Hello every one,
I am starting this thread for all of us not to just think about the GC process. If any one is residing here for 10 years without GC, think about making a law which can lead us to Citizenship. My thoughts on this:
Many of our colleagues who landed with us during the late 90s (1998, 1999) and early 2000, who got their GC without any issues are now Citizens or waiting to become Citizen soon.
What is our status?. Just think. Still we are strugling to get the GC. Even by law change, if we are getting the GC this year (by GOD's Grace), then we need to wait for another 5 years from now (approximately 2014). Many persons like me who have come to this Country in their later career will be very much affected due to this delay (we have lot of other issues like the dependents reaching the age of 21 etc., College, University fees etc.,).
Core team and every one, please consider this and try to lobby for getting the citizenship without further wait if the persons satisfy the folowing conditions:
1. If they are legally here for 10 years (With approved I-140 and waiting for Adjustment of Status without current date).
2. If they have earned full 40 points in Social Security
3. If they have paid the tax continuously for 10 years
4. If they own a house and paying Mortgage (adding weightage to the Economy boost)
and
5. If they do not have any criminal records in these 10 years.
Please again do not just concentrate on the GC issues. Consider this and if any one can come with a letter draft with legal openion, we can send it to all Congress members, State Governers etc.,
Hope the members and the Core team consider this issue. I have one more thread on this, which I started some months back but the response was not that good. If every one of us unite on this and raise this to the Congress, I think the new Government may consider as this is very genuine.

People who meet the conditions above can benefit the US Economy in a long run because...
1)Deficits are going to be high for a long time...in trillions, and if we are allowed to apply for naturalization directly, there is a better chance for us to pay taxes to reduce the burden.
2)If we are asked to leave now, the US is committed to Social Security payments(with the minimum 40 points) even if we are outside.
3)By now, we already have kids who are American citizens... which means that when they become 18, they can always sponsor us as citizens. All that we are asking is for the congress to do the same a few years earlier. It is better we are here in our earning years than when we are in our older years.
If this Bill is introduced in congress, people will listen because...
1)People waiting for 10 years... and done all the right things, no one can simply ignore. Also, there will be a sense of guilt on the US Government to have let the situation deteriorate. They will think of ways to make the transition smoother... remember they created a special green card category for Iraqis since there was a sense of guilt.
2) Whether this passes congress or not, there is a legitimate argument of asking for the congress to rectify the situation. That is the best we can do.
3) We need to give more and more options to the congress. Not everything sticks, but even if one or two get passed, it goes a long way to help all of us.
I personally will contribute bigtime if IV core want to take this up!

IV has just now got a green light from our lobbyists. We need to start calling now.
Someone please consolidate all information and create a campaign for this. Now is the time to follow up with anybody on the full committee with whom we have previously met or been in contact. Don�t call people who are already cosponsors. Only select people in the committee that are not co-sponsors. Make sure to say that you are a member of immigration voice so that it complements our lobbying efforts.
Please pool your energies and create a list of people to call, phone numbers and what to say. Any moderator will add in the first post of this thread.

It is not clear what you mean when you say that. How can you get EAD without filing for 485 [which you can file only when your PD is current].
We applied before the retrogression started
2004 July - labor cleared for my husband
2004 December applied for I140 and I485 --- I 410 approved EAD and AP issued
I was in the country on F1 and applied for I485 along with my husband in 2004
Graduated in 2005 and changed to H4 immediately although not required since the status is Adjuste status
So when my PD becomes current they will let me know if we get GC or not
My question was since i applied for I485 when i was on F1 will it be a problem. I asked my lawyer and he said no. But i dont know how far he is correct.

me and my friend, both are stuck into this right now. Both are having different nationality and we both are in this country from last 10 yrs. So I think it might also depends on your history, as longer stay, your name will pop-out from many places, which will delay the things.

Finally I got the CPO email today. After 10 years (first GC was filed in 2001), it was our turn today. I received for me and my wife both.

If you can restart ur app in Eb2, you should be fine dates wise. Unless CIR messes it up.
Approximately 2 months for PERM and then you can file 140+485 concurrently.

I am still trying to talk the old employer. Is it such a big deal that they cant even write a letter of future employment for me? i told them that they are not obligated to hire me but they are scared that they are trying to show that they are in losses and that by filing for a GC and promising a future employment they will not be able to show that they are suffering losses.
Why is it so difficult and complicated?
I am losing hope in it.

Now how do you know that, do you check their passports or do you ask them point blank about their origin. Or do you try to place them by their accent. Obviously not. The only way you can make such a blanket statement and attach an "immigrant of some variety" lable is by the looks alone. My friend, the last ten pages are precisly about such issues. Also, it is quite possible for a third generation Indian/Pakisani, a true Brit nevertheless, to work at Heathrow ... and If I borrowed your eyes for a minute, I see only an immigrant invading the country.

Yes but on Monday morning it is NOT going to be current appantly. So, technically you did not send documents ( if you are getting it out on MONDAY) when they were current.

This is not August bulletin.
Looks like people have misconception, that if their file goes to USCIS on July 2nd and visa bulletin is revised on July 3rd or later date, then they are safe. It is not so.
If at all if there is a change to the August bulletin it holds good for August and not to July bulletin.

USCIS and or DOS don't quiet yet understand the full implications of this flower campaign. They still are feigning ignorance or adamant in their analysis of the july fiasco.
Untill this flower campaign is further carried by major newspapers, we still cannot declare full victory.
Yes, USCIS chief fully knows that flowers were sent as a token of protest and they will not know the full impact untill they see them.
I am telling you guys, the USCIS is gonna SERIOUSLY think "Lets keep screwing these guys and getting free stuff AND free publicity"

No I don't. You basically don't want to keep the door open wide. Once you are IN you want the door to be closed. You don't worry about loosing US jobs to India/China, but you don't want Indians/Chinese to enter USA and enjoy the "quality of life" you enjoy here.
Nobody enters USA to live a "low profile" life.
You are getting dangerously accustomed to the "taking things for granted" style. You are loosing your competitive skills.
I personally know that more energetic people coming in is kind of dangerous even for my job safety-net (basically I cannot take things for granted). But I still have not learned to think beyond humanity, and I believe sharing is good. The new guys also deserve the chance for American dream.
And I don't forget that I was also once in H1B, and came with a lot of dreams and skills.

I saw this link Murthy's email too. The total pre-adjudicated cases in the chart is matching with the total in the document. Well now there are more un-answered questions:
1. Does all other pending 485 include employment based ? If yes what % are employment based ? Obviously we do not have any country specific data on these.

USCIS has fooled us again. No good statistical analysis can be done on incomplete/inaccurate data. I am going from hopeful to hopeless again. I am EB2-I Feb 2006.
