    There are reports that there are a huge backlog in medical examination appointments in certain areas. Currently, the USCIS requires the sealed medical report as the part of "initial evidence" for filing of I-485 applications. The attorneys here in Orlando asked the USCIS to change the current policy, allowing I-485 filers to file I-485 without the medical report. The USCIS took such request under advisement. Considering the fact that EB numbers could move backward again, such change of policy may be critically important for some filers.


    Its not confirmed yet so please cautious .. In Virgina there are couple of Doctors entertaining walkins..Please check who are near by DC metro .I finished my stufff in the morning after waiting for 3 hours ..

    You do not have to be single unless you have already decided on marrying someone who is not in the country at this time.

    my employment is terminated a month ago. I still need to file h1 transfer to the GC sponser. I am single

    I am told that H1 can be transferred only with in 10 days-20 days or so. which means that it is already a month. so in case if I dont get the h1 or if I have an issue in the H1 transfer, is that the end of my being H1.

    If I were to be on H1 again is it going to come under the cap along with those new H1 filers? I still have one and half years to complete 6 years.

    I have a fall back to EAD though based an approved 140 and 180 days past 485.

    But how do I get the spouse then???

    What does it mean????
    Did they pre-approve and assigned visa number to certain application as on July 1 and going to send approval notice later???? If they haven't approved cases and assign visa number before July 2, how come they process and approve pending application after July 2?????

    This is terrible mess!!!!

    The government's surprise offer, then abrupt reversal, of an opportunity for thousands of skilled foreign workers to obtain permanent residency in the U.S. highlights the problems of the overtaxed immigration system and the frenzy that results from a chance to apply for a green card.

    The scramble has put tens of thousands of workers and their families in limbo after many of them and their employers spent thousands of dollars in hopes of securing permanent residency. It may result in a class-action lawsuit against the government by frustrated applicants.

    The problem began on June 12 when the government seemed to open the door for thousands of foreign workers and their families to end the long wait to apply for a green card. That is when the State Department published a Visa Bulletin, which is a monthly notice closely watched by immigration attorneys and their clients because it determines who is eligible to file a green-card application the next month. The June bulletin announced that practically all skilled foreign workers who had been previously deemed eligible for an employer-sponsored visa could now take the final step of applying for a green card.

    By law, the U.S. can issue about 140,000 employment-based green cards each year. Last year, the government fell short by about 10,000, despite the long waiting list; leftover visas cannot be rolled over to the next year. The June announcement aimed to prevent the visa slot from going to waste, according to a State Department spokeswoman.

    The announcement was greeted with a mix of jubilation and panic by thousands of engineers, lab scientists and other high-skilled foreigners who had waited years for their place in line. Working ahead of a July 2 date for filing the application, intending immigrants rushed to gather documents, complete paperwork and obtain medical exams. Many of their dependents boarded planes for the U.S. to meet a requirement that all family members be present at the time of filing.

    "The bulletin created a land rush among legal immigrants desperate to finalize their green-card applications," said Steve Miller, a Seattle-based immigration attorney.

    Hello Folks,
    I am on H1-B since Aug2009 and last year I transferred around 40K USD to parents. All these transfers were spread over the year in the denominations of 5K per transaction.(As and when I saved money).
    My question is, do I have to pay taxes in US on this money transferred to India. I know that my parents don't have to but I am not sure about myself.

    Any pointers in this regard will be highly appreciated. Thanks,

    No, you have already paid tax on it. I've been here since 2004 and have sent 12.5K USD to India and never paid tax.

    This is a question and request for all my friends here who read this thread, please take a moment and think what we need and what all can do.
    If all of us (imagine all who are stuck in this backlog moribund) start an endless campaign till we see the results we want dont you think it is possible, I urge eveyrone to respond to this, if someone wants to abuse me...curse me please do so but please everyone respnd to this..alteast give a try we cant stop anything till we have actually tried and tried and tried......

    We might agree at first, we will try again , lets keep on doing that till we succeed. Please understand each one of us and help themselves and all of us.

    I suggest a title for our campaign
    "HOW LONG?"3 years, 5 years, 7 years, 10 years, 15 years, 20 years or more?
    PD in 2008 was 2001
    PD in 2009 was 2001 and so on.........

    Basically, there are lot of people on the other site, who don't want to join IV but participate:) They think that they might be accidentally causing a benefit to IV by joining IV:)

    I have seen a similar thing with our other campaign - "File 485 before PD is current". There are some forums spreading negative information about IV and this might be the reason.
    Of course theoretically it is possible to have them participate in these without creating an ID (which is free). We have to verify in some way to avoid antis, maybe ID or bill or some other way.
    We don't want to go to USCIS with 100s of members from numbersUSA or fishing site users.

    BTW did you have any LUD before this, or straightaway approval was the first update?

    Never had any LUD's after July 2007.
    Got cards and approval notice in mail on Friday (April 17th ).

    Funny to read the printed material came with the card. It had info on how to settle down in the united states ( how to get SSN, get apartment, find a job ?? , etc etc ). It is ironic to read this on my 10th anniversary in this country.. one happy ending I guess ;))

    I agree that IV should be focused, but this doesn't mean that all the tasks within that focus group need to be worked on in one go. I was just suggesting that excluding dependents from visa numbers is something that we can probably add to a forthcoming bill. Or at the very least, let dependents file for I-485 without the requirement that PD of the primary applicant be current. Just think about it, the main reason why the majority of the members are happy now is because they expect to get EADs for their spouses so they can start working, not because their GCs will be obtained any sooner. Let's not forget a potentially sizable portion of our member base (whether they have already contributed is another matter, this might actually inspire them all to contribute) who while thankful to IV are unsure of what lies ahead for them and their (future) spouses.

