For the August visa bulletin, USCIS gave all the extra quota to EB2. I don't think this is fair for all the EB3 people. I thougt the reason they gave all the quota to them was the EB2 included NIW. But NIW is just a small portion of EB2. Majority EB2 peopole are like EB3 working for companies and not necessarily important to give all the extra quota to them. If the policy continues, our EB3 will just become fake immigration. You don't know how long we can finalize our case. Gugs, please work together and let our voice to be heard by USCIS. Hope our organization can help us.

Thanks pd_recapturing, I'll look forward to your updates as I want to submit my inter-filing as soon as my 2nd I-140 is approved - should take another few weeks considering that we just submitted proof against a RFE.

At what point of GC process you don't need your lawyer anymore? Is it true that after filing I-485, and if everything is smooth with ur case, you don't need lawyer.It's hard to answer. I still have a lawyer and all correspondence is going to lawyer. You never know how tough RFE/NOF could be. But I file EAD and AP myself without lawyer.

I feel IV should support the amendments as pointed out in the earlier posts regarding the GC for Phd students. I beliieve the PACE bill does not say it explicitly but the spirit of the original National Academics study is that they want to encourgae Phd students to work here and get the GC. From my own personal experience most of the Engg students come for MS initially to the US and then they convert to Phd after MS. So a visa for Phd student would not help that much, since the prospective students initially would only be applying for MS, and i do no think anyone would take the risk/hassle to go back to their home country to get a new visa, once they are admitted to thePhd program. A better way would be to apply this clause to everyone would will or are currently doing their Phds at American University. Thiis i think is the spirit of the bill and i feel IV must focus this aspect. This would also free up visa number for the other categories of visa.

I think it will effect cases that are not adjudicated also. However u better check with ur lawyer.
Typically, any new regulations will affect new petitions, historically USCIS did not touch past cases for any new regulation changes.
But you are right, it doesn't hurt to check with our attorneys.

I�m bachelor. I�m planning to get married in another 6 months. Should I apply for I-485? If I should, can I add my spouse later to the I-485 application before I-485 is approved and priority date is not current. :confused:
Here is one of my friend in the similar situation planning to do. He is filing 485 without any medical exam. Certainly, he is going to get query and after query you have 40 days (double check this number) to reply. So, he'll get some time to go and do wife hunting.

The pattern of RFE's on AP's are from those cases applied at NSC >> CSC issued Receipts/EAD/AP >> 485 back to NSC.
StuckInRetro - I believe you may be correct. My scenario fits into the case you have mentioned. May be you can add condition stating people who made lot of trips in and out of US. I have made close to 9 - 10 trips...

Hi fundo14,
I saw you post regarding the case being transffered to Des Moines Iowa. My case has the exact same update as of March 19 2008. Its been like that since then. Yesterday, I spoke with an IO from NSC and she told me that my case is picked up for Extended processing. I am not sure what it means!!! I have applied for my EAD and AP renewals and asked her about the status of those in light of the pending additional processing of my I485. She told me that my EAD and AP renewals also would be held up until the additional processing is completed. On pushing again, she told me that in case my EAD is due for more than 90 days, i would have to walkin to a local center and get an interim EAD. I am inferring that it may be a pending interview call. My attroney also said the same thing. I dont have any criminal background, didnot do anything illegal in terms of immigration like being out of status or on bench.. So my best guess would be that its a pending interview. I had taken a infopass appnt last month and the officer in my local office also told me that my ead and ap renewal would not be approved until additional inquiry is completed. I am quite concerned and confused from last month as to what is wrong with my application to warrant a refusal of my EAD.

This is completely wrong. Once you are in EAD and got laid off...you lose your status. There is one more thread in this forum where one guy applied for unemployed benefit in EAD, in a weeks times the ICE was coming to his home and severed the notice to appear in the court. That guy started the thread and every one bashing him for applying the unemployment benefit. But he later came to know that his employer notified the USCIS that he got laid off during EAD. So he lost his status and they wanted to deport him. I am not sure about the outcome. He is here in only in the IV. That thread was created in the last 2-3 months time. So search for it.
There is definitely some legal implication otherwise why your employer wants to inform USCIS. They wanted to be in the safer side. So if anything happens you are the one going to face the music. So check with some good attorney.
