million who entered the country legally and helping the U.S. economy and paying taxes. Why don't they consider giving all of us Green Cards as a one time measure too ?????

My wife and daughter planning to go to India next month. They do not have H4 stamping but H4 validity is there up to next year. Plan is to come back after receiving AP. I am thinking that once their AP is approved I will send their AP to India, and they will come back using that AP. Experts, do you see any problem in this. Please share your thoughts.

Thomachan 72, if you have already submitted a non avialability birth certificate, if you submit a birth certificate then will the immigartion not question as to how do you have a birth certificate now.

Having 3 years EAD/AP and ability to refile AOS (in the worst case) is the best workable solution to an economic turndown and lay-off. Having a recapture done will also help many
IV already has this as part of the letters campaign. Everyone worried about recession, lay-off etc. must support IV campaign with full vigor.

I got my EAD today...Even i received my Wife EAD also...Mine is sent to NSC on july 2nd...I received EAD's from Texas Center...I think my application was transferred to Texas...I have approved I-140 from Texas...Are receipt numbers for EAD, 485, AP are in serial? I haven't received receipts yet...I filled G-28...my attorney did not receive my receipts...I don't know what is going on...

There is no such thing as a cooperative employer in this economy. I will give you an example....
While I do agree with some points on how difficult it might be given the economic environment, we do not know OPs employer or OP himself to make a broad generalization. For all that we know, OP might have 10+ years of domain specific knowledge that might make him really valuable to his employer or he might be working for a desi consultant who is happily taking 60% of his biling rate making him very lucrative to his employer. That's why I used the word "cooperative" to refer to the type of employer.
While no doubt, getting PERM approved is difficult at this time, it's not impossible (I have a few close friends who got them approved recently in EB2 though they had to wait a long time for it) and giving it a shot is well worth it if things work out in OPs favor.
PS: And God knows why I got reds for my previous post. Funny!

Great topic. wating one more year would mean 12 more months of rent. so even if the house depreciates it would break even considering the lost rent. This is just my opinion assuming that the depreciation would be less than 5-10% till next summer. I had the same problem with my desi employer about a couple of years ago. Tell him that you are going to call the IRS if he does not correct the W2. then go ahead and call the IRS. they will send him a letter, most often than not it should take care of things, otherwise the IRS will investigate the employer.

Also, If they have really mentioned INS, I bet they don't even know what AOS or pending I-485 is, because agency INS is no longer there but your wife's international office officials mind is still stuck in 2002.
I need urgent advice from you. As you know my wife is on F1 visa and completed most of her credit hours needed by school. She has get only 1 credit hr to complete the course. However, that�s below 9 hr full time student status. She has been asked to register for additional 8 hrs..and pay tuition fee accordingly ( > 8K). Which I think is unreasonable. They told her that if she doesn�t register by tomorrow they have to report it to INS. She told them that she has EAD..there answer doesn�t matter in order to remain in school and F1 visa she has to register.
My questions is:
1) Can she continue working on her Thesis on her EAD and AP ?
2) What will happen to her f1 if she use EAD
In response to these questions my Lawyer said
1.) yes, she can continue to be a student as an adjustment applicant � she can work using the EAD and travel using the AP.
2) she is basically no longer an F-1 because she has demonstrated immigrant intent by filing the adjustment. Which is fine � she has valid legal status as an adjustment applicant and can work with the EAD and travel with the AP.
What do pro�s think..:)

You need to have your old I-140 approved to port PD to your new I-140. If the old 140 is not approved by the time you file you new 140...thats fine. At a later stage when your old 140 gets approved have your lawyer send a letter to the processing center with PD porting request for the new one. At that time your new 140 can be in processing stage.

Do we need original I-485 receipt to file EAD/AP? Also do we need original receipt while going outside of US. I have scanned copies of my receipt notices. If absolutely required then I'll ask my attorney to send me the original receipts.

I spoke to our immigration lawyer today.
He said that entering on h1 while I have a pending 485 does not affect the 485 in anyway.
He advised that I enter on h1 even if I have the AP.
you can enter on H1. There is no issue with it.

You dont have to pay any taxes for tranfering money. It looks like you are supporting your parents by transfering your savings to their account.
Since the account is in your parents name and i am guessing you are not a jt holder since that is illegal in india. A NRI and indian resident cannot be joint holders of an account.
If you were transferring it to your nre or nro account in India then you are supposed to report the account information using FBIR form( if sum of amount in all acounts > $10K) and pay taxes in US on the interest earned in those accounts.
I was not doing it initially but for past 5 years i have been paying taxes and past three years reporting all my accounts to IRS.
Hope this helps.

The Doctor admitted his mistake.
He completely forgot to mark the TB test earlier.
He was ready to back date to avoid more inconveniance to me.
But I told him to be sincere in all aspects.
I basically forced him to give my wife a TB test again and also the x-ray.
Now the plan is to submit all this information with a nice letter which states that the doctor had forgotten things last time etc etc.
Hopefully they will mark the case as - resume processing.
I also had some issues with my medical exam. Lesson learned is to have civil surgeon verify and double verify
the information entered in the exam.
