    Thanks for the perspectives.

Yeah, it's just been a day since I got this news so I am still processing it, talking to friends and colleagues.

I am going to look around for people who are going to file.

Thanks for the advice about taking a lead on things, and also pushing my manager to file it.
And it is true that they are planning more layoffs over the next few months, so I am in the soup if things stay this way. All good ideas, which I am willing to experiment with.

I am also looking at this as a golden opportunity to do something that I wouldn't have done if my GC process was going on - like move somewhere else to a smaller firm or change my job title a bit.

Or travel to Canada or Australia and work/live there for a bit, explore the world, and come back later.

Friends I think a great injustice is being done to NSC filers , their applications are taking months for ead and ap, while TSC filers are getting ead adn AP as soon as they get receipt, do you think this will improve for NSC in future, at this time looks like august NSC filers will haveto wait till the end of the year for EAD,ap, which is sad.

Agree with you. It is sad.

He will be out of status. Your 3 year extension beyond the allowed 6 years is based on that LC/I-140 from which your I-485 was filed. If the I-485 is rejected you have no right to stay beyond 6 years.

It is best to not use more than 3 years of H-1 if you have a pending I-485. That way you have 3 more years of H-1 in case you get rejected. The pending I-485 gives you unlimited time in the form of EAD/AP. Dont waste your H-1 time.

It only makes sense to keep H-1 while you have AOS if your country of chargeability is ROW, which is usually current. If your country is backlogged, it will most likely extend your H-1 over six years. Please consult a proper immigration attorney before you do anything.

That's not true, as per my attorney. When you are on the 7th yr of your H1 the only reason for the you get the 3 year extention on the H1 based on your approved I140 after filing your 485, is so that you won't be out of status even if your 485 gets rejected. You can still stay is status in US and appeal your 485.

all that stuff comes in at I-140 stage. During PERM/LC they dont care about his qualifications, its the job that is being certified.

See the audit questions again, all relate to justifications that the requirements are really needed for the job advertised. ie. when the job ad said MS+2 Years is needed, DOL wants to know why this job requires MS+2 Years of experience. His lawyer is right, a more conservative approach to job requirements (MS+0 or BS+5 for EB2 is much more easier to defend). As you increase the minimum job requirements, it reduces the pool of available candidates who can apply for the job. DOL wants to make sure the minimum requirements are really valid, and not set artificially high simply to reduce the pool of candidates.

Basically your LC sponsor needs to be able to justify all requirements posted for the job (education, experience, specific skills) else you can be in trouble.

Yes audit questions seem to be hinting screw up from employer side but then also it can not be judged exactly on the same line without going into detail of provided job classification, job requirement and furnished docs from employee. Now all of the areas you mentioned are crucial from employer side and in addition to that "employee's degree" evaluation is also done at labor stage,(PERM or OLD LC). Please see following link.

    http://www.usabal.com/permres/PERM_Overview.html

Now logically screw up can occur at one of the two or both segments. "Employee side related docs and process" and "Employer side docs and process". I was kind of trying to know whether poster might not have screwed up anything from his side. You covered the areas "from employer side" - whether it may be business necessity and/or recruitment results. Now if employee's docs have conflict with any of "business necessity" for an example evaluation cert depicts MS (Electrical Engineering) and "business necessity" is to hire "MS (Computer science) then also it could create the problem. In such case employer/lawyer if can establish that MS (Electrical) can also that job then matter is finished..

There were about 600,000 AOS applications including the July and August filers. So that number less 60,000...roughly about 540,000 applications still pending with USCIS....

I am not sure how effective these new laws are. I recently renewed my Texas DL after expiry...I renewed it online...expecting for them to ask me for visa documents...instead I got the new DL in mail a few days later.

Maybe the databases are connected somehow & they verified my immigration details....but I very much doubt it. Sometimes you wonder why its so easy to be an illegal immigrant in the US.

However I did notice (in a city nearby in the same state - not the one I live in) that when you go in person, they ask for visa details.

I think immigration voice should ensure that concurrent filing of I-140 and I-485 is removed.

And why exactly should ImmigrationVoice do that?? Concurrent filing is HIGHLY beneficial to most people here!

Thats great! Congrats!! :) Are they charging $350 just for initial checkup or with shots, x-ray??

