Why is Atlanta processing PERM applications so slowly versus Chicago? Is this always the case? Do they always process at such a slow pace? It is really frustrating when people filing their labor from Chicago are getting approvals in not more than a month people from Atlanta are waiting for 3-4-5 months and even longer. What is wrong?

This question has been posed before but I did not find answers so am posing too: When can one travel safely to India after applying 485?
1) If EAD and AP are filed along with 485, how long will they take to arrive. Service center dates indicate that EAD and AP currently at Jan 07. Does that mean that they are taking over 4 months to issue EAD/AP?
2) There is a an Interim EAD. Is there an interim AP if AP is pending for over 90 days?
3) Is it possible to request EAD/AP at a later time?
4) My H1B is up for reneval in Oct 07. Can I get a 3 year extension on H1, apply for a H1B visa in India and travel back to US on this? Would this be a faster option?
5) When do FP notices typically come out after applying for 485?
6) What is the grace period for FP if one misses the deadline (Is it still 12 weeks? Will the new rule to remove 12 weeks on RFE/NOID have an impact on FP?
7) If you are using an attorney for 485, will all such notices (FP, etc.) go to the lawyer as well. The concern here is that if the notice comes to my home address and I am out of the country then I am liable to miss that appointment.

I had a friend who tried to register but the website wouldn't because he has yet to file his LC, can someone confirm this? otherwise I will personally help my friend if he is making any mistake.

What your friend can do is enter the tentative month he thinks his LC is going to be filed. He can always update his user profile once the LC is actually filed. I would however request all members who are introducing others to request them to enter a valid email that they access frequently. IV is not in the business of selling emails or sending junk mail. But valid and regularly accessed emails are a vital tool in getting members involved when a significant push is needed.

My 485 petition is with NSC. I opened an SR last month and got a rather uninformative response today. It does not tell me if my petition has been pre-approved or has even cleared the background check.

Letting all this Indian Consulting Firms taking ALMOST all the H-1B visas is very unfair for everyone of us that we are working hard to get a job in the US. In my opinion, they are trying to monopolize all the H-1B so no other company can be able to hire foreign professionals by themself. In this way their only way to get professionals is thru them.
It is very UNFAIR that this consulting companies takes a large number, getting almost everything, of H-1B visas without having a real job for them. This companies will offer this H-1Bs to other companies, making it a big business. Additionally, I believe that indians also pays to this consulting companies for the H-1B.
Even if the congress raise the cap without making changes in the system, it will never be enough. It will just increase the profit of this consulting companies. I only hope that the changes going to be introduced to fix the system will not screw us and complicate more the immigration process. But realistics and effectives changes are needed.

Here is some information that may help you gauge the reality. There is lot of companies in US that would not fit into your definition of ‘Indian Companies”. These companies have filed for large number of H1s that too would have finished the H1 quota. If it is ok for an H1 employee to work for a shoe making company, then why is it “UNFAIR” for H1 employee to work for a consulting company?
Bottom line is:
1.) There is green card backlog for 6-10 yr. Any company would love to get an insurance policy that an employee will work for them for that long period. So one reason for this quest for H1 is due to delays in green card processing. If someone gets their greencard in 1-2 yrs., H1 visa approval will not get the employers any insurance policy for long term employee. And the demand for H1 due to this factor would subside.
2.) More importantly, even if demand for H1 would subside due to green card processing in 1-2 yr, the fact that unemployment rate is very low will still exist. Unemployment rate is making it hard for companies to find the right people at the right time at the right place. So companies are looking for ways to recruit the necessary talent, wherever that talent is available. IEEE wants all foreign engineers out of the country so that their membership base of engineers here, who do not want to learn new technology, could get the taste of late 90s. So for you to first attack a set of consulting companies and then cheer around the bill hoping that “the changes going to be introduced to fix the system will not screw us and complicate more the immigration process.” is exactly how it is going to play out. Infact, anti-immigrants will come to this site and cut-paste comments like yours into their report to strengthen their argument when they would go out to lobby in favor of this bill. Folks, sorry I have not been in much action, with other stuff taking priority, but I would definitely like to know what it takes to do this? I have completely lost fitness due to bad lifestyle, long commutes to work, working spouse, small baby, and other tensions and I like this idea a lot.
Nolaindian - can you briefly explain how this marathon works? Does every city have a marathon to which we register, is it a community? Who sponsers? Do we do it as IV? Do we all form a group. Are the rules set by us? Do we pledge????

