I think this is an opening and the outcome will depend on how we respond to it.
We are in the middle of a fight to get recognised of our problems and for sure the director responded to our non-violent protest.
What we do next will count.
Should we lay down our arms a surrender now? This will be a sign of weakness. Lets fight on.
Why is everybody so happy? He has just briefly and curtly informed in the message that flowers will be forwarded. They won't be sitting on my desk and embarrasing me. There is no acknowledgement of the issue or any empathy or compassion with the sufferers. Now even the press coverage will make USCIS director look good. I don't see what's the positive development here.

From IV: IV commends the initiative taken by it's members nk2006, pd_recpaturing, ItsNotfunny and others. As these members have observed, we all know that any one who has filed for AOS/I-485 can potentially be hit with this issue, especially in the current job market situations. If you believe in the old adage prevention is better than cure, this is an action item you have to subscribe to. It will be only a matter of time the number of such denials is going to spike.
In recent weeks there has been a spate of I485 denials by USCIS in the AC21 cases. In most of these cases, the underlying I-140 has been revoked by previous employer. But AC21 regulations and related memo’s require that I485’s should not be denied based on that – provided I485 has been pending for more than 180 days and the applicant has changed to a new job that is same or similar. USCIS has been rejecting cases without even issuing a NOID – again required by AC21 regulations. So USCIS is not following AC21 regulations and related field memo’s for whatever the reasons.
Obviously this will have a very bad impact on us – in addition to tremendous amount of stress it can have very bad economic implications including loss of job. In the current economic conditions we cannot afford to lose the job change flexibility provided by AC21 regulations. IV has started a campaign to fight this.
After a brief campaign to write to Ombudsman, it has been decided to intensify this campaign and write to various officials in USCIS hierarchy. IV core members have been actively involved in coming up with a strategy and are actively supporting this effort. By sending large number of letters we can draw their attention to this issue and resolve as quickly as possible. There are other strategies that are being discussed and will be underway soon to tackle this issue. This is the first and the most important step up on which other steps depend.
I request all the members to start sending the following 4 letters. For your convenience the letters have been completely written including addresses to be sent – all you have to do is download following 4 google documents – add the date, your name and address – and send it to the address provided on each letter.

Did any one get their GCs WITHOUT getting the CPO email? I got PDA emails Sep 11 (saying that they have approved the I485 applications), followed by SLUDs Sep 13. I didn't get any CPO email or other notification. Should I expect the CPO emails and THEN the GCs, or just simply the GCs?

Does one need to be physically present in US in order to file I-485 application? I had already booked my travel to India on May 25th before I came to know that the my Priority Dates had become current. Will I need to be in US till I get the filing receipt? I was curious on how would UCSIS know that I'm out of country on the day of filing?

it asks last five year employment history , i have not worked in USA for the past 3 year but i have worked abroad before these 3 years.. should i write it in the column or i should write NONE as i have not worked here in USA .... i am not the primary applicant ... my husband is primary applicant

I recieved nothing. I cant check whether my check is cashed or not as my lawyer asked for draft and not personal check. Dont know whats going on...cant talk to the lawyer as the company doesn't allow....Man this is too frustrating...

we are giving USCIS options on how to deal with the campaign.
If they really do forward the flowers they need to think about seperating notes from flowers.
They will pay a smaaaaaaaall amount to delivery guys who will strip all notes and that's it. Or they could say "it's gov. necessity' to remove a message from bucket, and it will be free. :(

Nothing will happen. The dates will be retrogresses on Monday. May be we will see 'U' in Visa Bulletin. The AILA will try to pursue DOS and USICS but they will politely say "sorry for the trouble" This will lead to the law suit. Some people will submit their resignation. In the next year you will see those at some higher post somewhere.

