Now that the SEP VB is out, what does this indicate in terms of
- future VBs
- visa availability in the coming months
- awareness about visa wastage
- dates becoming current for most EB categories

USCIS efficiencies :D : They are not efficient. People with PD in 2002,2003,2004 are still waiting and that are in 2006 getting released. Where is FIFO and efficiency in their process? No transparency in their process.

Alisa has a good point, is there a list of important items that we can present to lawmakers.
I belong to my state chapter, I am all for meeting whoever to make an impact but it would be great if we can put together good talking points and issues to highlight when we meet these lawmakers.

C'mon dude, i wouldn't use the word "get lost" for someone who has kept cool and putting up thoughts without using extreme/harsg words. even if you suspect the person could be from anti-immigrant group, I don't think it's appropriate to sentence someone based on suspicion.

Posts like yours are welcome, they help us remember that there could be fraud happening around you and you gotta be careful. But in case you are not immigrant and the news made you believe that the %age of such fraud people among legal immigrants is significant then let me assure you that it is not, in fact work-visa community is at the top of the list of cleanest/noble communities. Their contribution to national prosperity and keeping America is # 1 is among the highest. In a way they are the soldiers with keyboards in their hands, fighting for America.
You are more than welcome to express your thoughts as long as they are in line with the goal/mission of this site.

Sorry to hear about your case. Immediately call your Congressman's/Senator's immigration wing. They will help you. If not, try to call attorneys like Rajiv Khanna or Sheila Murthy or Shutterman. They will charge you for the call, but you may get some valuable ideas.

If your current/future job is eligible for EB-2, you have the qualifications to meet the job requirement and your employer is willing to start EB-2 process, I would get the process started as soon as possible. With your current EB-3 PD, I dont see anything changing in the next 1 to 2 months. You might as well start it now so you can complete the PERM documentation and advertising phase and file PERM in 2-3 months duration instead of waiting. Thats my 2 cents.

I received RFE on my 140 on nov 15th. I came to know about this when i checked the status online. It says on Nov 15th we mailed you a notice requesting further evidence . I-140 Receipt date is dec 11 2006. I do not yet know what the RFE is about. How many days does it take for the RFE to arrive normally ??
As USCIS sends out the RFE in regular mail, it takes about 4/5 business days to get it in hand. The lawyer and employer will add their buffer if they are busy or if the RFE is related to the employer, etc. The reason being once you know about the RFE you would get on top of them to send a response. They will use this opportunity to make bottom line money.
One good thing that USCIS had done is put time constraints on the RFE's (Though I don’t support this 100% as there are drawbacks). In earlier days the employer used to send response after 3/4 months so that they could delay the case as long as they can to have you tied down.
As I-140 is an employer's document, you might not have much say in this case. I suggest you to take it easy and watch out carefully in your benefit. Obtain a copy of the RFE before you do anything as there are lots of professional fraud lawyers out there who will do anything to make money.

I had my I140 approved too and had mentioned it in my application. They dont bother you. They however gave me 221g to verify student status and delayed my visa for two weeks. Interview was less than 2 mins and the vo said she had to verify student status thats it.

I am in the same boat, my LC and I-140 both approved . But employer not ready to share the copy of I-140. Is there any way to get the copy I-140.

You usually get a SS statement in mail after you have filed your taxes. If you don't, then there is a way to request the statement from www.ssa.gov.

We checked the records and find that since September 2006 (date of your joining) contribution has been in April 2009 for $25 as a one time contribution. After that there have been no contribution. Due to a one time $25, you had donor status for a month. We had given you donor status and access for more than a month until 19 July 2009 for you to renew your subscription. If you have contributed recently, contact us with the details.

No. You do not pay double Taxes.
US & Canada have a tax treaty. Nearly always Canadian Income Tax is higher than US, so you pay US taxes first and then when you file Canadian taxes you get credit for the amount of US Taxes you paid.
so ex you make 70 K and your US Taxes come to 20 K , you go ahead and pay 20K. Then when you file Canadian taxes, your tax amt comes out to be say 25 K You will then only pay Canada Revenue 5 K difference.
Only complication is Canada doesnt recognise US 401K contribution or mortgage as tax deductable, so you will have to calc Canadian taxes on gross income.

Interfile means 'amending the existing application'.
When you file a new I-140 application , you may also ask to recapture the old PD from your earlier approved I-140. This is interfiling. The new and old I-140 can be from the same or different employers.
After getting a new I-140 with old(recaptured) PD, you can ask to amend your existing I-1485 application to be upgraded from Eb3 to Eb2.
