I surely may have missed something here. Has been a bill placed already that will allow us to file 485 and get EAD?
Sorry, I am really having tough time coming to IV these days.
Its law the day when it is signed by the president unless there is clause in the bill to postpone the impelmentation.

Guys, I wanted to circle back and update you on the results. My I140 was approved today and this is what i had submitted as alternate evidence. Hope someone else will benefit from the details I am putting here.
Thanks to you all who took time to reply and assist me on this issue.
Documents submitted:
> Experience letter non-availability as an affidavit mentioning that we tried but previous employer did not provide the letter.
> Email trail of communication with ex-employer detailing communication asking for exp. letter.
> 2 affidavits from previous co-workers detailing job responsibilities, skills, dates employed together.
> For 63 months of last employer experience, paystubs, W2's, Indian Form 16's, Indian IT returns, yearly appraisal letters, other evidence related to employment(not all but whatever was available).
RFE was :

That article is a joke and more like propaganda. It says around 58K H1Bs are issued and most of them are extension - but are they not aware the extensions are not counted towards the cap...?

This is interesting information. This is the first time ever that such news has come out of Indian press. You may belittle it by calling it a joke but to me it is critical because this issue may turn into a trade issue. Call for negotiating a comprehensive services agreement is not mundane. Together with rejection of billions of dollars worth Us defense deal, this is seriously moving towards becoming a significant issue. You may want to dot the is and cross the ts but that is not how the Law makers, Senators US or Indians think about these issues. They are at 30K feet level looking at the Forest while we waste time in just going around our own trees.
To me the intent is more important than the content in the early stages. We will get to details once there is broad agreement on the issue, that is basic negotiation 101.

I wanted to know if any one's online status changed after FP is completed.
I had an LUD on my record after my lawyer sent the clarification to USCIS. But the status remains the same as ".... Case in suspense". Did any one's status came to Pending or a less ominous one?

3) I can work with any US employer. And, I can obtain competitive salary.
4) I can travel to other countries without hassles of visiting US consulates and visa stamps.
To show my gratitude, I am sending copy of all my legal papers.
As soon as this bill becomes law, I will send you original of all these documents as I wont need them anymore.

Been with Ron Gotcher for over 5 years now. Never ever had a problem. The best thing is you can talk to him or his son anytime regarding any immigration issues. I had lots of H1 issues with my current employer and he was gracious enough to talk to my employer several times and help them out without charging me a penny. I would highly recommend him.

Hi,
If you have used the H1 approval to go out of the country and get the visa stamped and then come back in, the white I-94 given at the airport supersedes the one in the H1 approval. That is the core issue.
Regarding an earlier question, you can contact any local "international" airport - in my case, my port of entry was Detroit, but I got the correction done in Cleveland.

Never left the country fo far.
She came on H4 and at that time her I-94 was till Apr/2005.
She got H1 in 2004 with new I-94 till May/2007.
Got her H1 extension( with new I-94 dates.)
The I-94 she got at the port of entry expired but her employer told her it is not a problem as her H1 has a I-94 with new dates.
I know in your cases(s) you have passport expiry thing. But I guess it's still the same right. I gues your H1 will have new I-94 in it .So what is the descrepency?

I was just thinking, the wastage of visa numbers we see, is that basically due to the per country quota. The rule that no country can have more than X% of GC's in a year, would mean that even though there are visa's available, they cannot be alloted due to that per country limit.

I agree with Bob here, as I've shot with both Nikon D1's and F5's from back in the day, to the latest stuff. I've done the same with Canon through the 90's and the current crop.
I feel like Canon has the upper hand on Nikon currently in both bodies and lenses.
Bob did label his opinion, most likely without thinking about it -- with the IMHO, to avoid attacks as such. Everyone is entitled to their opinions and none of us can 100% say that Canon lenses are better than Nikons.. No one here does bench tests, price comparisions, etc.. It's just field use and preference that determines this.
Back into your corner's fighters! Let's argue about sports or hot women before we waste our time on the merits of macro lenses!
Back to the topic at hand.. I think the Nikon is probably her best bet because of the build quality and apparently the kit lens is pretty damn good. You can pick up the D70 w/o the kit lens for $999 MSRP, which is only $100 over MSRP the 300D. So maybe the first question is, decide if either kit lens is fine for you. Then determine the build quality, and lastly determine which lens system you might want to grow into.
I don't think you can make a bad decision either brand you go with. We can all be happy with that. Competition is good.

I am also in same situation. Two 140s (eb2 and 3) both have same PD. Have beed trying for interfile from last one year. I do not know if my case is eb2 or still in eb3. I enquired from Congressman and she told me that my case is assigned to a IO on 6th Aug so its in eb2. She is not listening to anything else after telling me this information. I have infopass on 2nd Sep. lets see ...

No one is going to raise the GC backlog issue. Is there a way by which the we can also ensure that companies also stress on reducing the backlogs in EB categories and re-capturing past immigrants visa as a interim relief as they lobbied for increasing H1-B caps

Yeah i did have a I-94 with my H1 Renewal. But when i got my vis stamped in Canada recently, my original I-94 was take and i was issued a new I-94(white Card) at the border post. And the new was issued up until my passport expiration date.

Take your company attorney & HR guy(al) out for a $250 lunch and first build a rapport with them. Tell them about what you need & do tell them politely that if they care about you as an employee, they need to get on with your immigration process.
Nothing unethical, illegal or embarrassing about push your point forward.
There are ppl who will tell you that sth like this would never work. time ot prove me wrong!
Its your future. Take charge.
Haha. That is an accurate assessment at a 50-foot level. I was pretty disillusioned after a couple of years of working. A mixture of what the fuck am I doing, but not really knowing what to do, and all confused because I was at probably the biggest firm around and and a feeling of even if I switch, what's the point? And not having the balls to switch jobs, for the fear of throwing away what I had, mixed with personal struggles with life and not having the social life that I wanted.
In between all this, the desire to get the GC process kicked off came and went, esp. since I wanted to switch positions to a more people oriented role, and the feeling of gosh, do I want to stay in 6+ years in this job - maybe if I file, then I won't want to change jobs.
As you can see, even I am not sure what was going on there. But my personal life and acclimatizing has sorted itself out rather well of late, and I do want to stay here now that I have a really interesting life (and partly out of fear of throwing everything away and moving somewhere new).
Now, I know that IV is not a self-help trauma group, so I will cut short my story here, which has little to do with the raw facts of my immigration situation :)
And yes, I did not participate or know much about the visa process, or IV till recently, and am a recent need based participant, but I hope that does not stop anyone from contributing their ideas to help me out.
*** Also, to the previous poster (nojoke) who said that big companies usually hold off on perms, are you suggesting that I have a better chance at a smaller company then?
UPDATE: My company attorney suggested talking about this in April, and I am nervous about waiting till then in limbo - things are only going bad to worse, I might as well find a job at a place which will sponsor a PERM sooner rather than later.
I request you to PM me if you have any leads for such companies might still be a good bet for filing a PERM.