I found this forum after my I 485 denied as I applied for AOS under AC21 at texas center on 12/31/2008. The first thing I did after joining IV is sent the four letters.
I know its a stressful time. Please follow this thread carefully, read it completely and contact ombudsman with correct form. It would be easier for all of us if CIS can see number of genuine cases which are denied wrongfully. This way, CIS may would act faster to again put your case on file and in future will not do this again.

its ok, you misunderstood my point. I dont want to divert OP of this thread.
Anyways the fact of the matter is that we are in a limbo, all indications point to Obama becoming the next president of US. if CIR 2008 was any indication , we as EB applicants are royally screwed if Sen Durbin dictates his immigration policy. What is the use of talking about wars and innocent people when chances are that the advocate of his immigration policy is opposed to my main issue of EB reform. high low Taxes, 401k's, houses, Medicare etc will matter if you get to stay here in the first place. A average 6-9 years of paying taxes, supporting medicare and Social Security and we now need to think about moving to different countries where skilled immigrants are welcome....think about it. Just look at the CIR 2008 discussion to understand what i am talking about. Read the senators transcripts.

I have a quick question, Some of you had an older EB3 pd active, filed 485 and then either ported or have used a newer EB2 and gotten approved and Greened.
Now, knowing USCIS uses outdated software, the question is are these people that are greened, taken out from the so called "queque" for EB3?. And then hopefully the line gets shorter for EB3s?.

USCIS declares in weekly updates that actual package receiving date will be recognized as the Receipt date. However, as filings are shuttled between centers in an effort to push work around, when data is entered, a different date appears. This needs to be corrected. Further, as there are still cases not owned by any center, weekly updates are misleading. Each center just reports on what it has accepted to deal with. This needs to be addressed as well.
I think congressmen should be approached with the larger and collective problem, which is likely to get attention/action. Individual cases just receive standard replies.

Here is the short version of how it unfolded. I've seen some quick responses from USCIS.
9/15/2010 - USCIS email indicating that cards mailed for both me and spouse
9/16/2010 - Spouse received card
9/21/2010 - Got email (LUD) that my card returned undelivered.
9/22/2010 - Called customer service updated the address
9/23/2010 - Got my card in mail (wrapped in an usps priority envelope) with tracking number
I was pleasantly surprised with the fastness of USCIS.

My attorney's office contacted USCIS and was told that USCIS has current address on system :cool: They told that since the case is waiting for RFE it must have happend by mistake :confused:

Here is a list of things you can do to protect and improve you cash cushion (and may be avoid foreclosure)
1. If you drive one of those luxury cars that cost upwards of 25K and have paid it off. Get rid of it now. These cars depreciate more in dollar terms compared to cheaper cars. Buy a less expensive, no frill used car for 9-10K, put the difference in bank. That might bring in 10K of much needed cash. Even if you have not paid it off look for deals to sell and reduce your monthly payments.
2. Open an account at quicken online (http://quicken.intuit.com/online-banking-finances.jsp) it is free. Connect your banks and monitor ALL your expenses carefully. Find out what portion of spending is discretionary and cut down on it.
3. Hunt coupons, shop at Costco/Walmart (even if you hate the shopping experience). Avoid brand names and stick to Kirkland/Great Value. This might save you in monthly expenses.
4. Also, you can add cash by working part-time. I am not talking about those hard to come software moonlighting jobs. Any job that pays 10-12 an hour will add 12 x 4hr x 5days x 4 Weeks = $960 per month.
5. If you live in a duplex with a bathroom/bedroom downstairs, you can rent it to someone from local college/university. Underbid by quoting super low rent on craigslist and you can get $400-500 per month.
6. Use online services like LegalZoom (or Prepaid legal from work) to prepare contracts for rentals etc.
7. Cut down on travel/eating out and anything that you can live without. A little cash could go a long way.
Also, when it is hard to stay put and make payments, always remember there is a silver lining in owning a house too. If there is a hyper inflation (which is very likely) rents will sky rocket and salary might go up to keep pace with it, but your home mortgage frozen in time for next 20-30 years will remain unchanged and you could potentially have lower monthly expenses compared to renters. That's a bright side of staying put.