The basic concept of Team IV is to raise either $300 or $500 in 1 years time starting when you join Team IV and the year ends on January 18, 2009.
There are two Memberships Types to join Team IV; Individual and Family Membership: The Individual Membership costs $50/yr and Family is $75/yr.
Team IV Members will get a T Shirt, Welcome Package with more details and fundraising tips. The premise of the fundraising is that your friends and relatives will support your goal to walk/run one of the three Team IV events in the year and thus will make donations to Immigration Voice (by check) to help you reach your goal of either $300 or $500.
The Three Team IV events we have chosen are:
1. San Francisco Golden Gate Park 5K on August 17, 2008. A 5K is 3.12 miles and can be walked in 45 mins.
2. The Washington DC Army 10 Miler on October 5 2008
3. The Houston Marathon (26.2 miles), or Half Marathon (13.1 miles) or 5K on Jan 18, 2009.
You can do all events, as Santb1975 and myself will, but you are required to do only 1 of these 3. If you have a family membership, we encourage all family members to participate, however, we require only 1 to complete at least 1 event.
If you absolutely cannot make it to one of the above events, you can still join Team IV and participate at local events in your hometown. I can assist you with finding such events. We will try to include your local event in our schedule the following year.
What would really benefit IV is to show our strenght by numbers; meaning if we have several IV members in IV T Shirts walking/running as a group, we are going to get noticed even more, and this is how we can good press for IV.
The goal is to raise money to support IV's long term lobbying efforts and to support a not for profit org that fights childhood obesity in the US. This is in keeping with our fitness goal, and it is a quality of life issue, not only for IV, or for Team IV members, but for the country we have chosen to make our homes in.
Our goal is to have 150 Members and raise at least $45,000!

We had our fp done on June 11th and there was a soft LUD on 07/22.

Hope we get our EAD approval soon.
I think they had a system glitch for some time. All the people who got an LUD on 7/22 essentially means that TSC had received the FP on that date.
I have an infopass on 14th I will see what information they will provide.

True. They are already preparing tax returns from India. I've heard of some tax preparers (competition to H&R Block) who have a VoIP phone and prepare tax returns by interviewing the tax filer. And they are lot more effective in getting a return. A small correction to AmericanDesi's observation that EB1 is for Ph.d . You don't need a formal Ph.d for EB-1. If you have demonstrable extraordinary ability which will benefit the US government and people, you come under that category. This usually requires 40+ peer reviewed publications in International Journals in your area. It isn't that easy buddy getting in under EB1 if you think that all you have to do is to be in school for 5 years and submit a thesis at the end of it. And it is getting tougher and tougher to get in under EB1 as they are scrutinized more.

I was just getting more information on EB3 India on the net.And found an interesting blog(It makes sense to me and that why i am posting this thread)

There are 140,000 visa numbers available under all the employment based categories, with 7% per country limit and 28.6% allocated for EB3 and dependents counted into the numbers, there are only about 115 EB3 primary applicants allowed from India per month. Throw in a few thousand illegals(amnesty) into the mix and now you have the royal screw-up as is happening now. The law allows visa numbers from unused countries to be transferred to the oversubscribed countries but with nearly every category retrogressed this law won't apply for a while.
The future looks toooo dark even to mention.

You can put in a conditional order and let it work...........but it is better if you moitor it .
