Most of the people are predicting that it will move a couple of months. If they are thinking for long time means they might have more visas ( Thinking of how to utilize the available visa numbers is good for forward movement)

Who gets FP notice? is it attorney or us?
We also filed on July 2nd at NSC.. got EAD and AP. buit no sign of FP yet. we were also out of country for last 3- 4 weeks. Is there chance we could have missed it?

I think it was Collin Powell that help passed the 7th year extension and one year extensions there on if LC is pending for a year..this was passed since there was a crisis with delay in LC adjudications....so we are at a point that we need such a relief soon...we are heading towards such a crisis point..soon...EB releif should happen soon...I think this was a single issue that was handled and relief provided and EB matters should be handled in a piece meal manner....(I may be wrong may be it was a part of AC21)...also oppenents are saying why piece meal handle when CIR is in place to delay any kind of a relief..
Some of us here are under the grand illusion that
(a) the lawmakes consider relief for skilled immigrants in isolation to be an important enough issue that they will make it a priority
(b) Relief for EB immigrants is totally non-controversial and everybody and his brother will back us.
Both assumptions are dead wrong. If 900 of the biggest companies and universities in america cannot convince congress to make SKIL bill a priority, then you know what a formidable challenge lies ahead of us.
As for EB relief being non-controvesial, I only need give one counter-example : S 1932.
We are all desperate for any relief : I repeat ANY. To think that the core team would be so shortsighted as to only pursue grandiose bills like CIR and not be on the look out for smaller relief measures is naive and severely underestimating their intelligence.

Okay. I was able to talk to my attorney just a few minutes ago. He said, to do interfiling , you do not need to have PD current based on new I-140 as this is just a case update with new 140 information. He said that in any case, your 485 will be picked based on PD. I found him very very confident when he was telling me all this info to me.

You can file as many I-140's in any category (EB2/EB3/NIW) as long as you have a certified labor for a bona fide position with a matching education and company has ability to pay for those positions. These I-140's can come from one company or different ones it doesn't matter.
In your current situation:
1. Don't even think about doing anything with pending I-140 and AOS. There is a definite delay in I-140 approvals at both NSC/TSC so waiting is the best thing to do. As long as your qualification matches the LC description you will get your I-140 approved. If your I-140 is pending 30 days past the processing time and you haven't received an RFE, it might have been stuck in security check. Your lawyer needs to open a service request to find out what is going on.
2. For the labor that is expiring in Jan, go ahead and file an I-140 petition right now, there is nothing to worry about two I-140. If nothing else this petition can be used for 3 year H1B extension in case the first one gets stuck.
3. The second I-140 that you are filing can't be used for your pending AOS if your priority date is not current. Check the Pearson Interfiling memo ( from link below). If your priority dates are current and will remain current (EB2 ROW) file for an new AOS application when your second I-140 gets approved. If by this time your first I-140 is approved you can simply toss the second I-140 in the office shredder.

Greencard and H-1B expenses should be paid by the employer. Anything else is illegal. I am requesting admins to close this thread.

Only my opinion, Janey, but since you are moving up I wud be looking to the future. Meaning, the D70 will be a great camera for you and then you'll be eventually experimenting and wanting different/better lenses.
Canon offers IMHO far more superior lenses and more choices.
The 300D or the 10D both Canon, would be my choice.
Ok, in defense of Nikon, how are Canon's lenses "far superior"? Yes, they have IS (VR) in long teles, and their wide T/S lens has a bit more flexibility. But say Janey wants to do some extreme macro photography? Yeah, Canon has the MP-E 65mm that goes from 1x to 5x, but it's expensive, and for the same cost (or less) one might be able to get a PB-6, enlarger lens, movie camera lens, 50mm lens, and various accessories to link them all together, and in the end have a much more flexible macro system.

also since its a govt organization, my LC juz said 4 years bachelors or equivalent. i do have a Masters from an US state university. so not sure what could be the RFE.. ability of pay is not an issue i guess, cos its govt. what other rfe's are there?

This is something that's doable without legislation. It would be done for employment based visas.
