Hi All,
Regarding my I-485 appln. status - I do remember seeing "Request for Evidence" status before. Currently I see "Request for Evidence Response Review". I see this status change although there are no LUDs.

The objection by house members to this bill is the easy way out for the reps, who are in trouble for a million things such as high gas prices, another Vietnam type bogging down in Iraq, high spending on medicare etc. The only way for conservatives to curry favors with their base is to throw in the defense of marriage bill, and do nothing about the CIR. The next few days will be critical for the bill. It dies or goes to the conference where it might come out radically changed.
I am opening a new thread to post all updates on the CIR. It seems today is a crucial day when the house comes in session and work on forming the committee might start. If people hear any updates you can post in this thread.

It sure is going to be a difficult task to have this bill passed since house has republican majority and they are saying in the media that they will not have the bill passed.

These hardliners argue that the U.S. Constitution mandates that any legislation to raise revenue for the government must originate in the House and S. 2611 violated the U.S. Constitution by originating such legislative bill in the Senate. Thomas does say about the amendment. It was included in minimum wage bill that has passed in senate.
Even this amendment S. Amd 187 was agreed to in senate. So I believe if the minimum wage billed has been passed then same goes with the amendments too. So we can still hope and not that this was hoax.

"Also the EB queue needs to be considered while moving to the skill based one" - I don't know what you meant by this line but I am in no mood to restart my GC application (for which I have been waiting for the past 9 years) just because some genius (whoever that person was) woke up one morning and decided that all the applications need to be reformed into a points based system.
Of course we are all in the EB queues. I don't want to discuss details of any campaigns in the public forum. You could volunteer for this too and suggest your ideas to 'StarSun' and clear your doubts.

Though I love the recent forum posts being displayed alongside the content on the home page, I think it's also a drag on the resources and takes down the main site at times because of issues with the Forums/DB.
We're all (mostly) techies.... we should be able to fix this and deliver higher SLAs for our web site...

I agree with this 100%, BUT we (US degree holdeers) have to understand that in the GC aspirant community there are tons of people who came in through "desi consultnats" (even this word makes my blood boil), who will never agree with this or support this. Classic Indian mentality, one crab pulling the other back in the basket.

The outcome of it does not matter right now, atleast the process has started and we need to follow on it with some targeted activity. Lot of my fellow IV'ians gave suggestions and some presented stories too. I did come across this thread only today and I missed out on an opportunity to present my story but nevertheless others have done so, i am somewhat lucky that despite the pain and hardship I did get my GC a year and half ago but I feel the pain my friends go through every day and continue to associate with IV.
I have read through each and every post made in this thread and these are good responses. There are some very good proposals - some likely to benefit a small set of
people ( GC's for Master's from US universities) and others wide encompassing.
I think the fix for this needs to go beyond smaller subsets of people.
A single master stroke is not going to erase the backlog it will need a series of fixes and the best way to go about it is to push for 1 or 2 main goals which will eliminate most of the issues. IV's core efforts are in the right direction.
IV'ians need to be united in getting a broadly accepted solution to majority of people rather than a small minority. Clearly my allegiance lies with people with priority dates which are more than 5 years old, people who are stuck in backlog centers, name check's and unexplained delays for no fault of theirs. This is not to belittle other people who are in the line for their GC's everybody have to wait their turn.
Friends who are espousing the cause of faster GC's for US Masters, do not sit on the high pedestal and belittle the people who came in on 'work visas'. They have as much right as you to have that 'Green card'. The time is not to fight EB2 vs EB3 or by ethnicity. A big deluge starts with a small drop of water, let us begin somewhere and once we get a fix to the larger problem other things will fall in place.

We EB3 folks are not requesting for EB2 visas. We all will be happy to get 50% EB1 spill over visas. The other 50% can go to Eb2s.
right now 100% of EB1 spill over is going to EB2.
Where were you for these many years when DOS was giving out all EB1 spill visas to EB3 ?

It's better to apply for 485 after getting the H4 stamp. Once you leave the country it is considered abandoning the green card application. So you may have trouble getting a visa stamp. I may be wrong. So once you get your H4 stamp then you can come in with a valid H4. If you are planning to travel only in July why not file 485 and Advance parole then you can travel with Advance Parole as a backup. It's just my opinion.
My husband's I-140 will be approved in few days and our PD is current right now. Once the I-140 is approved we are planning to file for I-485 the sooner possible. The main reason is for me to apply or EAD so that I could work. You should also consider that I am travelling on July/august and of course I will require a visa appointment at the consulate to stamp my H-4.
My questions are:
1- Is it safe to apply (once the I-140 is approved) before leaving U.S. For I-485 and EAD together?
2- What documents are required to file for EAD besides what is already being sent with the I-485?
3- What are the potential problems in leaving the country in July with an I-485 (with or without EAD, please tell me in both cases) submitted, and having a visa appointment at the consulate abroad in August to renew my h4 that expires in NOv 2007? The dilemma is whether it is risky to change jobs during the infinite waiting period or it is risky to stick to the same employer and get frozen in time...
That is an individual decision. You will minimize the risk by maintaining H1 status so you can appeal any untoward decision. Just make sure the new job you take up is "similar" to the current job. Unfortunately, there are no good answers here since AC21 is a (relatively) recent regulation.

Quick question; so when was your EB3 140 approved? or does it really have to be approved inorder to port to the EB2?
Can a person who only has labor approved under EB3 later port to that date if he were to get the labor approved under EB2?
My EB-3 I-140 was approved in March 2007. Yes, you need to have an approved I-140 to port your PD. Just an approved labor with earlier PD won't help.

I think we should make a list of things we lost and found in D.C :)
The amazing thing is We Found all the things we lost. I found the same pair of glasses Twice! The owner managed to lose it again in the situation room and I found it again - I think he didn't like the glasses :)
Chargers and ties were lost and found. I think after working 3 days straight, without much food/sleep and thousand and one things on our mind - we too were lost :)
