It is the RD of the 485 application that dictates the order of processing the application. In addition, for the application to the processed the PD must be current. Once the PD is current, it is the RD that matters.

the company is probably advertising the position in california and that is where the job opportunity is. If it doesn't allow for travel then company is saying that is where you are going to permanently work.

however, in the last few months; department of labor in audit requests has stated that job opportunity is at xx location but person address is at xxx and to explain the discrepancy. I haven't seen this type of query recently but your lawyer is probably thinking about getting this type of query.

...only if approved. Guess, luck matter a lot when ur dates are current...as those guys are picking up cases randomly. Majority of approvals thus far are Feb/Jan 06 , when oct/nov guys are still looking forward..Please, dont get me wrong....Systematic approvals helps everyone...as you know the celebration time has come

Is it just me. Has anyone noticed all these new threads and posts by new members, their 1 or 2nd post and they are bashing the Indian consulting firm. They are asking for names of such firms to file a lawsuit against them. The timing of these posts is interesting with the new Senate bill S.1035, which wants to make the H1-B system unworkable by citing the example of such Indian consulting firms. One of the pretensive solution of this bill is to stop such exploitation by Indian consulting firms.

I agree that house appreciates on average at inflation + 1% but it is still not a bad investment because most likely everyone would be taking a mortgage. So what we need to find out is a equity return on house?
For a 30 year mortgage and a 20% down payment, the house return on your invested equity of 20% by the end of 15 years is approximately equal to long term stock market return of 10%, even though the house is appreciating at inflation + 1%. This is because of deleveraging.
However, if we do not refinance by the end of 15 years then the house becomes a bad investment and the returns go down.

My employer will not sponsor me for no particular reason and all the horror stories about GC processing have discouraged me from pursuing it on my own. I am currently seeking opportunities in my home country.

I can't tell you how p***d I was when I read someone suggesting ppl to "enjoy the moment". For someone who has been waiting 3-4 years for labor to clear and sees ppl getting in front of the line to get the EAD/AP, its just insane. And to tell that person to be not a "spoilsport" is just rubbing salt in their wounds!
To my friends who are still stuck in PBEC, please have faith. You will hopefully be able to file 485 even after Sept when the dates retrogress again. My gut feeling is that dates will retrogress back to 2004 again. 2005 is when PERM started and that's where the bulk of applicants will come from right now. PERM filers will get the advantage of AC21 that you didn't have for all these years but plight of ppl stuck in BEC's has never been on anyone's agenda. So not much you can do.
In this process everyone gets screwed onetime or other . Everyone knows that dates will move back but the advantage of filing now is the applications enter into preprocessing stage after 10 months or whatever.
People should look at anywhere between 3 to 10 years depending on priority date to get GC.

I highly doubt any one with a full time job will trade enough volume for it to be cost effective to claim trader status when filing taxes. If you trade for a living,not work as a trader then it makes absolute sense to file as a trader.
What is the advantage of claiming trader status on your tax return? I buy / sell shares on different days of the week (example: Buy on Monday, Sell on Friday). Does that make me a day trader?

I am seeing several people contacting Congressman and opening service requests. These guys seem to have become current just this month and they do not have any patience. It is crazy in my opinion. As pointed out earlier there is lot of herd mentality on the forums and if one person posts, everyone else does the same. Some people I have seen on the forum call customer service every day to get case status. I urge people to read and try to understand the process than blindly following what others are doing. Secondly as posted earlier, tracking is also useless and a waste of time. It will not help you get your green card any faster. Have some patience and follow the process. Starting a service request as soon as your date gets current, cannot help you.
And to add if this continues, Congressman will not take these requests seriously going forward as every other day they will be getting such requests. So please have patience and wait for few days before you approach your local Congressman.

I sent my passport renewal to CGI houston on Apr 5. I called them last week and they said they registered it on Apr 8th and it is under processing. I will be traveling to India on May 18. Will I get my passport before then or should I file for Tatkal. Or how long can I wait before I send the tatkal fees. The lady who answered the phone said that I don't need to file tatkal and hung up. I am confused on what to do next. Please advise.

Hundreds of members visit this website every day. I am just really surprised that we are having trouble getting people to participate in Advocacy Days and raising $50,000. It seems like a no-brainer to me to participate in whatever way possible.
There have been around 250 contributions so far. Some members have contributed a few hundred dollars each, with a couple of members contributing $500+ each, and some have pledged $100 for every $2500 or $5000 raised, just to help try and reach the target. They wouldn't have had to put in so much if everyone else chipped in.
I am really curious to know why you are not getting more involved and at least contributing financially to this effort if you cannot attend the Advocacy days. You are the beneficiary. What is holding you back from trying to do something tangible to help yourself, your family and your friends? Are you seriously going to tell me that it's not even worth $50 to you?
This is the best shot we are going to have in the next two years.
