Quick question; so when was your EB3 140 approved? or does it really have to be approved inorder to port to the EB2?
Can a person who only has labor approved under EB3 later port to that date if he were to get the labor approved under EB2?
My EB-3 I-140 was approved in March 2007. Yes, you need to have an approved I-140 to port your PD. Just an approved labor with earlier PD won't help.

Re-issue of passport.
thanks, I had e-mailed them yesterday and they replied today that my application is regd in their system and that all apps received by mail will take atleast 3 weeks to process.....did u get any info on ur application ?

So there is a possibility that they will issue August Bulletin with limited date movement and act like July bulletin events never happened? Man, and we keep thinking they cannot sink any lower.
Is there a written rule that they have to request number only when they are about to approve a 485? Or is it just been a USCIS procedure. In the latter case they can change it when they want. Then they would have played everything by the rule.
1. On Jun 12 th there were lot of numbers.
2. July 2nd numbers were gone, through USCIS requests.
3. But wait a minute come July 10th some were returned(which is also legal). Now DOS may say numbers are not zero and potentially issue Aug bulletin with June dates or little movement.
4. Every new application now gets them higher fee.
And this could potentially be defense against the lawsuit. May be I am giving too much credit to USCIS but this has the makings of a great book for some official when he/she quits this administration(Like lot of others who have done this earlier).
So is it possible that the following was USCIS' plan all along in a bid to (1) force applicants to pay the higher fees and (2) reduce the number of applications they would receive. So let's try and see where USCIS or DOS acually broke the law. BTW, the following is pure speculation on my part.
1. DOS makes all categories current in the visa bulletin dated June 12.
2. This screws up USCIS's plans. So they have to force the DOS to issue a revision before July 1st.
3. USCIS frantically starts requesting visa numbers. Even for 485s with pending FBI checks.
4. Come July 2nd, USCIS still hasn't used up all the 60,000 or so numbers, but still informs DOS that all visa numbers have been exhausted.
5. DOS publishes a revised visa bulletin dated July 02 where everthing becomes unavailable.
6. USCIS acts on DOS revised visa bulletin and decides to reject all I-485s filed on July 02 and beyond.
7. July 05 onwards, USCIS starts returning the numbers to DOS. This could be for applications that have pending FBI checks.
8. DOS now decides to use some caution before issuing August bulletin. They will probably not make all categories current, but will probably shift them by a few months based on June bulletin.
9. USCIS now gets all new applications with higher fees and a reduced number of applications.
Please add to this sequence of events if you think I missed anything.
IMHO, USCIS broke the law in #4. And DOS broke the law in #5 if it was aware that visa numbers were still being issued as of July 02.

i met a guy like this last weekend. came to US 2/3 yrs back. has masters in India and has 5 yrs total experience. not doing any research. He is actually a contractor at a client. the employer, applied his GC under EB1. he got GC under 1yr. I was amazed.
he says, his employer applied for few of his other colleagues too, but rejected. most amazingly, for one of his boss (1 or 2 levels above him) also they applied under EB1 but his app was rejected. unbelievable stuff. i guess the EB1 verification is random.
Be so bothered about this trend if it was not siphoning away green card numbers from people who have paid taxes for so many years, played by the rules and still don't have anything to show for it. Plus under EB1 these guys completely skip the labor cert system and escape the brunt of DOL inefficiency.
Nowadays with job openings I'm seeing that the lowest common denominator is taken over a better qualified candidate, the differentiator being GC. If that's the case these guys/gals gaming the system will one day be our bosses. And we with our degrees and experience will have no other option but so say "Yes sir" to these chumps who got lucky.
I'm honestly thinking of writing a letter to the CIS director asking them to please scrutinize these applications closely.

Scroll to the Advocacy tab and read thru the "Meet the lawmakers" document.
Meeting is better than emailing, as emails do not get read. Ask IV Coordinator for the presentation zip when you get an appointment with your lawmaker.

If you read closely, it appears like the 290,000 immigrant visas would be true for years from now on and for years 2001-2005 (the diffrence between current limit and this section). If that's the case and if that becomes a law, there is possibility there will be no backlog after that for some time...short time probably. Please correct me if I am wrongly reading this section. But for me, it appears it applies retroactively and will add the diffrence (150k a year) between years 2001-2005. If my calculation and understanding is correct, once this act becomes a law, the first year there would be 290k + 600k from years 2001-2005 ......I am not sure if my understanding is correct. I prey it is..

Thomas does say about the amendment. It was included in minimum wage bill that has passed in senate.
Even this amendment S. Amd 187 was agreed to in senate. So I believe if the minimum wage billed has been passed then same goes with the amendments too. So we can still hope and not that this was hoax.

I am an American, born and raised in the US and I wholly support Team IV. This initiative not only supports IV, but also helps prevent childhood obesity in the US which are two very important issues that we currently face. We do not get any attention, because we do not raise our issues and we are not vocal about the problems we face. Now granted, we are a small minority compared to the huge lobby and muscle power the undocumented have. But we need to educate the lawmakers about us. We face real issues and our lives have been held in limbo. We have done everything right, played by the rules, stood in the line, pay taxes, contribute to the society. To get this message across, we need to visit lawmakers offices,and educate them.
This advocacy and raising awareness is an ongoing effort, it cannot be a one day or one month thing. We will not get anywhere overnight, perceptions have to change, there is a whole lot of dynamics at play. The timing, legislative calender and politics in general. But we as a group need to stand up, talk about the issues we face and have our voices heard.
