My Labor has been approved around May 20 2007 and my employer got a letter from DOL stating the same (dated May 23), but my Lawyer says that they never got the Original Labor notice (may be they misplaced it).
Now I'm waiting to file my 140 and 485 together before Aug 17 and he says if we don't have the original Labor notice, we can still file 140 and 485 with the proof we have (DOL letter to the employer).
Will this work or will my 140 and 485 be denied ?? I'm not sure I can get my original Labor notice before Aug 17. Is there anyway to track with DOL ??

Lets start a Rally or sending letters...Lets do something so that our pain..plight gets highlighted...It's really frustrating inspite of such backlogs people just keep quiet and don't do anything about it....I just can't imagine waiting another 5 yrs to get my GC....Lets get started with a Rally

We don't need to alert the general public about our issues.
What we need to do is alert people who can make a difference.
Also, the costs are huge for news paper advertisements and may also irritate the general public.
Now that we have the people aware through Flowers, we can go for the big kill.
Advertize in Newspapers in D.C., State capitals or National newspapers
We can contribute to IV and IV can advertize.
Half page ad with facts, events and Rep. Lofgren letter.
Nothing works better than mass media awareness

May Become Unavailable Sooner Than Expected
EXECUTIVE SUMMARY
It has been reported that U.S. Citizenship and Immigration Services (USCIS) has indicated that employment-based numbers may be exhausted sooner than expected and could become unavailable or subject to new retrogression during the month of July. USCIS reportedly has sufficient numbers of immigrant cases in its adjudications pipeline to meet the reported 40,000 employment-based visa numbers that remain for Fiscal Year (FY) 2007. If employment-based numbers become unavailable in mid-month, USCIS could cease accepting applications for adjustment of status before the end of the July, though it is not yet possible to predict when this could occur.

Our understanding is that discussions on the issue of visa availability have been escalated to a high level in the government and we will continue to seek definitive information.

1. Bill applies to anyone who got their degree in preceding 5 years or resided legally since graduating (even greater than 5 years) will be eligible under this bill.
2. Many ROW EB2 and EB3 will get visa number from the 55K if they have advanced degree here. That means more spillover.

4. There are going to be more Indian and Chinese apply for EB2? Not that easy any more. The DOL is tougher than before on PERM application. I don't believe there are going to be 55K more new EB2 applicants each year. No matter whether there is additional 55k, people are always trying to applying for Eb2 if there can. As we don't see that many new EB2 now, I don't believe we will get that many new Eb2 later either. Plus, the bill does not say the 55K visa will only go to EB2.
5. What else can we do then? It is already very tough to push this bill through. Should we modify the bill by saying that just simply applying the 55K to everyone, no matter if he/she has advanced degree? I am perfectly OK with that if the IV core think it is a better idea. Personally, I think that would make this bill even more difficult. :

I can't stop thinking of our efforts in DC. As I have already posted, it was a tremendous experience being a part of such campaign. I came upon this thread of adding more members to IV and from what I read, it was successful largely. IV has increased members from 10,000 to over 40,000 since this thread was started.
I am bringing back this thread again, asking our members to get more involved in their state chapters and to encourage our current membership to be more active in the forums and action items. We, who participated in the DC event, can hold conference calls (if our members are separated widely across the state) or meet in local libraries (if many of our members are in the same city) and talk of our experience in DC and what needs to be done ahead.
Fellow participants, please do come up with suggestions on how to keep the momentum going.........

Do you know the story of the crow getting to the water by putting pebbles into the jug which had very little water?
Well, here we are: the water is IV's target...the pebbles are the contributions ($200, great, but $20, still good!!) from a large number of members. It's impossible to justify why one can not contribute $200 when the core members and some others like you & anurakt have given so much more. I believe it is equally important to encourage as many members to contribute as much they can.
No contribution is too small if it is actually made. An ounce of action is better than a pound of intention!
Some legislative action is expected in Feb. Money will be needed immediately. I don't think $20/month is the answer.
I think $200 is a very reasonable amount based on the cause. Life is not a charity.
You should pay a total of $200 immediately if you have paid less then $200.

Is the birth certificate required for dependants too or just the principal applicant...Can someone please clarify.....My PD is not current (EB-3 India Nov 2003)..But hoping it will be current in a few months....So just want to keep all docs ready if the dates are current.....

My wife is on H4 visa with a valid I-94 (till Feb 2009) but her status will be on H1 from Oct 1st, 2007. Do we need to go for stamping before she starts working. Also who applies for SSN - Her employer and do we need to file ourselves. The employer kept the original H1. Do we need the original to apply for SSN? How soon can we apply for SSN?

Doctors are EB2 and EB1.
They are not EB3
Even Physical therapists are EB2.
EB3 are low level/entry level programmers or skilled workers with with undergraduate degree or diploma degree holders that use education evaluation service to prove that their diploma is equivalent to an undergraduate degree.
Now some of you will say you have masters degree and still are EB3. It does not matter if you have a undergraduate degree from IIT or Harvard and have MBA from Harvard. If your job needs only undergraduate degree your master degrees are useless. You are working in a wrong job and overqualified for your job. You should look for another job that needs your american masters degree. Some will say that their lawyer filed in EB3 even though they qualify for EB2. Now that is also a wrong excuse. If your lawyer and HR screwed you, it is your fault that you could not stand up to them. It is not USCIS fault.

My I140 is approved and now I am filing the I 485/765/131 together based on new developments. Now that all dates are current, are they going to process the application based on July filing date or based on Priority date(labor).
Can please someone confirm that. My attorney says its based on priority date but I just called USCIS information desk and they said that its based on 485 application date.

If dates retrogress (Likely to happen on July 3rd, July 15th, July 31st.....take your pick), then I-485 will be processed based on PD

The slowness in the approval rate has me a little worried. In July many people got approved at within the first few days - that does not seem to have happened for the first 3 days of August so far. I'm hoping that this is just a blip and the trend picks up shortly.