360 for initial checkup - without xray and shots

1 shot is around 60-90.00 depending on shots.
    x-ray - 80.00

Do they seek some sort of public opinion? If yes, Is that open to non U S citizens? Is there some kind of voting involved? We can touch base with UTD Student Associations so that they can forward it to their alumni who are still in that area.

He doesn't have much credibility even in republicans. he talks filth and spews venom. It is better to be safe than sorry with these talk show hosts.

i do agree with gcsucks that he is pro indian, i have heard him defend migration from india when a caller called him to complain about the H1B program. but he sure is moody, cause if we catch him on the wrong day then the responce can be unpredictable.

once he did a show on why indian kids end up winning spelling bee, and it was an interesting analysis of our culture and our dedication towards education. but his primary concern was that someday it will sure happen that indians will start dominating the american lifestyle and policy.

The point is that to lobby for keeping the spouse out of the "VISA NUMBERS CURRENT" constrain may not be politically hot as it becomes a very compulsive and humanitarian issue. There is expected to be less resistance and public support as its a family issue. Success may be relatively easy and hence its a ponderable issue.)

Exactly. I believe lobbying for legislation such that spouses can be added even when PD is not current as long as the primary applicant's AOS is pending is quite reasonable, and may not invite that much scrutiny or opposition compared to the larger and thorny issue of actually excluding dependents from the visa number cap. I know that the two are essentially related under current legislation, but if we (IV) can decouple them it would be a major success for us.
As Jitamitra mentioned, this was not a huge issue earlier because movement of PDs was relatively predictable.

Another option would be to lobby for a provision where the primary applicant's EAD benefits could be transferred to the dependents as well.

    Hi friends,

Can we start working for the new company immediately once the transfer petition is mailed i.e. without waiting for the EAC number ?

    NO.

Mailed is not equal to received or applied for transfer. Until you have proof that USCIS has received your application, dont start at the new employer. Waiting for the receipt # is the safe route down the road even though you have to delay by a week or so.

Well it seems the idea to get a Stimulus for 2008 for people having spouses with ITIN is nearing dead end (no action). Now the government is planning another stimulus. I think we should work on taking the necessary steps to prevent the same happening this year (being dropped out). I think we should raise awareness and write to all people including President Obama.

I wrote about our retrogression problem to our senator Barack Obama three months ago and I got reply from him today.I couldn't find the answer to my question. Can you help? Here is his response:

Thank you for writing me regarding immigration policy. I have heard from constituents on both sides of this issue, all making passionate arguments. This is unquestionably a complicated policy challenge with far reaching ramifications across society.

After much study and discussion, I have concluded that the best course is to pass comprehensive reform that reaffirms the rule of law and brings the undocumented population out of hiding through an earned path to citizenship. In my view, the approach presented by the immigration bill passed last year by the Senate lays the foundation for such a permanent solution.

To address the immigration problems in our country, that bill put forth a three-pronged response: 1) it strengthens border security; 2) it establishes a path to citizenship that included fines, a requirement to learn English, and adherence to the rule of law for immigrants and their families who may have entered the United States illegally but are now contributing and responsible members of society; and 3) it creates a "guest worker" program whereby American businesses can temporarily recruit foreign workers for jobs that American workers cannot or refuse to fill. This proposal passed the Senate by a 62 to 36 bipartisan vote, but a joint House/Senate conference committee appointed to reconcile the differences between this bill and a separate version passed by the House of Representatives (H.R. 4437) was unable to complete its negotiations before Congress adjourned.

Like our nation's religious and civil rights communities, I opposed enforcement-only approaches like H.R. 4437. That House bill is also opposed by the U.S. Chamber of Commerce, the AFL-CIO, the U.S. Conference of Catholic Bishops and over 200 other faith-based, business, labor, religious, local governments, civil rights, and ethnic groups. The common denominator of this opposition is that the bill would have had a profoundly negative impact on workers, on businesses, on families, and on local communities without making the country safer or fixing any part of the broken immigration system.

The President and Congress should look at immigration reform in a comprehensive manner to guarantee both that enforcement and border security are enhanced and that all workers, including immigrant and “guest” workers, are treated fairly and are afforded basic labor protections. This approach will curtail the flow of illegal immigrants into the country, reward work and unite families. I look forward to continuing to work with President Bush, my colleagues in Congress, and the people of Illinois on this important challenge.

Again, thank you for contacting me. Please stay in touch on this or any other issue of concern.

    Sincerely,

    Barack Obama
    United States Senator