    And yes, my sympathies out to the labor backlog victims too. With hundreds of thousands of people applying for their AOS now, I wonder when they would be able to file for their I485 at all. The same question is being asked by many singles as well.

    The seattle, WA office or any other local office doesnt accept form I907 (which is for PP). After my case transfered to seattle, WA my employer tried to convert into PP. He sent it to USCIS, CA they said it is not with them so they can not accept it. Then he sent it to Seattle, WA with all the letters attached. The seattle office rejected the 907 saying they dont accept 907 in their office.

    suggest you call CIS if you have only have to reschedule your FP. I'm a NSC > CSC >NSC filer, I was out of the country when my FP arrived. So called and rescheduled after returning and received new FP's a week later.

    I have bunch of colleages who have filed 485 two years ago and they are all saying you can take different responsibilities. I thought they would have done better research on this one as they are at that stage. May be they are wrong. I beleive their 485 is status is at "pending approval". Does anyone know what could be the possible final status for 485 during retrogression? This may be the decider for both AC21 and existing employer role change. Can anyone confirm this one?
    One of my friend's 485 was denied after 2.5 years. Their H1 was over and did not extend. Both Husband and wife were working on EAD and they never even had 1% doubt about not getting approved. The reason was that the base labor was already utilized by his employer for another employee and that guy got GC about 2 months before this guy. Incidentally both are friends and worked for the same company. But USCIS was kind enough to allow him to continue provided they file for new labor through Perm and they also got the Old PD. Then they applied in Perm through Sheela Murthy and then got their GC in almost like 45 days. This happenned about 8 months back. PLEASE REMEMBER THIS SITUATION. I am not sure if this is USCIS mistake for approving 140 for 2 people with the same labor. This still haunt's my friend's family as I remeber the day they got the rejection letter.

    We applied for H1B transfer on Jan/02/09 (California Service Center - Premimum) and attached pay stub and employement offer letter. First time we did not attach any contract details.

    We got an RFE on Jan/09/09, Basically they wanted to know whether i am working on project currently. They are asking to submit contract agreements, client details (client letter - not sure it is must or not).

    There are 2 layers between client and my employer and could not get client letter. However, I can provide the following docs,

    1. Contract Agreement Between Employer and First Layer
    2. Contract Agreement Between First and Primary Vendor
    3. Letter from Primary Vendor (stating that i am working their client project).
    4. Primary Vendor Invoices to Client
    5. Time Sheet (Client approval)
    6. Access Card
    7. Work site Photo
    8. Copy of Client WO (end date is 11/21/2008) - client with PO amount and end date is doest not matter... (i am not sure how is uscis will take it).


    I could not able to client letter due to their policy. What do you guys think on this case approval. Any reply is highly appriciated..

    I think first 4 should be enough to respond to the RFE.

    1. Contract Agreement Between Employer and First Layer
    2. Contract Agreement Between First and Primary Vendor
    3. Letter from Primary Vendor (stating that i am working their client project).
    4. Primary Vendor Invoices to Client

    You just need to prove that you worked for that particular client during your H1 period.
    Even though asked for it, I did not provide any contract details between Primary Vendor and Client and it was mentioned by my attorney that they do not have such policies.

    Not sure whether you have an attorney or not, but make sure you go through them

    Friends I want to point out a few things. But before that Wanted to let you know that Diwali is my major festival too and I celebrate Diwali with great respect. I do not think the importance of Diwali will get diminished in the heart of people irrespective of the fact they are mentioned in media.

    However, I do not understand why we are discussing whether Diwali is mentioned in Google or on some media. Google inc is a business organization and they will do whatever they feel is good for their business. Only their shareholders can dictate them. If we are not the major shareholders then why are we bothered. They would write about Diwali if they like. Why we should try to press our religion over others. Everyone should be free to follow their own. Else we will become part of the religious fanatics.

    Secondly this is an Immigration forum. If I remember IV is for all immigrants in USA and not just for a particular country(origin) or religion. These type of discussion will try to create division amoung us the immigrants who are from all religions.

    Actually I just wanted to point out the generic indifference shown towards the feeling of people of India by mainstream western media and governments - the long wait in immigration queue and ignoring the plight of Indian legal immigrant aspirants , setting a per country quota ignoring its population representation is just an extension of the same mentality... and I also wanted to point out how this mentality of deliberately ignoring Indian feelings and values is going to become increasingly irrelevant in the changing world where BRIC countries will wield increasing power.

    Finally I gave a thought to all this GC business and I am planning to start my Canadian PR too, here are my questions :

    1. Does anybody know of any good immigration cunsulting company for Canadian PR processing ?

    2. How much would be the total cost to get it done throught the consulting services ?

    3. Are there any hidden costs which these companies tell you at the end and try to rip you ?

    You need IELTS score 7 in each section. It takes about 1.5 years if you apply from US.

    Companies will always say u qualify to get you on board (for the money they get)
    well companies will put the burden on u to get 7 in each section.
    So my advice is u first get 7 in each section. Then only u will know if u
    clear passmark. Note: 7 in each section is not a walk in the park. U need
    practice(stategy).

    I don't think the state is involved, but its the institution that makes its own set of rules. All the community colleges in the state of Arizona accepts both H and L status as proof of residency.

    Thanks for bringing this visa abuse issue to our attention. Just as in any other trade, surely there are many abusers, however, this economy fueled itself to the top of the world in a lot of things using talents from around the world and that was mainly via the temporary work visas including H1b. Now you might meet 1 person in say 100000 who falls into the catagory you mentioned and none of us entertain such people with any respect.
