Great to see that things are moving in DC at just the right time.
Also note to all the readers. I hope people realize that all the folks who are in DC right now (from Florida, NJ and other places) have
1) Paid for their trip at their personal expense
2) Are staying at hotels at their personal expense
3) Taken days off from work at personal expense
4) Paid for Rental Car/meals at personal expense
We are running short of funds and there is only so much the core volunteers can contribute (monetarily as well as timewise). Each of us have an equal stake in the outcome of what we are trying. Please consider contributing to Immigration Voice. If you have already contributed once, we urge you to please do so again. Also try and rope in your friends who are in the same boat.

1. you can files your I485 and later add your spouse if the dates are current or you have the priority date.
2.You can apply for EAD during I485 and at the same time can be on H1 unless you don't change an employer using EAD.
3.Unless you add your spouse to I485 process..you have to maintain your H1 status as your spouse will be on H4.
4.BY any chance your I485 is approved before adding your spouse(present in US)..you have 180days to apply for your spouse.
5.If your I485 is approved when your spouse in outsite USA..then you have to go for consular processing.
6. No one exactly knows if the PD will remain same or not.
So anyone about to marry or planning to get married,talk to your attornies about your situation and take a decision.

I know people are saying that visa numbers may not be availabe in Sep, but if all PD are current till June 2007, and if my wife will get my PD, what difference does it make if she files in Aug or Dec 2007. What will happen in Dec that will not let her file I-485. I am meeting my attorney next week, but with the pathetic interview scheduling system, it would be good to know so I can get an earlier date for her.

How do you guys get to track the status online, do you get the receipt and then track it online.

The visa in my passport expired 4/2006.
Currently I am on my 7th year (which I do not have stamp for since I did not leave the country in a while) which ends 4/2007.
I just applied for my 3 year extension (8th, 9th 10th) which I hope to get approved in Feb before I leave.

The LAWSUIT has immense WINNING POTENTIAL.... Instead of losing in court of law and make that a NEWS in major mainstream media GOVT agencies wrap up mistakes in this way. This method works everywhere , so that the noise level remains low.
As the lawsuit progress they may offer Financial compensation ... anything can happen if you can Prove that you have been beaten financially for a wrong announcement... I mean if you can show receipts between June 13th and June 30th and that document is a requisite in 485 application anyone can claim compensation ...

The approval of h1 will not invalidate H4 visa. The usage of h1 visa invalidates H4 visa.
if you have h1 approved and don't join the company, then your h4 remains intact. Once you join a company on h1, you will fill out i-9 form, which informs the concerend authorities about your status change.
That's what I meant . Since he started usinlg the H1 his H4 visa was no longer valid . Doesn't that mean that if he goes back he will have to get some kind of visa stamped to come back ( either H4 or H1 ). Could someone throw more light on this situation.

It is 7 years for sure.
I think its more than 3 since I got a notice about my 2003 state taxes in 2007 which they said they never received and I got stuck with a penalty ( although I was getting a refund ). I paid the penalty since it would have been too much of a hassle to go through 2003 records and then duelling it out with the IRS.

Its is not true. You don't need to send photos for EAD and the instruction clearley says that. For AP you need to send photos even thnough you went for biometric appointment.
If you apply both EAD and AP together then you will still need to go to fingerprint and also send photos for AP.

I played around with the 14n at Adorama. Also I have been at DPR Kodak forum gathering user experiences. For its price, its a great camera for its targeted purpose.
There are two problems for me. There can be major magenta fringing at back-lighting and low light conditions (What will happen for shooting one hour before sun rise and after sun set?). You must shoot raw and do significant digital dark room work.
Complaint: Even the D70 has spot metering, 1/500 x-synch, 30 - 1 / 8000. Cmon, Canon, at least put the d*mn spot-metering on the 10D-II (if not 12mp, FF, ... for $999.00)

Look at tv25's post. He/She alreday used the H1B...tv25 mentioned that she/he worked on H1B for three months. That would have invalidated her h4 visa.
tv25 shouldn't have entered using H4 visa that got invalidated as soon as the H1B was used.
This is a serious issue and as all others are saying, tv25 needs to contact an expert immigration lawyer.

I think we need to clarify that Reid and Pelosi are independent and not related in terms of setting up a debate. Pelosi is in the Lower Chamber - House of Representatives, Reid is in the upper chamber - the Senate. They do not have influnce over each other in terms of scheduling and the rules, etc. Pelosi is the speaker of the House, Reid is the Majority leader in the Senate (there is no speaker in the Senate). In the Senate Reid is the one who calls the shots in terms of scheduling, but it has to be on a bill proposed in the Senate (not the one propsed in the house), although the texts could be identical it is still a separate bill with a separate number. Based on the rules such bill may have to go through a comitee first (Judiciary perhaps). As for the House I believe Pelosi has lot of say when it comes to the agenda. Background : EB2 India PERM applied in Oct'08.PERM RFE Audit notice received on Apr '09 and replied immediately by the lawyer. Currently as per iCert labor website Audit cases being processed as of 07/31/2010 are PD July 2008. My H1B six year completes on Jan 2012.
Question :
- When do I realistically expect any decision on my PERM audit?
- Should I apply for fresh PERM Labor in order to meet the 365 days prior labor applied rule for H1 extensions or should I wait for the audit to be decided? My spouse has EB2-I PD OCT '07 with 140 approved ..waiting to file 485.
- In case I decide to wait,what will be my status if the pending PERM currently under audit filed gets denied? What are my options for further H1 extensions in that situation?
- If advised,when should I plan to file my fresh PERM labor? Given that a RIF took place at my employer at end of May 2010, per my understanding there is a six month wait period after RIF to file for PERM labor. Hence, can I file PERM earliest by the end of Nov, 2010.Am I correct? Will I meet Jan 2011 deadline o file fresh PERM?
-What are your overall suggestions in my case?

I have applied for Advanced parole at the end of July 2007. My H1B visa is expired, but my H1B petition is still valid. Should I just take the risk of traveling and try to get H1B visa renewed to re-enter ?
OR should I just keep waiting for Advanced Parole to be approved ? I can wait until end of November 2007. But I am not sure whether I should plan to travel in Dec 2007 or not. I dont know how long its going to take to get the approved AP.
Any thoughts ?? Do any of the July filers who have filed for AP know what time frame should we expect for approval of I-131 (AP) ?
